9. PROJECT DESCRIPTION
The project site is located at 6500 Carmel Trail/ 6408 Providence Point Road/ 6418 Providence Point Road,
adjacent to Howe Creek, in Wilmington, New Hanover County,
According to the application, the riparian parcels located at 6500 Carmel Trail/ 6408 Providence Point Road/
6418 Providence Point Road have a maximum elevation of approximately 13 - 16' above normal high water
(NHW) and is approximately 67,343 sq.ft. cumulatively (1.56 acres). Each lot has a single-family home with
high ground that consists of trees, shrubs, and maintained lawn grasses. The adjacent riparian parcel at 6504
Carmel Trail has a single-family residence with a private docking facility and a naturally stabilized shoreline.
The adjacent riparian parcel at 6404 Providence Point Road has a single-family residence, in -ground
swimming pool, and a private docking facility with a naturally stabilized shoreline. The project sites have a
total shoreline frontage of approximately 257 linear feet that is naturally stabilized, There is an approximately
300' wide area of Coastal Wetlands located waterward of the project sites, that primarily consists of Spartina
alterniflora (Smooth Cordgrass). Other present Coastal Wetland species include Juncus romerianus (Black
Needlerush) and Cladium jamaicense (Saw Grass).
The applicants currently maintain a shared private docking facility that consists of three (3) separate access
piers that begin from the shoreline of each applicant (Gabriel, Warren, and Rawls) and meet at a fixed 16'
long x 12' wide fixed platform. The access pier from the Warren property measures approximately 35' long x
5' wide. The access pier from the Rawls property measures approximately 70' long x 5' wide. The access
pier from the Gabriel property measures approximately 55' long x 5' wide. There is also a set of access steps
extending from the south facing side of the 16' x 12' fixed platform. From the fixed platform, there is an
approximately 331' long x 5' wide fixed pier that extends waterward to Howe Creek. At the end of the fixed
pier there is a fixed platform that measures approximately 16' long x 12' wide, which extends to the south.
Approximately 30' landward of the fixed 1-head" platform, there is an existing davit lift (see Warren, Rawls,
and Gabriel Riparian Survey). The current structure was previously authorized by State Permit No. 120-18
that was issued to Donald Warren, William Chapman, William Rawls, and Charles Scanlon on October 30,
2018. The permit expired December 31, 2021. State Permit No. 120-18 was then renewed on December 6,
2021 and expired December 31, 2023, It appears that some changes to the configuration of the fixed 1-head"
platform were made at the time of construction.
The New Hanover County Land Use Plan classifies the adjacent waters as Conservation, and the adjacent
high ground portion of the project area as Residential. The adjacent waters of Howe Creek in the project
area are classified SA;ORW by the Division of Water Resources and this area IS designated as Primary
Nursery Area (PNA) by the N.C. Division of Marine Fisheries. They are CLOSED to the harvest of
shellfish.
PROPOSED PROJECT
The applicants propose to remove an existing davit, install a solar -powered platform lift and install three (3)
new davit systems with a fixed access platform at an existing pier for a total of (3) slips.
The applicants propose to install an approximately 12' long x 12' wide solar -powered platform lift adjacent
to the southwest facing end of the existing fixed "L-head" platform. The water depths in the proposed
footprint for the platform lift were taken by the applicant on 8/06/2023 between 7:15 PM and 8:15 PM (low
tide). The water depths that were recorded were approximately — 0.58' (— 7 inches) and — 0.92' (— 11

