Staff review of the plans and specifications has determined that the project, as proposed,will comply with the Stormwater Regulations set forth in Title 15A NCAC 2H.1000. We are forwarding Permit No. SW8 020216 dated October 23, 2002, for the construction of Holden Beach Food Lion. This permit shall be effective from the date of issuance until October 23,2012, and shall be subject to the conditions and limitations as specified therein. Please pay special attention to the Operation and Maintenance requirements in this permit. Failure to establish an adequate system for operation and maintenance of the stormwater management system will result in future compliance problems. If any parts,requirements,or limitations contained in this permit are unacceptable,you have the right to request an adjudicatory hearing upon written request within thirty(30) days following receipt of this permit. SCHEDULE OF COMPLIANCE 1. The stormwater management system shall be constructed in it's entirety, vegetated and operational for its intended use prior to the construction of any built-upon surface. 2. During construction, erosion shall be kept to a minimum and any eroded areas of the system will be repaired immediately. 3. All connections into the stormwater system from future areas or outparcels shall be made such that short-circuiting of the system does not occur. 4. The permittee shall at all times provide the operation and maintenance necessary to assure the permitted stormwater system functions at optimum efficiency. The approved Operation and Maintenance Plan must be followed in its entirety and maintenance must occur at the scheduled intervals including,but not limited to: a. Semiannual scheduled inspections (every 6 months). b. Sediment removal. C. Mowing and revegetation of side slopes. d. Immediate repair of eroded areas. e. Maintenance of side slopes in accordance with approved plans and specifications. f. Debris removal and unclogging of outlet structure, orifice device and catch basins and piping. g. Access to the outlet structure must be available at all times- h. The vegetated filter will be kept grassed with no erosion. The spreader mechanism will be kept clear. 5. Records of maintenance activities must be kept and made available upon request to authorized personnel of DWQ. The records will indicate the date, activity,name of person performing the work and what actions were taken. 6. Decorative spray fountains will not be allowed in the stormwater treatment system. 7. The facilities shall be constructed as shown on the approved plans. This permit shall become voidable unless the facilities are constructed in accordance with the conditions of this permit, the approved plans and specifications, and other supporting data. 8. Upon completion of construction,prior to issuance of a Certificate of Occupancy, and prior to operation of this permitted facility, a certification must be received from an appropriate designer for the system installed certifying that the permitted facility has been installed in accordance with this permit, the approved plans and specifications, and other supporting documentation. Any deviations from the approved plans and specifications must be noted on the Certification. 9. A copy of the approved plans and specifications shall be maintained on file by the Permittee for a minimum of ten years from the date of the completion of construction. 10. Prior to the sale of any portion of the property, an access/maintenance casement to the stormwater facilities shall be granted in favor of the permittee if access to the stornwater facilities will be restricted by the sale of any portion of the property. 11. The permittee is responsible for verifying that the proposed built-upon area does not exceed the allowable built-upon area. 12. If the stormwater system was used as an Erosion Control device, it must be restored to design condition prior to operation as a stormwater treatment device, and prior to occupancy of the facility. 4 State Stormwater Management Systems Permit No. SW8 020216 13. Deed restrictions must be recorded prior to the sale of any portion of the drainage area, outparcel or future area shown on the approved plans to ensure that the new owners are made aware of the built-upon area limitations. The following statements must be recorded: a. The following covenants are intended to ensure ongoing compliance with State Stormwater Management Permit Number SW8 020216, as issued by the Division of Water Quality under NCAC 2H.1000. b. The State of North Carolina is made a beneficiary of these covenants to the extent necessary to maintain compliance with the Stormwater Management Permit. C. These covenants are to run with the land and be binding on all persons and parties claiming under them. d. The covenants pertaining to stormwater may not be altered or rescinded without the express written consent of the State of North Carolina, Division of Water Quality. e. Alteration of the drainage as shown on the approved plans may not take place without the concurrence of the Division of Water Quality. f. The maximum built-upon area for Outparcel 1 is 45,738 ftz and for Outparcel 2, 41,382 ft2; Future built-upon areas are limited to 168,577 ftz; the Hines property is limited to 37,462 ftz; as shown on the approved plans. These allotted amounts include any built-upon area constructed within the property boundaries, and that portion of the right-of-way between the lot lines and the edge of the pavement. Built upon area includes,but is not limited to, structures, asphalt, concrete, gravel, brick, stone, slate, coquina and parking areas,but does not include raised, open wood decking, or the water surface of swimming pools. g. The runoff from all built-upon area within the outparcel or future area must be directed into the permitted stormwater control system. h. Built-upon area in excess of the permitted amount will require a permit modification. i. The connection into the stormwater control shall be made such that short- circuiting of the system does not occur. j. Each outparcel or future development tract whose ownership is not retained by the permittee, shall submit a separate permit application to the Division of Water Quality and receive a permit prior to construction. 