As agreed upon in the Raleigh Farm Riparian Buffer and Nutrient Offset Umbrella Mitigation Banking Instrument (MBI) and Raleigh Farm Bank Parcel Development Packaged (BPDP), made and entered into on September 24, 2021 by Restoration Systems, LLC, acting as Bank Sponsor (Sponsor), and the North Carolina Department of Environmental Quality (NCDEQ), Division of Water Resources (DWR). This document details the riparian area restoration activities, monitoring efforts, and the final mitigation potential of the Parcel. Measuring 89.01 acres, the Parcel is designed to provide mitigation credits for unavoidable impacts due to development within the Neuse River Basin. NCDWR representatives conducted an onsite determination for parcel applicability and suitability of Site Features on June 8, 2020 (Phase B) and June 2, 2020 (Phase Q. A Site Viability letter for Buffer & Nutrient Offset was provided by the Division on August 17, 2020 and September 24, 2020 for Phase B, and August 17, 2020 and September 25, 2020 for Phase C. North Carolina Wildlife Habitat Foundation (NCWHF) was granted a Conservation Easement by the City Raleigh, North Carolina on June 12, 2023. The conservation easement was recorded at the Wake County Register of Deeds on July 26, 2023; Book No. 019393, Page 00672-00696. Restoration construction activities involved the removal of existing farm infrastructure, including piped crossings and existing earthen roads (farm paths). RS began preparation for restoration of the riparian buffer and planted the Parcel in February of 2022. Riparian buffer restoration activities included ripping/bedding of the parcel with a narrow set plow, bare - root planting, and broadcast application of a permanent seed mix. During February 25 — March 21, 2022, Axiom Environmental installed forty-nine (44) Carolina Vegetation Survey (CVS) monitoring plots (Phase B = 6, Phase C = 38) and collected as -built data. Year 2 data was collected September 21-22, 2023 (Appendix B). 2.0 Parcel Location The Parcel is located approximately three miles northwest of Clayton, five miles east of Garner, and seven miles southeast of Raleigh in Wake County, NC. The Parcel is within the Neuse River Basin 14-digit USGS Cataloging Unit 03020201110030 of the Middle Atlantic Coastal Plain (North Carolina Division of Water Quality [NCDWQ] Sub -basin Number 03-03-05) (Figure 1, Appendix A). Parcel Location: (35.707071°,-78.479510°) Directions to Parcel from Raleigh: - Head south on N. Blount St. - Turn left onto Martin Luther King Jr Blvd. (1.1mi) - Turn right on Rock Quarry Rd. (1.8mi) - Latitude, Longitude: 35.707071°,-78.479510' Raleigh Farm Phase B-C Nutrient Offset and Buffer Mitigation Bank Parcel Page 1 MY2 (2023) Monitoring Report— March 2024 2.1 Parcel Background The Parcel encompasses 89.01 acres of land over two tracts of historical agricultural fields. Prior to Parcel development, land use is described as a mixture of managed fields for biosolid applications from the City's NRRRF, row crop agriculture, and unmanaged hardwood forests. Site Features were devoid of woody vegetation outside of forested areas due to historic and agricultural practices. Managed features were maintained (mowed/brush hogged) to keep woody vegetation from establishing. The Parcel is comprised of four separate tracts situated just south of the Neuse River. Currently, a 200- foot Duke Power 500 KV Overhead Transmission Line is located outside of the Site's easements. Additionally, Dominion Energy's T-030 Gas Pipeline Extension Project will maintain a 50-foot utility easement over Project Parcels associated Phase B. The new easement abuts and runs parallel to Duke Power's 200-foot overhead transmission line easement. Site design avoided all temporary and permanent easements associated with the T-030 Gas Pipeline, and the easements are located outside the T-030 Gas Pipeline easement (permanent and temporary). An existing City of Raleigh greenway trail (Neuse River Trail) meanders near portions of Phase B and Phase C. The Site's footprint is outside of all greenway easements and footprints. 2.2 ParcelObiectives The primary goals associated with the restoration of riparian areas within the Bank Parcel focused on improving water quality, enhancing flood attenuation, and restoring wildlife habitat. These goals were achieved through the restoration and preservation of forested riparian areas adjacent to stream channels, in -line ponds, and an agricultural ditch. Goals were accomplished by the following. 1. Removing nonpoint sources of pollution associated with agricultural production, including: a. Ceasing the broadcast application of class B biosolids, fertilizer, pesticides, and other agricultural materials into and adjacent to Parcel Features. b. Providing a restored buffer to filter runoff from adjacent lands. 2. Reducing sedimentation within onsite and downstream receiving waters by reducing bank erosion, vegetation maintenance, and agricultural land disturbances by ceasing agricultural and current land use activities. 