The Town of Fuquay-Varina appreciates the opportunity to respond to the Notice
of Violation dated March 13, 2024, for Sanitary Sewer Overflow (SSO) incident #
202400421 that occurred on February 5, 2024, because of a spill associated with a force
main from our Northwest Regional sewer lift station. It is our intent that this response
will provide sufficient additional information regarding the incident and justification that
the Town should not be assessed a civil penalty.
Cause of Non -Compliance:
On February 5, 2024, town staff were performing preventative maintenance on an
air release valve (ARV) when the valve assembly broke off from the force main pipe.
Remedial Action Taken:
Town of Fuquay-Varina sewer collection staff in conjunction with contractors
established containment and began to pump and haul from the containment area. Pump
and haul also occurred at the Northwest Regional and Basil Creek sewer lift stations to
remove the flow on the sewer force main. Utility crews were able to isolate the broken
section of the ARV assembly, install a new tapping saddle and ARV and return the force
main to service. The area where the sewer was contained was washed down, limed,
seeded, and strawed. The Northwest Regional and Basil Creek lift stations were placed
back into service the same day. All sewer from the pump and haul was returned to the
collections system. No sewage reached the surface waters of the State during this
incident. The cost the Town of Fuquay-Varina incurred from contractor services for
pump and haul and ARV assembly replacement was $60,986.56.

As demonstrated, Operation and Maintenance personnel were responsive and took
immediate action to respond and resolve the issue and initiated corrective action to
address the broken air release valve. Unfortunately, the valve did break, and a spill was
created but no detrimental impact to the environment was caused. We believe this letter
justifies our commitment to maintaining the collection system and we hope that the
Division recognizes these efforts. Therefore, we respectfully request that the Division not
take any further enforcement action against the Town.

The self -reported Sanitary Sewer Overflow (SSO) 5-Day Report submitted by Town of Fuquay-Varina indicates
violations of permit conditions stipulated in the subject permit and North Carolina G.S, 143-215.1. Violations Include
failing to effectively manage, maintain, and operate the subject collection system so that there is no SSO to the
land or surface waters and making an outlet to waters of the State for purposes of G.S. 143-215.1(a)(1), for
which a permit is required.

Remedial actions, if not already Implemented, should be taken to correct the above noncompliance. Please submit
a written response to this Notice of Violation. Your response is to be received by the regional office ' hwlt in 15
business days following receipt of this violation. Please Include any additional documentation about this Incident(s)
in the response. The submittal will be considered in determining whether the Division will assess a civil penalty for
the cited violations.
