The stream has severe erosion due to past channel work and damage to the bank due to cattle having access to the stream A barn is being damaged due to washing at the foundation. Page 10 of 10 United States Department of the'Interior FISH AND WILDLIFE SERVICE Asheville Field Office 160 Zillicoa Street Asheville, North Carolina 28801 February 11, 2015 Mr. Rodney Wright Stokes County Soil & Water District PO Box 98 Danbury, North Carolina Dear Mr. Wright: Subject: Federally Endangered and Threatened Species Assessment, Little Snow Creek Habitat Enhancement and Stream Bank Stabilization Project, Located South of the Intersection of Moorefield Road and Little Snow Creek Road, in Stokes County, North Carolina On February 10, 2015, we received a letter from you (via e-mail) in which you requested our review and comments on the proposed project. We have reviewed the information presented and we are providing the following comments in accordance with the provisions of the Fish and Wildlife Coordination Act, as amended (16 U.S.C. 661-667e), and section 7 of the Endangered Species Act of 1973, as amended (16 U.S.C. 1531-1543) (Act). According to the information provided, the project consists of restoring the dimension, pattern, and longitudinal profile of a section of Little Snow Creek. The stream channel will be realigned to create a more stable pattern. The overall stream channel length in the project area will be reduced from 2,156 linear feet (If) to about 1,7001f. A pump around system will be used to dewater the area during construction. The stream banks will be reshaped/re-sloped, stabilized with coir matting and sod mats, and replanted with salvaged woody vegetation. Although rock cross vanes, log vanes, and J -hooks, toe wood, and root wads are proposed for use in constructing the new stream channel, your letter did not include specific site plans or designs for the proposed project. According to your letter, initial surveys (including an aquatic survey) for federally listed species were conducted at the site on May 31, 2012. An additional survey for the federally endangered small-anthered bittercress (Cardamine micrantera) was conducted on August 29, 2014. No federally listed species were found during the surveys. Suitable habitat for small-anthered bittercress, although limited, was found within the project area. Based on the information provided and a review of our database, we believe that no listed species occur within the proposed project area. Because suitable habitat for small-anthered bittercress occurs within the project area, we believe the proper determination is "may affect, not likely to adversely affect" for this species. For all other federally listed species that were included in the county list, we believe the proper determination is "no effect". Therefore, the requirements under section 7 of the Act are fulfilled. However, obligations under section 7 of the Act must be reconsidered if: (1) new information reveals impacts of this identified action that may affect listed species or critical habitat in a manner not previously considered, (2) this action is subsequently modified in a manner that was not considered in this review, or (3) a new species is listed or critical habitat is determined that may be affected by the identified action. We have no objection to the proposed actions and support any efforts to restore and protect the water quality in the project area. We appreciate the opportunity to provide these comments. Harris Director On June 19th, I accompanied Rodney Wright, Watershed Conservationist with the Stokes County Soil and Water Conservation District, to evaluate property owned by Bradley Robertson for the presence of jurisdictional wetlands. The wetland determination was general in nature and associated with a stream stabilization project on little Snow Creek. Little Snow Creek runs through Mr. Robertson's property and threatens to undercut a farm structure—thus, initiating the stabilization project. This letter relates preliminary findings prior to a definitive wetland determination performed by the U.S. Army Corp of Engineers. The site is located at Mr. Robertson's residence at 2073 Moorefield Road, Danbury, NC 27016 in Stokes County. It is a pasture in the flood plain of Little Snow Creek. The creek runs west to cast through the middle of the pasture. Hills surround the site on the north, south, and east sides. The latitude/longitude is 36'27'59"N, 80° 10'23" W. The primary factor used to make the wetland determination was the presence of hydric soils. A sharpshooter spade and a hand auger were used to evaluate the soil. Soil munsell color charts were used to describe soil color. Only general observations were made of hydrologic indicators and wetland plants. The site is mapped Dan River and Comus soils, 0 to 4 percent, occasionally flooded (DaA). Both soils occupy flood plain landscape positions. Both are very deep (>60 inches to weathered bedrock) and well drained. On site observations revealed coarse -loamy to sandy soils with strong brown to yellowish red soil colors. No gray or gleyed redoximorphic matrices or mottles were observed in the upper 12 to 18 inches of the soil surface, No dark surfaces or organic coated sand grains were observed, The entire site was traversed and spot checked. No hydric soils were observed at this site. General observations were made regarding wetland plants and hydrologic indicators. In general, walnut trees (Juglans nigra), a FacU tree, dominates the tree stratum. Sycamores (Platanus occidentalis) ate next in abundance. A few of birch trees (Betula spp.) were observed, as well. The latter two tree species are FacW and occur in the immediate vicinity of Little Snow Creek. The herbaceous layer had isolated plants of common needle rush (Juncus effuses), a FacW plant, occurring near the water line of the creek. Cane (Arundineria spp.), also FacW, occurs near the water, but is more widespread. Microstegium vimineum, a Fac+ plant, is especially common in shaded areas adjacent to the creek. No hydric soils are associated in spots where Fac or wetter plants dominate. Aerial photos reveal sandy deposits in areas adjacent to the stream. A high cut bank undercutting the foundation of a farm structure gives stark evidence of flooding. No other hydrologic indicators were noted. Given these findings, I have a high level of confidence that the site contains no jurisdictional wetlands.
