Dear Mr. Lashua:
The Division received your application for a wastewater discharge permit on March 7, 2005. Division
personnel have reviewed and approved your application. Accordingly, we are forwarding the attached NPDES
discharge permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143-
215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection
Agency dated May 2004, and as subsequently amended.
A Total Residual Chlorine (TRC) limit has been added to this permit. Because the subject facility is equipped
with a dechlorination system, the TRC limit will take effect with the effective date of this permit, November 1,
2005.
If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to
you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following
receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of
the North Carolina General Statutes, and filed with the Office of Administrative Hearings, 6714 Mail Service
Center, Raleigh, North Carolina 27699-6714. Unless such demand is made, this decision shall be final and
binding.
Please note that this permit is not transferable except after notice to the Division. The Division may require
modification or revocation and reissuance of the permit.
This permit does not affect the legal requirements to obtain other permits which may be required by the
Division of Water Quality or permits required by the Division of Land Resources, the Coastal Area
Management Act or any other Federal or Local governmental permit that may be required.

All previous NPDES permits issued to this facility, whether for operation or discharge are hereby
revoked. As of this permit issuance, any previously issued permit bearing this number is no longer
effective. Therefore, the exclusive authority to operate and discharge from this facility arises under
the permit conditions, requirements, terms, and provisions included herein.

Dear Ms. Manuel,
We are in receipt of your August 3, 2005 letter and draft permit. We understand the new ultra low
chlorine limit will take effect immediately since dechlorination facilities are already in place.
We do have a concern that we would like to have addressed. We wish to have the chronic toxicity
requirement removed from the permit. The test using ceriodophnia dubia is inherently flawed and has
come under question in many areas. In the past, your division has often allowed "substitution" of
whole effluent toxicity for a nitrogen ammonia limit (the permit does not currently have one). We
would like to pursue this since the plant has extended aeration treatment, and we should be able to
meet an NH3 H limit.

I received your voice mail about our request to delete the chronic toxicity from the permit and add a NH-3
limit.
We do wish to do this.
I understand from your message we would be permitted for a 6 mg/1 in the summer and a 3 mg/1 in the
winter and we would prefer this to the chronic toxicity testing and believe we would have no problem with
compliance.
If you need any further elaboration, please let me know. Thanks in advance.