14. A copy of the recorded deed restrictions with all statements as listed above, must be submitted to the DWQ within 30 days of the date of the recording. The recorded copy must be signed by the permittee, dated, stamped with the deed book number and page, and bear the stamp/sea.] of.the Register of Deeds. 15. Built upon area includes,but is not limited to, structures, asphalt, concrete, gravel,brick, stone, slate, coquina and parking areas, but does not include raised, open wood decking, or the water surface of swimming pools 5 State Stormwater Management Systems Permit No. SW8 020216 16. The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies of revised plans and certification in writing to the Director that the changes have been made. 17. The permittee shall submit to the Director and shall have received approval for revised plans, specifications, and calculations prior to construction, for any modification to the approved plans, including,but not limited to, those listed below: a. Any revision to the approved plans,regardless of size. b. Project name change. C. Transfer of ownership. d. Redesign or addition to the approved amount of built-upon area or the drainage area. e. Further subdivision, acquisition, or sale of the project area. The project area is defined as all property owned by the permittee, for which Sedimentation and Erosion Control Plan approval and/or a CAMA Major permit was sought. f. Filling in, altering, or piping of any vegetative conveyance shown on the approved plan. 18. The Director may determine that other revisions to the project should require a modification to the permit. III. GENERAL CONDITIONS 1. This permit is not transferable. In the event there is a desire for the facilities to change ownership, or there is a name change of the Permittee, a formal permit request must be submitted to the Division of Water Quality accompanied by an application fee, documentation from the parties involved, and other supporting materials as may be appropriate. The approval of this request will be considered on its merits and may or may not be approved. The permittee is responsible for maintaining compliance with the permit conditions until such time as the Division approves the transfer. 2. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to enforcement action by the Division of Water Quality, in accordance with North Carolina General Statute 143-215.6A to 143-215.6C. 3. The issuance of this permit does not preclude the Permittee from complying with any and all statutes,rules,regulations, or ordinances which may be imposed by other government agencies (local, state, and federal)which have jurisdiction. 4. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the Permittee shall take immediate corrective action, including those as may be required by this Division, such as the construction of additional or replacement stormwater management systems. 5. The permittee grants DENR Staff permission to enter the property for the purpose ui inspecting all components of the permitted stormwater management facility. 6. The permit may be modified,revoked and reissued or terminated for cause. The filing of a request for a permit modification, revocation and reissuance or termination does not stay any permit condition. 7. Unless specified elsewhere,permanent seeding requirements for the stormwater control must follow the guidelines established in the North Carolina Erosion and Sediment Control Planning and Design Manual. 6 State Stormwater Management Systems Permit No. SW8 020216 8. Built-upon area in excess of the permitted amount requires a state stormwater management permit modification prior to construction. 5. All permitted runoff from outparcels or future development shall be directed into the permitted stormwater control system. These connections to the stormwater control system shall be performed in a manner that maintains the integrity and performance of the system as permitted. The project will consist of a Food Lion Grocery Store and 10 each (1200 s f) commercial shops. The project will.also have 2 present out parcels plus 1 area that is expected (but not presently) to become part of the shopping center. The project will have several areas of offsite property that will drain onto the project site and these areas have been taken into consideration during the design of the pond. The total drainage areas that will flow to the pond are as follows: 1) Food Lion Parcel (includes sanitary sewer plant and retention pond areas) 12.97 acres - on .site. 2) Out Parcel I, (1.1 acres-on site). 3)Out Parcel H, (1.0 Acres-on site). 