3. Promoting floodwater attenuation by increasing frictional resistance of floodwaters crossing Parcel floodplains. 4. Improving aquatic habitat by enhancing stream bed shading and natural detritus input. 5. Providing a terrestrial wildlife corridor and refuge in an area extensively developed for agricultural production. 6. Restoring and re-establishing natural community structure, habitat diversity, and functional continuity. 7. Protecting the Parcel's riparian buffer functions and values in perpetuity. Raleigh Farm Phase B-C Nutrient Offset and Buffer Mitigation Bank Parcel Page 2 MY2 (2023) Monitoring Report— March 2024 3.0 Restoration Activities To achieve the objectives above, a restoration plan including the following components was completed in February of 2022. Primary components of the Restoration Plan included the following. 1. Removal of dilapidated/ abandoned agricultural infrastructure within forested areas where feasible, 2. Removal of existing compacted earth roads associated with agricultural use, 3. Parcel -wide soil preparation & herbaceous vegetation treatment, 4. Riparian area restoration (replanting) extending from the top of bank (TOB) out 200' where applicable and, S. Parcel protection in perpetuity through a conservation easement. Tables A & B detail the restoration and protection activities. An outline of restoration activities and their completion dates is provided in Table 2 (Appendix A). Table A — Restoration Plan Activities Restoration Phase Specific Actions Plan Activity - The City, who actively self -manages the farm operations, treated fescue grasses within the Herbaceous Parcel ahead of planting efforts. Treatment consisted of a broadcast application using Treatment Roundup Custom (Glyphosate) at a rate of 3% and a surfactant of AgriDex at a rate of 1%, per acre, mixed with water. - Removal of existing farm paths within the proposed easements by deep ripping to break Removal of soil compaction associated with equipment and vehicle use. NRRRF will establish new Existing roads dependent on future use and need outside of the Site's proposed easements. Infrastructure - Removal of large debris from the easement without damaging the existing riparian buffer Feature 3A, Phase B. North Carolina Wildlife Habitat Foundation (NCWHF) was granted a Conservation Easement Parcel by the City Raleigh, North Carolina on June 12, 2023. The conservation easement was protection recorded at the Wake County Register of Deeds on July 26, 2023; Book No. 019393, Page (89.01 acres) 00672-00696. 2.) IRS marked the easement at every corner with an iron, CE cap, and corner t-post. Additionally, easement posts were placed every 200-feet along the Parcel boundaries 3.1 Construction Activities Two primary construction activities occurred onsite including 1) removal of existing, earthen farm paths within the proposed easements by deep ripping with agricultural equipment to break up soil compaction associated with historic farm equipment and vehicle use; and 2) Removal of reinforced concrete pipes & other debris located within the proposed easement (as feasible) without damaging existing forest/vegetation. 3.2 Riparian Area Restoration Activities Restoration of the riparian area allows for recolonization and expansion of characteristic species across the landscape. The riparian areas were restored according to the Consolidated Buffer Mitigation Rule 15A NCAC 02B .0295. The planting plan for the riparian restoration area included planting 37,000 native bare -root hardwood saplings (Phase B = 7,200 saplings, Phase C = 29,800 saplings) across 57.265 acres (Phase B = 11.043 acres, Phase C = 46.222 acres) at a Parcel density of +/- 600 stems per acre and live stakes for stream bank stabilization where necessary. Community associations utilized in the proposed planting plan include Schafale and Weakley's (2012) Mesic Mixed Hardwood Forest (Piedmont Subtype) and Piedmont Bottomland Hardwoods. The planted species composition is intentionally diverse and while based on these communities, also accounted for local observations and nursery availability. All species were selected based on their ability for sediment stabilization, rapid growth rate, the ability to withstand hydraulic forces associated with flood events, suitability to specific soil types, and Parcel conditions. Tree species were mixed thoroughly before planting to provide a diverse and random plant across the Site. Planting density is set to ensure sufficient diversity and density of planted stems outlined in Rule 15A NCAC 02B.0295 of 260 trees per acre at the end of five years. No one tree species will be greater than 50% of the established stems. The bare root planting list is provided in Table C followed by the permanent seed mix in Table D. Additionally, easement posts were placed every 200- feet along the Parcel boundaries. 