Dear Mr. Perry:
On March 20, 2024, Division of Water Resources (DWR) Raleigh Regional Office (RRO) staff Jesse Barnes conducted
a routine compliance evaluation inspection at the single family wastewater treatment system located at 5601
Greenbay Dr, Durham, NC 27712 in reference to NPDES General Permit NCG550000 and Certificate of Coverage
NCG550774. Owner Macon Perry was present during the inspection. A review of the permit requirements, treatment
components, septic tank, disinfection, outfall, sampling, records, operations, and maintenance was completed. This
review reflected noncompliance with the subject permit. The determined permit violation(s) and item(s) of concern
are listed below, along with other observations. Inspection findings are detailed in the attached Water Compliance
Inspection Report.
Permit Violation(s
1. Part I, Sections B. (1.) and D. (1.) of the subject permit require the treatment system to maintain disinfection
at all times. Mr. Perry stated that tablets are not regularly applied to the chlorinator tube. The tube cap
could not be removed during the inspection to check for tablets and proper operation. Domestic wastewater
disinfection tablets with the active ingredient calcium hypochlorite must be maintained within the chlorinator
tube at all times.
2. Part I, Section D. (6.) of the subject permit requires a visual review of the outfall location twice each year.
Mr. Perry stated that the location of the outfall is unknown. Previous inspections in 2010, 2015, and 2019
also noted that the outfall location was unknown. DWR staff were unable to locate the outfall during the
inspection. All system components must be located, inspected, and maintained in accordance with permit
uirements.
3. Part I, Section C. (3.) of the subject permit requires annual monitoring and recordkeeping of the listed
parameters of the system effluent discharged from outfall 001. Mr. Perry stated that no effluent monitoring
has been conducted.

4. 1 No written records or receipts of septic tank maintenance were provided.
A significant amount of flowing water was observed seeping up from the ground and pooling near the
southwestern corner of the subject parcel. DWR staff could not determine the source of the seepage and
the water appeared to be clear and odorless. No evidence of septic system failure was observed.
Other Observations
5601 Greenbay Dr, Durham, NC 27712 is a single family wastewater treatment system. Version 4.0 of NPDES
General Permit NCG550000 and Certificate of Coverage NCG550774 became effective December 17, 2021, and will
expire at midnight on October 31, 2025. The facility is authorized to discharge wastewater treated in accordance
with the subject permit via Outfall 001 to the nearby Unnamed Tributary (UT) to Crooked Creek (Stream Index: 27-
2-18), classified as Water Supply IV (WS-IV) and Nutrient Sensitive Waters (NSW) of the State within the Neuse
River Basin (03-04-01).
The residence is owned by Macon Perry and currently occupied by renters. The septic tank is located beneath the
concrete driveway, at the south side of the home. Mr. Perry stated that the septic tank is inspected and pumped
annually and he believes it was last pumped in October 2023. See Item 4, above. A chlorinator tablet tube is located
in the back yard approximately 30 yards west of the septic tank. See Item 1, above. Mr. Perry stated that there
have not been any issues with the wastewater treatment system. Recent annual fees have been paid and there is
no outstanding balance.
Corrective actions that address all violation(s) and/or item(s) of concern listed above should be planned and
completed within a reasonable time. Failure to complete corrective actions and achieve permit compliance
within a reasonable time may result in further enforcement actions.
Please be aware that the Division may take enforcement action against any individual who fails to comply with the
requirements of all applicable permits, regulations, and/or statutes. Pursuant to NC General Statute (NCGS) 143-
215.6A, a civil penalty of not more than twenty-five thousand dollars ($25,000.00) may be assessed against any
person who violates or fails to act in accordance with the terms, conditions, or requirements of any permit, or
applicable regulations, issued pursuant to G.S. 143-215.1.
