Dear Mr. Giannotti:
This Certification is pursuant to the application for Clear Run Apartments Phase 3 received on July
13, 1995, with additional information received on August 4, 1995. Staff review of the project plans and
specifications has determined that the stormwater control system as proposed for Clear Run Apartments
Phase 3 will comply with the Stormwater Regulations set forth in Title 15A NCAC 2H.1003(i). The
runoff from 89,700 square feet of impervious area will be treated in a detention pond sized to achieve 90%
reduction in Total Suspended Solids.
Any modification of the plans submitted to and approved by this Office or further development of
this site regardless of the fact that the modification may be less than 1 acre, will require an additional
Stormwater Submittal/Modification and approval prior to initiation of construction. Modifications include
but are not limited to; project name changes, transfer of ownership, change of owner address, redesign
of built-upon surfaces, addition of built-upon surfaces, redesign or further subdivision of the project area.
This Certification shall be effective from the date of issuance until rescinded. The project shall be
constructed and maintained in accordance with the plans and specifications approved by the Wilmington
Regional Office. This Certification does not supersede any other permit or approval. The developer is
responsible for obtaining any and all permits and approvals necessary for the development of this project.
This could include the Division of Coastal Management under CAMA requirements, the Division of
Environmental Management under Wetland 401 Water Quality Certification and/or a Dredge and Fill
Permit and/or a Sewer Extension/Collection Permit, I.T.S. Army Corps of Engineers 404 Wetland Permit,
NPDES Stormwater Permit if disturbing five acres or more, local County or Town Agency permits under
their local ordinances, or others that may be required.

A professional engineer must certify that the stormwater system has been installed in accordance
with the approved plans and specifications upon completion of construction. The attached certification
must be received in this Office within 30 days of completion of construction.
The detention pond must be constructed in it's entirety, operational for it's intended use, and
permanently vegetated prior to the construction of any impervious surfaces proposed as a part of the
project, except roads. Failure to construct the stormwater controls as approved is considered a violation
of this Certification.

Dear Linda:
Attached for your further review are the revised Density Limit Submittal Form and two
copies each of the plans and calculations for the project. The revisions and the comments below
are in response to your letter of July 31, 1995.
The word "s-----" has henceforth been stricken from the English language, at least as
spoken by North Carolina engineers.
The calculations were revised to provide for the discharge of the full 8600 cf of storage.
The calculations and orifice size have been revised to provide for the average head.
The outlet structure detail now indicates 3:1 sideslopes.
I do not have a dimensioned building plan. The buildings shown on the plan were
derived from progress drawings provided by the owner. The outside dimensions are approximate
to within a couple of inches, but are not intended to be exact.
In order to account for the expected variation in building size, as well as expected minor
deviations which are normal and customary to the construction process, we have provided excess
capacity in the stormwater management system. This excess capacity consists of a 3% increase
in impervious area, a 12% increase in pond storage area, and an 8% increase in pond storage
volume over the regulatory requirements. I did not intend to infer a level of accuracy greater
than two significant digits, which can be adequately verified by either scaling or planimetering
any of the information shown on these plans.

Dear Mr. Sneeden:
The Wilmington Regional Office received a Stormwater Submittal for Clear Run Apartments on
July 13, 1995. A preliminary review of that information has determined that the submittal for the subject
project is not complete. The following information is needed to continue the stormwater review:
Per the Attorney General's.Office, the wording of the O & M needs to be changed. The
word "should" must be changed to "must". This is for enforcement purposes. The original
is enclosed for your convenience in making this change.
v12. Why have you used 8500 cf to determine orifice size, when 8600 cf is being stored?
v13. The drawdown orifice size is too small. Your calculations show a height, H, of 1', but
normally, an average head is used. Please revise.
✓4. Please provide a pond cross-section detail, or add 3:1 side slopes to the existing outlet
structure detail.

This letter is to follow on your letter dated February 3, 1995 regarding the new development of
Clear Run Apartments.
We are aware that a Stormwater Submittal for stormwater management is required for the subject
project. UDRT of North Carolina, L.L.C. has contracted Phil Norris of Andrew and Kuske
Consulting Engineers Inc. to design the engineered storm water plan. We are still in the initial
stages of design development, as such, it is unlikely that plans will be available for submittal by
the suggested date. The plans will be submitted for approval as soon as they are available.

Dear Mr. Giannotti:
On February 3, 1995, the Wilmington Regional Office received notification that a 401 Permit to fill
wetlands had been applied for for the new development of Clear Run Apartments. As of this date, however, we
have not received a Stormwater Submittal regarding stormwater management for the subject project.
Please be aware that any site which requires either a Sedimentation and Erosion Control Plan permit and/or
a CAMA major permit will also require a Certification of Compliance with Stormwater Regulations by the Division
of Environmental Management. Additionally, detention ponds are not allowed to be sited in wetlands. Any
construction on the subject site, prior to receipt of the required Certification, will constitute a violation of 15A
NCAC 2H.1003 and will result in appropriate enforcement action by this Office.
A Stormwater Submittal or information regarding the status of this project and expected submittal date must
be received by this Office no later than March 3, 1995, or the subject project file will be closed and construction