4)Hines Property 0.9 acres - off site. 5) Various off site areas zoned commercial 3.3 Acres - off site. 6) Various off site areas zoned residential 5.0 Acres off site. We have assumed the off site residential parcels will be 50% impervious and the offsite commercial parcels will be 95% impervious. We have addressed each of your review items as follows: 1. We have added a note on Sheet #1 of the plans that no wet lands are present on the site as per information provided by owner/developer. 2. Holden Beach Land Group,LLC will have control of all the property as shown within the project area and therefore there should not be a need for an access easement to the retention pond area. If and when the property should change possession an access easement will be provided in order to assure continued access to the retention pond area. 3. We have specified emergent rush as the wetland plant to be planted on the 6:1 vegetated shelf. 4. We have reconfigured the pond design so that the travel path of the water has a total length of 667' while the overall width of the basin is 215'. This gives a length to width ratio of 667'/215' =3.1, which exceeds the 3:1 minimum required ratio. 5. We have added the location of Hwy 130 and Hwy 17 to the vicinity map. ' 6. We have added the maximum allowable built upon areas for Out parcel I and Out parcel H on the plan data sheet. We have not added the Hines property to the data sheet as it is not presently part of the project itself. We have considered it as an offsite parcel that is zoned as commercial and have used a 95% impervious area coverage in the design calculations for the ponds overall SA/DA requirement. We have also taken the parcel into account in our temporary storage volume needed in the pond. Should this parcel become part of the project in the future the restrictive covenants as submitted with the revised application can be amended to include this parcel. 7. We have redesigned the pond such that the pond no longer is encroaching onto any property of John Holden. This should relieve the requirement for such an easement for access and maintenance for the pond. The principal spillway and emergency by pass spillway have also been redesigned so that they now fall within an existing drainage swale easement that adjoins the project site on the northeast line as shown on the grading and drainage plan. 8. We have provided a.Va."versus storage table with the project narrative that shows that the runoff from the 1" rain event will be stored in the redesigned pond at an elevation of 33.21 and this is where we have set the top of the 12" tee for the principal spillway structure. Therefore the storage volume required is held between the elevations of 3 1.00 and 33.21. 9. We have added the temporary storage pool elevation to pond section A-A. 10. We have provided with this submission an offsite drainage area map, which specifies the offsite areas that contribute to the overall drainage area. The map shows the size of the areas, the current zoning of the areas and the design impervious amounts for each area. 11. We have provided a legend on the plans. 12. We have referenced the principal spillway structure on the plans as well as the detail. 13. We have extended the stormwater system so that it now touches and stubs into Out Parcel I. 14. We have redesigned the 18"drain lines that drain the water from the spoil area so that they first enter the forbay area. 15. We have provided a plan view of the permanent pool elevation 31.00 with its dimensions on Sheet#2. 16. We have redesigned the depths for the permanent pond areas as well as the forbay area and have shown the levels for sediment removal in the wet pond supplement form as part of the maintenance instructions. 17. We have reported all built upon areas as acres as well as square feet. 18. We have provided the latitude and longitude of the principal spillway on the revised application form. 19. We have provided the deed restrictions for future development on the sanitary sewer plant and spoil area as well as Out Parcel I and Out Parcel U. We have not included the Hines property on the deed restrictions due to the fact that Holden Beach Land Group, LLC does not currently have control of this property. These deed restrictions could be amended at some future date if this property is obtained by the Holden Beach Land Group,LLC. 20. We have separated the Food Lion built upon areas from the "other on site areas" and "offsite areas" as per your request. Remembering that the Hines property is currently classified as off site property zoned commercially and assumed for design purposes to be ?07impervious. 21. We have provided a 3" outlet orifice and have noted it as such on the plans and the supplement. 22. I have hand written my initials on the wet pond supplement form. 23. As previously mentioned we have provided a pond length to width ratio that is greater than 3 to 1. 24. I have initialed item'M"on the wet pond supplement. 25. We have reworked the overall calculations and they are in detail inside the project narrative. The revised calculations show a total drainage area to the pond of 24.27 acres and a total built out impervious area of 17.38 acres. This given an overall impervious area percentage of 17.38 acres =24.27 acres^ 71.61%. This is the figure we used to determine the required SA/DA percentage when we assumed a pond depth of 7.5'. 26. We have used the required percentages of 50% impervious for offshe residential and 95%impervious for off site commercial areas in our pond calculations. 