In accordance with the application for discharge permit received on April 11, 1997, the Division is
forwarding herewith the subject state - NPDES permit. This permit is issued pursuant to the requirements of North
Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S.
Environmental Protection Agency dated December 6, 1983.
Because of the close proximity of Sunset Apartments and its wastewater treatment system to Woodland
Hills, the Division strongly encourages Woodland Hills and Sunset to open a dialogue for the consolidation of the
two discharges. Such a consolidation could precipitate long-term beneficial impacts to the receiving stream and the
surrounding ecosystem.
If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to
you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of
this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North
Carolina General Statutes, and filed with the office of Administrative Hearings, Post Office Drawer 27447, Raleigh,
North Carolina 27611-7447. Unless such a demand is made, this permit shall be final and binding.
Please take notice that this permit is not transferable. Part II, EA. addresses the requirements to be
followed in case of change in ownership or control of this discharge. This permit does not affect the legal
requirements to obtain other permits which may be required by the Division of Water Quality or permits required by
the Division of Land Resources, Coastal Area Management Act, or any other Federal or Local governmental permits
may be required.

The permit shall become effective February 1, 1998
This permit and the authorization to discharge shall expire, at midnight on September 30, 2002

2. Discharge from said treatment works at the location specified on the attached map
into Brushy Fork Creek which is classified C waters in the Watauga River Basin.

No treatment system modifications have occured since the last permit was issued. Raleigh
requests that the Regional Office comment on the installation of ammonia limits based on the
zero flow nature of the receiving stream. There have been a few compliance problems over the
past two years, however for the most part, this treatment system seems to be operating well.
The monitoring frequencies in the existing permit are that for a class II facility so no
modification is proposed. Instream sampling remains in place with the upstream location being
50 feet above discharge point and the downstream location being 100 feet below the discharge
point.

through the middle of Boone. At the stoplight turn left on the 105 Bypass (NCSR 1107). The
apartments are on the right side of the road. The treatment plant is under the apartment buildings in
the basement.

The permit was modified on January 5, 1996 to delete influent sampling for BODS and total suspended
residue. Influent sampling is still not necessary.
3. Important SOC, JOC or Compliance Schedule dates: (Please indicate). None.
4. Alternative Analysis Evaluation: Has the facility evaluated all of the non -discharge options available.
The discharge is into a zero flow stream. The last permit did not require an alternatives
analysis evaluation. An AAE should be done.
5. Other Special Items: None
PART IV - EVALUATION AND RECOMMENDATIONS
A review of the self -monitoring results for 1996 indicates compliance with all current final effluent permit
limits. Woodland Hills and Sunset Apartments discharge to Brushy Fork Creek, a zero flow stream. Sunset
Apartments is close to this facility. The renewal for Sunset has proposed limits of 5 mg/l BOD5 and 2 mg/l
ammonia limits. To be consistent, this plant might need to meet similar limits for the zero flow stream.
In the file history, it has been mentioned numerous times that Woodland Hills and Sunset Apartments need to
build one treatment plant to serve both facilities. The treatment plants currently in use are very old and
outdated. Both plants were made from concrete units which have deteriorated. The permittee for Sunset will
probably have to spend money for new treatment units to meet new limits. Now would be a good time to
encourage consolidation of the two plants.
If the Woodland Hills permit requires limits similar to Sunset, the plant will definitely need to upgrade. The
following items need to be included in the permit if the 5 mg/l BOD5 and 2 mg/l ammonia limits are given:
1. A 12 month compliance schedule for the facility to meet the effluent limitations of the permit.
2. A statement requiring the permittee to obtain an authorization to construct to upgrade the existing
facilities to meet the effluent limitations of the permit.
Recommendation is made to renew the permit in accordance with division policy.
