On behalf of Lipscomb Development, we are applying for a Nationwide Permit 29 from the US Army
Corps of Engineers (USACE) for proposed impacts to jurisdictional waters associated with the project
known as the Jones Tract Subdivision. A Preliminary Jurisdictional Determination request package is
being submitted under a separate cover. The purpose of the proposed project is to establish a
residential development and related infrastructure located on the north side of Covered Bridge Road,
west of Bobbitt Road, in Clayton, Johnston County, North Carolina.
The project also qualifies for coverage under the corresponding Water Quality General Certification
4256 (GC 4256) from the NC Division of Water Resources (DWR). The project does not meet any
circumstances or thresholds identified in items a) through j) of GC 4256. Therefore, written
authorization for the project is not required from the DWR, provided all activity -specific and general
conditions included on pages 4 through 18 are met. A courtesy copy of the application is attached.
A list of the attachments to the online Pre -Construction Notification Application and those attachments

rules. There may be other streams located on the property that are not depicted on the maps referenced above and
are therefore not subject to the buffer rules. However, if the stream features are present on the tract they are subject
to all other applicable North Carolina stream standards and permitting requirements as outlined in 15A NCAC 02B,
and may be considered jurisdictional according to the US Army Corps of Engineers.
This on -site determination shall expire five (5) years from the date of this letter. Landowners or affected
parties that dispute a determination made by the DWR may request a determination by the Director. An
appeal request must be made within sixty (60) days of date of this letter. A request for a determination by the

information for your project review under the National Environmental Policy Act of
1969 (P.L. 91-190, 42 U.S.C. 4321-4347, 83 Stat. 852), as amended. A copy of this

The species conclusions table in the enclosed project review package summarizes
your ESA and Eagle Act conclusions. Based on your analysis, mark all the