inches). The proposed platform lift would be located approximately 34' from the adjacent riparian line and
would not require a 15' riparian setback waiver (see Warren, Rawls, and Gabriel Riparian Survey). The
applicants have stated that the intention for the platform lift would be used to access personal watercraft
and kayaks (see MP-1 form). The proposed solar -powered platform lift would not be considered a
formalized slip.
Once the existing davit is removed, the applicants propose to install three (3) new davit systems and a fixed
walk platform adjacent to the northeast facing side of the existing pier. The davit systems would be located
landward of the existing fixed I -head" platform by approximately 36'. The installation of the new davit
systems would involve the driving of four (4) new pilings approximately 6' to 7' out from the existing pier
(see Warren, Rawls, and Gabriel Riparian Survey). The four pilings would then be connected by
aluminum I -beams and the design would not include cradles or bunks. The proposed davit systems would
lift the personal watercraft from the top mounts and would be designed to be manually operated (see
Exhibit A). The water depths in the proposed footprint for the three davit systems were taken by the
applicant on 8/06/2023 between 7:15 PM and 8:15 PM (low tide). The water depths that were recorded
were approximately — 0.33' (— 4 inches), - 0.42' (— 5 inches), and — 0.67' (— 8 inches) (see Warren, Rawls,
and Gabriel Riparian Survey). The addition of the three davit systems would result in a total of three (3)
slips at the structure,
The applicants have also proposed the construction of a fixed access platform for the proposed davit
systems. The fixed walk platform would be directly adjacent to the existing fixed pier and would measure
approximately 51' long x 2' wide. The applicants indicate that the platform would be located approximately
4' below the elevation of the existing pier and would use the existing pier pilings for support (see GRW
Proposed 1, 2a, 2b of 2 and Exhibit A (6)), The walk platform would be located for the applicants to utilize
for access to the watercraft from the proposed davit systems.
The proposed davit systems would be located more than 20' from the adjacent riparian line and would not
require a 15' riparian setback waiver. However, the adjacent riparian neighbor, Scanlon, did provide the
applicants with a signed riparian setback waiver.

10. ANTICIPATED IMPACTS
The proposed solar -powered platform lift, three davit systems, and fixed access platform, would result in
the shading and incorporation of a maximum of 246 sq.ft. of Estuarine Waters and Public Trust Area in
PNA Waters. Water depths within the footprints of the proposed platform lift and davit systems range from
approximately from -0.33' to -0.92' at Normal Low Water (NLW). The proposed structures would not
encroach into either adjacent 15' riparian setback. Minor increases in turbidity can be expected during
construction.

Please provide a narrative letter that should describe the existing facility and site
conditions, discuss the character and purpose of the proposed development,
construction methodologies, specific intended use for proposed structures, and any
other special or relevant considerations. Please describe further how the proposed
davits and platform lift are to be utilized.
The existing facility consists of three short docks from each of the properties to a shared 11.9'
by 15.7' platform. From that platform, another dock extends approximately another 331.6' ft to a
platform that is 11.7' by 15.6'. The general direction is from the North West to the South East.
More specific details are included in the included survey from Charles Riggs signed 12/6/23.
The dock is shared by three neighbors and is used for recreational access to Howe Creek. The
proposal is to remove an existing attached davit lift (Noted is the survey as Existing Boat Slip),
Add three personal watercraft davit lifts adjacent to the dock (as described in the survey to) that
will be used to store and launch three small craft. (Additional details included in the included
GRW Platform & Davits Supplemental), and the installation of a solar powered water access
platform adjacent to the 11.7 by 15.6' platform at the SE end of the dock. The platform will be off
the SW edge of the platform.
The platform and davits will be used for recreational purposes for three residents and their
guests.
H&K will be contracted to drive the four pilings for the davit lifts and for the entire installation of
the solar powered water access platform, including driving the four pilings for the platform..
Construction methodologies will be handled by H&K and are described as "driving pilings" and
other typical installation practices.
The davits and the platform will include stops to prevent any contact with the substrate.

