1.Wetlands
Beth Reed from Kimley Horn reviewed permitting:
• Reviewed Gordon Road access road alignments proposed by
NCDOT
• 3 acre additional wetland impact anticipated from road
construction (assuming —100 -foot roadway corridor)
• Tentative bridge over railroad (discussed the presence of the
rail spur in the area)
• USACE (David Shaffer) discussed that road impacts may be
required to be included as part of Novo permit application since
USACE

the road did not have independent utility. He will confirm with
Raleigh Field Office Chief—Jean Gibby
• NCDOT (Chad Coggins) discussed that NCDOT did not currently
have funding in place for the project and that the anticipated let
date was not scheduled until June 2017, therefore, it would be
preferable to permit the road separate from the Novo project
due to schedule sequence.
2. Stormwater
Management
Mike Apel (Fluor Storrawater), Todd St John closed out
• Reviewed plan, mentioned temporary sediment traps adjacent
to construction areas will be used and will likely be within
footprint of final basins shown on plans
• Basin 1— expected to be about 3-5 ft. deep wet detention pond
(fishing likely)
• Basin 2 & 3 are dry ponds
• Basin 4 is a created wetland, explains why it is bigger
• Johnston County nutrient requirements were discussed
• Water from stormwater basins will be released (at non-erosive
velocities) into adjacent wetlands

• Alternatives Analysis (Section 404 (b)) will be critical component
of permit review, this includes both off-site alternatives as well
as on-site alternatives
• Information covered in Novo presentation needs to be
discussed as part of application documentation
• Preservation of on-site wetlands not impacted by the project to
help permit fulfill mitigation requirements was discussed.
USACE said wetland preservation is not common for Individual
Permit Applications, and USACE recalled requiring/seeing a 10:1
ratio minimum requirement. In addition, if on-site wetlands
were used for preservation/mitigation, they would be put into a
conservation easement which would prohibit further
development impacts in the areas which could be a potential
conflict for Novo in years to come.
• All mitigation for impacts will be 2:1 unless other justification is
supplied with application
• USACE said even though these are Rains (soil) flats, 2:1 likely,
despite likelihood of wetlands being completely dry (i.e. low
quality) during periods of the year since they are primarily
precipitation driven systems. NCDWR indicated that mitigation
requirements for Isolated wetlands would be at a 1:1 ratio
• Any temporary wetland impacts will require the inclusion of a
restoration plan (wetland seed mix, etc.) in application
• USACE/NCDWR stated that we need more info shown/included
on the Phase 2 development areas including building footprints.
• USACE discussed off-site alternatives analysis with examples of
the type of documentation they will need to justify questions
such as: — "Why can't Novo locate 3 miles down road?" "Why
expansion needed when API product has been coming from
Denmark previously?"
o USACE/NCDWR mentioned a link to proximity of new
site to the existing facility may help satisfy some of
these type questions
o USACE said their alternatives review specifically must
consider 1) Cost, 2) Logistics, and 3) Existing Technology
o USACE mentioned that cost is not necessarily a function
of total construction cost, but rather what is 'normal' or
'typical' for a particular industry (i.e. a million dollars is
significant cost, but if the industry cost is typically 20
million for similar activity, a million is not necessarily
significant)
o USACE suggested showing a figure with the off-site
alternatives and parcels, but will follow up on detail
required for off-site locations (after Gary Lohr
mentioned sensitivity of releasing alternative site

• USACE suggested documenting age/presence of the old farm
road crossing near wetland WA with a suspected year. Possibly
include aerial imagery supporting argument to demonstrate
existing culvert was in place prior to the implementation of the
Clean Water Act and therefore, new crossing would not be
considered a wetland impact.
