Alamance County, Nortl� Carolina, WBS Element No. 17BP9.R.63 Dear Mr. Bailey and Mr. Wanucl�a: The NorYh Carolina DepartmenY of TransportaYion (NCDO� is proposiug to replace a fuuctionally obsolete 24' x 7.5' single span timber bridge with a new 28' x 4' bottomless culvert with top bevel and wingwalls. An off-site detour will be used Yo convey traffic during construction. The project will also include some minor approach work on tlte existing roadway. Please find enclosed a PCN application, Stonnwater Management Plan, Culvert Survey Report, permit drawings, buffer drawings, a USGS quad inap, SHPO Concun�ence Forms, and photographs. The North Carolina Nafural Heritage Database was checked far records of tlu�eatened and endangered species. The database lists no species for Alunance County that have federal status. The Bald eagle is protected in every county in North Carolina under the Bald and Golden Eagle Protection Act. No suitable feeding/water source is located within one mile of the project study area to support Bald eagle habitat. Mr. Gary Jordan (USFWS) recently released the Programmatic Couference Opinion (PCO) for the recently lisfed Northern Long-eared Bat (NLEB). This opinion states, in pait, that "... it is the Service's corvference opinion that NCDOT acrivitles i�z eastern Nor�fh Cm�oli�w (Diviston 1-8), as proyased, are r�ot Irhely Co jeopardize the continued existence of tlze NLLB. " � This project was reviewed by NCDOT's Human Envuoiunent Unit ni 20t2 for potential affects to historical architecture and archaeology. It was determined that no suivey was required for historical architecture. A survey was conducted far archaeology on July 19, 2012, and it was determined there would be no eligible archaeological resow•ces present within the project study area. The project study uea is coinprised mostly of inaintained/residential land with Itardwood forest along flie stream banks. There are no additional jurisdiclional features associated with Bridge 146 other than Rock Creek There is a possible wetland area outside of the study area southwest of Bridge 146. The possible wetluid is within a fenced u�ea outside of the project study area. NCDOT best management practices (BMPs) will be used to minvnize and conhol sedimentation and erosion. The construction foreman will review the BMPs daity to ensuxe exosion and sedimentation is being effectively conh olled. The channel is well defined with a subsUate priinarily cotnposed of sand, silt, and gravel and is approximately 7-9 feet in width. From the project site, Rocl< Creek flows northward 8.90-miles to its confluence with Stinking Quarter Creek. Stinking Quarter Creel< then flows approximately 1.09-iniles to ifs conflneuce with the Big Alamance Creelc Big Alainance Creek flows 4.4 miles to its confluence with flie Haw River. The Haw River meets the definition of a Traditional Navigable Water. For these reasons, we believe Rock Creek is a Relatively Permanent Water and is under the jurisdiction of the U.S. Army Coips of Engineers. In order to consh�uct the project, it will be necessary to impact waters of the United States in the Cape Feu• River Basin (HiTC 03030002). Water will be diverted around the construction area. The old bridge will be removed. The proposed stucture will be replaced on its existing alignment. The new culvert structure will be a 28' by 4' reinforced concrete bottomless culvert. The channel will be excavated and realigned for low flow shaping, and a floodplain bench with stabilization will be established on each bank. Water will be pumped around the work area during construction by instalied impervious dikes upstream and downstream of the existing bridge. Water will be directed into special stilling bains. Impact Justification and Mitigation 1. Avoidance and Minimization 1 a. Specifically describe measures taken to avoid or minimize the proposed impacts in designing project. The proposed project is to remove and replace a structurally deficient bridge and replace it with a bottomless culvert. Roadway approach work is minimized as much as is practical to reduce the overall project footprint. Impacts to the associated protected riparian buffers have also been reduced by promoting sheet flow as well as providing grass shoulders to promote infiltration. An off-site detour will be employed to avoid the need for a temporary parallel structure. Bank stabilization will be minimized to those areas where deemed necessary. 1 b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques. Erosion and sedimentation BMPs will be installed prior to construction. Water will be diverted around the work area to prevent sedimentation of downstream aquatic resources. Impacts will be minimized by strict enforcement of Best Management Practices for the protection of surtace waters, restrictions against the staging of equipment in or adjacent to waters of the US and coordination (including a pre-construction meeting) with the Division Environmental Supervisor. Per the NC DWQ April 10, 2004 Version 2.1 Cumulative Impacts policy, small scale public transportation projects — such as widening projects, bridge replacements and intersection improvements — have a"Iow potential for cumulative impact since little (if any) new impervious surtace is added and the projects are usually in already developed locales." This proposed project is within a somewhat developed landscape (i.e. existing residential homes in the vicinity), this is not a road on a new location (i.e. there is an existing road and bridge structure and thus, the area already contains impervious surtaces) and the project drains to Rock Creek which is Class WS-V; Nutrient Sensitive Waters (NSW) (i.e. not HWQ or ORW or 303(d) listed waters).
