At this point, you have what you have. The variance provision in the 2C rules is typically utilized by the driller (by the
person responsible for the construction of the well forwhich the variance is sought)
15A NCAC 02C .0118 VARIANCE
(a) The Secretary may grant a variance from any construction standard under the rules of this Section. Any variance shall
be in writing, and shall be granted upon oral or written application to the Secretary, by the person responsible for the
construction, of the well for which the variance is sought, if the Secretary finds facts to support the following
conclusions:
(1) that the use of the well will not endanger human health and welfare or the groundwater;
(2) that construction in accordance"with the standards was not technically feasible in such a manner as to afford a
reasonable water supply at a reasonable cost.
(b) The Secretary may require the variance applicant to submit such information as the Secretary deems necessary to
make a decision to grant or deny the variance. The Secretary may impose such conditions on a variance or the use of a
well for which a variance is granted as he deems necessary to protect human health and welfare and the groundwater
resources. The findings of fact supporting any variance under this Rule shall be in writing and made part of the variance.
(c) The Secretary shall respond in writing to a request for a variance within 30 days from the receipt of the variance
request.
(d) A variance applicant who is dissatisfied with the decision of the Secretary may commence a contested case by filing a
petition under G.S. 150E-23 within 60 days after receipt of the decision.

Jim,
This is what I have gathered so far. The warehouse was built before the installation of the well (1994) but nothing
mentions the fact that it was within 25 feet of the warehouse or that the drillers received a variance before digging the
well. The site sketch attachment does depict that the location of this well was to be more than 25 feet from this
warehouse but somehow it didn't end up that way. As far as I can tell there was no proof of conforming to the 2C rules
in 1994 when they installed the well. So I'm assuming there's nothing that we can do to correct this? I would like your
opinions.

Deidra,
Warehouse including sections C, D, E, and maintenance shop was built in 1987. The April 1987 attachment is Agreement
between Alpha Cellulose Corporation and Home Builders Service Corp. The June 17, 1987 letter attachment inquires
status related to completing project by November 1, 1987.
As an old timer Thad guess 1987. Kenny Sampson explains he started Alpha Cellulose in 1988.and this warehouse was
completed when he started. He explains we hadn't yet moved into new maintenance shop.

Dear Mr. Peck:
In accordance with your application received April 4, 1988, we are
forwarding herewith Well Construction Permit No. 77-0004-WS-0091dated
April 7, 1988, issued to Alpha Cellulose Corporation for the construc-
tion of an approximate 720,000 gallon per day water supply well located
at the Alpha Cellulose plant on SR 2202 in Lumberton, Robeson County.
This Permit will be effective from the date of its issuance and
shall be subject to the conditions and limitations as specified therein.
If any parts, requirements, or limitations contained in this Permit
are unacceptable to you, you have the right to an adjudicatory hearing
before a hearing officer upon written demand to the Director within 30
days following receipt of this Permit, identifying the specific issues
to be contended. Unless such demand is made, this Permit shall be final
and binding. i

Attached you will find partially completed Well Construction
Records (GW-1). Please furnish the partially completed GW-1 to your
well driller. After the driller has constructed the -well, completed the
balance of the requested data, and signed .the GW-I, please submit it to

In accordance with the provisions of Article 7, Chapter 87, North
Carolina General Statutes, and other applicable Laws, Rules and Regula-
tions.
PERMISSION IS HEREBY GRANTED TO
Alpha Cellulose Corporation
FOR THE CONSTRUCTION OF one (1) supply well to be completed in the
middle unit of the Creatceous System at the Alpha Cellulose Plant
located at Lumberton on SR 2202 in Robeson County, in accordance with
the application dated March 31, 1988 and in conformity with specifica-
tions and supporting data, all of which are filed with the Department.of
Natural Resources and Community Development and are considered a part of
this Permit.
This Permit is for well construction only, and does not waive any
provisions or requirements of the Water Use Act of 1967, or any other
applicable laws or regulations.
Construction of a well under this Permit shall be in compliance
with the North Carolina Well Construction Regulations and Standards,
and any other laws and regulations pertaining to well construction.
This Permit will be effective from the date of its issuance until
October 6, 1988 or as this shall be amended and shall be subject to
other specified conditions, limitations, or exceptions as follows:
1. Prior notice of the pump test date must be given to Mr. Jim
Bales, Suite 714 Wachovia Building, Fayetteville, North Carolina,
