NORTH CAROLINA Director Environmental Quality To: Mickey Sugg, USACE Field Office Chief CC: Sarah Hair, USACE Project Manager Stephanie Goss, DWR 401 Supervisor Subject: Reasonable Period of Time Extension Request — West Carteret Co Boat Launch; Carteret; Corps Action ID# SAW-2010-00175; DWR# 20230797 Dear Field Office Chief; On June 5, 2023, the Division of Water Resources (DWR) received an application from Quible and Associates on behalf of Carteret County for an Individual 401 Water Quality Certification for the West Carteret County Boat Launch in Carteret County. On February 16, 2024, the DWR requested additional information from the applicant regarding the modeling and flushing analysis information, mitigation plan details, and project specific details. A response to this request was received on March 18, 2024. DWR is requesting additional time to review the information received by DWR based on the complexity of the project, the need to coordinate the modeling and flushing analysis information with DWR's Basin Planning Branch Staff, the need to coordinate the mitigation plan information with DWR's mitigation specialist to complete the 401 review and the applicant's request to participate in a meeting with State resource agency personnel that has yet to be scheduled. In accordance with the Final 2023 Clean Water Act Section 401 Water Qualitv Certification Imorovement Rule, Section 121.6(e), (e) The Federal agency and certifying authority may agree in writing to extend the reasonable period of time for any reason, provided that the extension shall not cause the reasonable period of time to exceed one year from the date that the request for certification was received. As such, DWR respectfully requests that the reasonable period of time be extended until June 4, 2024. By making this request, DWR does not waive its right to determine that additional information or time is necessary to process the application in accordance with Corps regulations implementing section 401 of the Clean Water Act, or any actions taken by the Corps pursuant thereto.
