That is correct, they do want to request phased mitigation. The proposed phasing would be as
follows:
For crossing RL -1, mitigation payment would be made by July 1st, 2018 or 60 days prior to start
of construction, whichever comes first. Final design drawings will also be submitted at this time,
if dissimilar to originally permitted drawings.
For the pond rehab, S-1, mitigation payment would be made by January 1st, 2019 or 60 days
prior to start of construction, whichever comes first. Final design drawings will also be
submitted at this time, if dissimilar to originally permitted drawings.
For crossings R-2, R-3, and R-4, mitigation payment would be made by January 1st, 2020 or 60
days prior to start of construction, whichever comes first. Final design drawings will also be
submitted at this time, if dissimilar to originally permitted drawings.
For crossing R-5, mitigation payment would be made by January 1st, 2022 or 60 days prior to
start of construction, whichever comes first. Final design drawings will also be submitted at this
time.

Attached is the updated acceptance letter from DMS, including mitigation acceptance for the
riprap impacts associated with the emergency spillway (S-1).

R-2 as perennial.
