Division personnel have reviewed and approved your application. Accordingly, we are forwarding the attached NPDES discharge permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143- 215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated May 2004, and as subsequently amended. We understand the new ultra low chlorine limit will take effect immediately since dechlorination facilities are already in place. We do have a concern that we would like to have addressed. We wish to have the chronic toxicity requirement removed from the permit. The test using ceriodophnia dubia is inherently flawed and has come under question in many areas. In the past, your division has often allowed "substitution" of whole effluent toxicity for a nitrogen ammonia limit (the permit does not currently have one). We would like to pursue this since the plant has extended aeration treatment, and we should be able to meet an NH3 H limit. Please give me n call at 704-52.5-7990, Ext. 216 if ynn should have any questions or need additional information. Thank you for your attention and consideration. Si erely, LL Martin Lashua 1'. We do wish to do this. I understand from your message we would be permitted for a 6 mg/1 in the summer and a 3 mg/1 in the winter and we would prefer this to the chronic toxicity testing and believe we would have no problem with compliance. If you need any further elaboration, please let me know. Thanks in advance.