27. We have used the.SA/bA table for the coastal counties and are furnishing a copy of this table with this correspondence. 28. The detail for the outlet structure indicates that the elevation of the top of the tee is 33, but the calculations use the volume in the pond between 31 and 34 to show that the required 1" volume has been provided. If 33 is the storage elevation,then either the calculations need to demonstrate that the required 1" volume is provided between elevations 31 and 33, or the tee elevation needs to be raised to 34. This may affect the orifice size since the driving head is reduced. 9. Please add the storage pool elevation to the Pond Section A-A. 10. Please clearly delineate(i.e., show property boundaries and outline them on a map)the overall drainage area and the 4 acre, 1.2 acre, and 3.1 acre offsite / drainage areas, and identify all existing built-upon area. 11. Please provide a legend on the plans. 12. Please be consistent when labeling the structures and details. The outlet structure on the grading plan is labeled as the "Principal Spillway Structure", but the detail is labeled as the "Outlet Detail". 13. Please provide a means for Outparcel#1 to direct its runoff into the pond. The collection system does not extend far enough up the access road to reach it, and no stub-out has been provided,as was done for Outparcel#2 and the Sandra Hines property. 14. All runoff must enter the pond through the-forebay: There is an 18" RCP that comes into the pond at the southeast corner from a temporary diversion berm along the east Hewett property line. Please either reroute the pipe into the forebay, or note that the pipe is also temporary and must be removed. I suggest piping this offsite runoff around the pond and directly into the ditch. 15. Please provide the dimensions of the permanent pool contour. 16. The pond depth must be maintained at 3' at all times,therefore,the sediment removal benchmark on the diagram on the supplement must be revised to 28 FMSL and the depth reported as 3'. You have shown the sediment removal benchmarks as elevations rather than depths. 17. Please report all built-upon areas in square feet on the application. 18. Please provide the latitude and longitude of the outlet structure of the pond on the application. 19. Please provide a copy of the proposed deed restrictions to include all required conditions and limitations as indicated on the enclosed document. Please include the built-upon limits for the outparcels and the Sandra Hines property. 20. In the lower part of Section III, Part 6 of the application, (the impervious area breakdown section),please split out the outparcel and future BUA's from the Food Lion BUM. Please correct the supplement, since a 4" orifice is too large. 22. Please handwrite your initials on the supplement. Regardless of the amount of excess surface area provided, short-circuiting of the pond is not allowed. The design errors that have been made will take away any excess surface that once existed. You have specified that a portable pump will be used as the mechanism to draw down the pond in an emergency. 25. The calculations have been done incorrectly. In order to determine the required permanent pool surface area,the entire 24.23 acre drainage area and all of the built-upon area(onsite,offsite, (see comment#26), outparcels and future)must be used. It is inappropriate to determine the surface areas required for the 12.93 acre site and the outparcels, separately and then add them together. Please revise. 26. Please account for the built-upon area within the 8.3 acres of offsite drainage area at the "full build-out potential", as required by the rules. The Division recommends bypassing offsite runoff. You do not own the offsite areas,therefore, you cannot force the offsite land owners to enter into agreements with you for sharing the cost of maintainin ff g the pond. If you do not bypass the offsite runoff please account for it as follows: if the area is an existing,developed subdivision, please account for it at 50%impervious; if it is an existing or possible future commercial development,please account for it at 95% impervious. This may increase the offsite BUA from 0.39 acres to as much as 6.49 acres. of 27. The SA/DA ratios your engineer has determined are way too low. It appears that the SA/DA table from the BMP document was used, but this is not the correct table,because it is only to be used for ponds in the Piedmont. A note at the bottom of that table tells you to call the DWQ Regional office to obtain the SA/DA tables to be used in the 20 coastal counties. This error, combined with the offsite BUA error,will result in the need for a much larger pond, unless the design depth is increased.The correct coastal SA/DA tables for 85%and 90% TSS removal are enclosed. V"28. Please provide a table of the pond elevations,beginning at the bottom and ending at the temporary pool elevation, and their corresponding surface areas and volumes that are provided in the pond. These soils were typically similar to the Kureb soil series. In general, soil water tables would exceed 6 feet for this soil. One portion of the area(see map)was disturbed and contained buried trash(wire, plastic, etc.). This area may have served as a trash dump in the past. Significant areas of soil have been removed(possibly mined)yielding lower elevations. In these areas we could not determine soil wetness by color.
