Dear Mr. David Cox:
The following is a response to Pat Durrett comments dated February 12, 2008. We believe that
additional work has been done after the inspection was conducted.
1) A signed Copy of the Engineer's certification is in the files as required.
Response: We sent the Certification to Ronda Hall on 1 22-0&
2) A signed copy of one O & M agreement is in the files, however an O& M agreement is need
for each pond
Response: We submitted an O&M agreement to Rhonda Hall on 122-08, showing elevations for
both ponds.
3) Both Pond A and Pond B have recently been cleaned out. A couple of issues still remain at
the site.
A. Both Pond A & Pond B still appear to have excess sediment in them.
Response: The ponds forebay & main body have been cleaned out so that the volume matches
the original permitted design. Please see as built ponds
B. There were some areas of erosion on the sideslopes that should be repaired.
Response: The sideslopes were permitted at a 1:1 slope, it is hard for a contractor to grade at a
45 degree angle.
C. There was little vegetation on the vegetative shelfs.
Response: There is now vegetation growing on the side slopes, it has been slow because of the
drought.

D. A pipe was noted going into the pond and not the forebay
Response: The pipe is a condensate line, from the nearby air condition unit.
E. We have not received any renewal information yet.
Response: We sent the Pond Certification & O&M Agreement to Ronda Hall on 1-22-08
F. The inlet for pond A forebay is nearly directly across from the outlet to the pond causing
short circuiting of the fore bay.
Response: The system was designed&permitted in the manner in which it lays.
G. Operation & maintenance records were not available during inspection. You are reminded
of your permit requirement to maintain O & M records.
Response: The O & M maintenance records can not be found.

Dear Mr. Duggan:
Please find attached a copy of the completed form entitled "Stormwater Compliance Inspection
Report". The report summarizes the findings of a recent inspection of the project's stormwater
controls conducted on January 10, 2008 to determine compliance with Stormwater Permit
Number SW8970521 issued on October 22, 1997.
The required actions that are necessary to bring this site into compliance are noted under the
Comments section of the report. Please inform this Office in writing within fifteen (15) days of
the specific actions that will be undertaken and the time frame that will be required to correct
the deficiencies. Failure to provide the requested information, when required, may initiate
enforcement action. If you have any questions please contact David Cox at the Wilmington
Regional Office, telephone number (910) 796-7318.

There's nothing you need from us to perform routine maintenance to certify the
ponds. If you have any questions about what was permitted, areas, elevations,
orifice size, etc. , .please call or email.

The Division of Water Quality issued a Coastal Stormwater Management Permit, Number SW8970521
to Udrt. of NC LLC. to serve Mill Creek Phase Il. on 10/22/1997. This permit will expire on 10/22/2007.
Section .1003(h) of 15 A NCAC 2H .1000 (the stormwater rules) requires that applications for permit
renewals shall be submitted 180 days prior to the expiration of a permit and must be accompanied by a
processing fee, which is currently set at $420.00. If this is still an active project please complete and
submit the enclosed renewal application in a timely manner. If this project has not been constructed
and a permit is no longer needed, please submit a request to have the permit rescinded. If you have
sold the project, or are no longer the permittee, please provide the name, mailing address and phone
number of the person or entity that is now responsible for this permit. Enclosed is a form for change of
ownership, which should be completed and submitted if the property has changed hands.
Your permit requires that upon completion of construction and prior to operation of the permitted
treatment units a certification of completion be submitted to the Division from an appropriate designer
for the system installed. This is to certify that the permitted facility has been installed in accordance with
the permit, the approved plans, specifications and supporting documentation. Please include a copy of
the certification with your permit renewal request and processing fee. Enclosed is a copy of a sample
certification. Also enclosed is a new Operation and Maintenance agreement that should be completed
and submitted along with your renewal application.
You should be aware that failure to provide the Designer's Certification and the operation of a
stormwater treatment facility without a valid permit, are violations of NC General Statute 143-215.1 and
may result in appropriate enforcement action including the assessment of civil penalties of up to
$10,000 per day.

This permit issued to UDRT of North Carolina, LLC
authorizes the development of 11.35 acres of land at S. Kerr Avenue for Mi11 Creek II
in New Hanover County. This permit issued on May 28, 1997
is subject to compliance with the application and site drawings, all applicable regulations and special conditions and
notes set forth below. Any plan modifications must be approved by this office prior to field changes.
It is understood by the applicant that a reprsentative of New Hanover County's Engineering Department may inspect the
the site at anytime following the issuance of this Permit. A copy of the approved Soil Erosion Plan and this permit
must be available at all times at the site.
Failure to execute the provisions of this permit and the approved Soil Erosion Plan, or any other provisions of the
New Hanover County Soil Erosion and Sedimentation Control Ordinance, shall.result in immediate legal action by the
County to the limits prescribed by the Ordinance. If the measures outlined on the approved Soil Erosion Plan and this
Permit prove insufficient, additional Erosion Control measures can and will be required which in turn be considered
provisions of this permit. This Permit does not perclude any other permits or approvals necessary for beginning or
completing this development. It is the Permittee's responsibility to obtain all necessary permits and approvals.