The Division of Coastal Management hereby acknowledges receipt of your application, as acting agent for Gabriel,
Warren, and Rawls, for State approval for development of the subject properties located at 6500 Carmel Trail, 6408
Providence Point Road, and 6418 Providence Point Road, on Howe Creek, in Wilmington, New Hanover County. It
was received as complete on March 21, 2024 and appears to be adequate for processing at this time. The projected
deadline for making a decision is June 4, 2024. An additional 75-day review period is provided by law when such
time is necessary to complete the review. If you have not been notified of a final action by the initial deadline stated
above, you should consider the review period extended. Under those circumstances, this letter will serve as your
notice of an extended review. However, an additional letter will be provided on or about the 75th day.
If this agency does not render a permit decision within 70 days from March 21, 2024, you may request a meeting with
the Director of the Division of Coastal Management and permit staff to discuss the status of your project. Such a
meeting will be held within five working days from the receipt of your written request and shall include the property
owner, developer, and project designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed development.
Enclosed you will find a "Notice of Permit Filing" postcard which must be posted at the property of your proposed
development. You should post this notice at a conspicuous point along your property where it can be observed from
a public road. Some examples would be: Nailing the notice card to a telephone pole or tree along the road right-of-
way fronting your property; or at a point along the read right-of-way where a private road would lead one into your
property. Failure to post this notice could result in an incomplete application.
An onsite inspection will be made, and if additional information is required, you will be contacted by the appropriate
State or Federal agency. Please contact me if you have any questions and notify me in writing if you wish to receive
a copy of my field report and/or comments from reviewing agencies.

Walk platform additional details.
The proposed walk platform will be mounted to the existing dock pilings at about MHWL parallel
to the proposed Davit lift slips.
There will be a ladder from the existing deck to the platform at MHWL.
The platform is decked with 2x6 (horizontal) running parallel to the dock.
Beneath the decking will be 2x6 (Horizontal) 16" o.c. that are supported by 2x8 (vertical box
framed) and 2x12 (vertical through bolted to the existing pilings.)
The 2x12 are the primary support. The 2x8 are box framed with the 2x12. The 2x6 cross the
primary "joists" and span across the joist to decrease sag in the decking.

discovered that additional information is needed for a complete application. Please clarify the additional

Narrative
Please provide a narrative letter that should describe the existing facility and site conditions, discuss
the character and purpose of the proposed development, construction methodologies, specific
intended use for proposed structures, and any other special or relevant considerations. Please describe
further how the proposed davits and platform lift are to be utilized.

• Mr. Lupo's submitted waiver form needs to be dated at the bottom.

I reviewed the documents you sent me and have quite a few comments and questions. Please see below.
Narrative
• Where is your narrative description for the project that describes the existing facility, what's being proposed,
and the purpose and need for the project?
MP-1 Form
• Form needs to be dated and signed where indicated.
• 3a: river basin is White Oak.
• 3c: Howe Creek is a natural waterbody.
• 3e: proposed work is not within city limits.
• 3f: the planning jurisdiction is New Hanover County_
• 4: Please fill out the sections for "Site Description", there are no answers listed in most of these boxes.
• 5d: please describe the activities that are being proposed. These are considered development activities.
MP-4 Form
• Form needs to be dated and signed where indicated.
Drawings
• All drawings need a title block that lists the project title and page numbers described as such (Page or Sheet 1 of
2 Pa a or Sheet 2 of 2
• The cross-section does not need the top -down view at the top of the sheet, that information should be covered
on the survey
• Please clearly identify the proposed structures on the cross-section drawing
• Please clearly identify and depict any presence of coastal wetlands in the cross-section drawing
• Please adjust cross-section scale to an engineering scale (eg: 1"=10', 1"-20', etc.)
• Please make sure to submit an example of the davit systems that you are proposing to install as part of your
proposal, this will be important information for the Division of Marine Fisheries as there are different types of
davit systems_
Neighbor Notifications
• Please submit either your certified mail receipts with the tracking numbers or signed green cards as evidence
that the adjacent riparian neighbors have been notified. This will need to be submitted along with all the other
application materials in order for the application to be considered complete.
Deeds
• Please submit the deeds that are associated with the properties involved in the project along with all the other
application materials in order for the application to be considered cornpicte.