4.0 Mitigation Potential DWR has determined the nitrogen abatement of restored riparian areas to be 2,273.02 lbs. per acre as agreed to in the Raleigh Farm MBI. Riparian buffer credits were measured to the nearest whole square foot. Mitigation potential for each Project Phase is detailed below. The Parcel restored 46.974 acres and preserved 29.112 acres of riparian area within a 89.01-acre Parcel. The Parcel permanently protects an additional 11.405 acres consisting of areas beyond 200-ft from Site Features, the footprint of Site Features, and non -credited access/maintenance areas within the conservation easement that do not generate credit. Table 1 (Appendix A) outlines the components and mitigation credits to be generated within the Parcel. The generated Neuse River Riparian Buffer Credits (RBC) and Nutrient Offset Credit (NOC, nitrogen) on restored riparian areas were measured from the top of bank out perpendicularly 200-feet on Parcel Features (streams, ephemeral channels, and an in -line pond). Riparian buffer restoration credits can be converted and transferred to NOC upon approval from DWR. However, conversions of NOC from widths 101'- 200' (measured from top of bank) to RBC will not occur. The Sponsor must request and receive written approval of the conversion and transfer of any mitigation credits from DWR prior to adding or removing credits from the ledgers. The Sponsor will maintain three individual ledgers, one to account for riparian buffer restoration credits, one to account for riparian buffer preservation credits, and one to account for NOC. All credit assets shall be accurately depicted on these credit ledgers (Table 1, Appendix A). Raleigh Farm Phase B-C Nutrient Offset and Buffer Mitigation Bank Parcel Page 6 MY2 (2023) Monitoring Report— March 2024 5.0 Monitoring Protocol & Success Criteria 5.1 Monitoring Protocol Restoration monitoring procedures for vegetation at each Phase will monitor plant survival and species diversity. Quantitative sampling will include fifty (44) permanent 10 x 10-meter vegetation plots (Phase B = 6, Phase C =38) as outlined in the CVS Level 1-2 Protocol for Recording Vegetation, Version 4.2 (Lee et al. 2008) and will occur no earlier than Fall of each year (Figures 2 and 3, Appendix A). Vegetation plot placement will adequately represent riparian buffer credit and nutrient offset credit areas. A reference photo will be taken from the origin point of each plot. All planted stems in the plots will be marked with flagging tape and recorded. Data collected will include species, height, planting type (planted stem and/or volunteer). Total and planted stem density by plot and species will be reported during monitoring years 0-5 (Tables 5A-B, Appendix B). Individual and average stem height data will be reported during monitoring years 3-5. Monitoring of the restoration efforts will be performed for five years or until success criteria are fulfilled. Restoration Systems shall submit to NCDWR annual monitoring reports no later than December 31st of each year. Each report will document the success of the vegetation and any maintenance, supplemental planting, or encroachment within the easement areas. Success criteria within the buffer will be based on the survival of planted species at a density of 260 stems per acre after five years of monitoring. Year 2 (2023) annual monitoring activities were conducted September 21-22, 2023 and found an average planted stem density of 465 stems per acre for Phase B, and 457 stems per acre for Phase C. Additionally, all plots throughout Phases B and C exceeded the stem density success criteria of 260 stems per acre. 5.2 Parcel Maintenance A remedial action plan will be developed and implemented with the approval of DWR in the event the Parcel or a specific component of the Parcel fails to achieve success criteria as outlined above. Other vegetation maintenance and repair activities may include pruning, mulching, and fertilizing. If exotic invasive plant species require treatment, such species will be controlled by mechanical (physical removal with the use of a chainsaw) and/ or chemical methods (aquatic approved herbicide) in accordance with North Carolina Department of Agriculture (NCDA) rules and regulations. If mowing is deemed necessary by the Sponsor during the monitoring period, the Sponsor must receive approval from DWR prior to conducting any mowing activities within Neuse Buffer Zones 1 and 2 to ensure that no buffer violations have occurred. 5.3 Long Term Management Plan The conservation easement will preserve all areas and prohibit all use of the property inconsistent with its use as a nutrient offset and riparian buffer mitigation property, including any activity that would materially alter the biological integrity of the Site/Parcel. Additionally, easement posts were placed every 200-feet along the Parcel boundaries. 5.4 MY1 (2022) Adaptive Management Plan On January 5, 2023, RS implemented a targeted replant in Phase B of one thousand five hundred (1,500) bare roots across roughly five (+/-5) acres of the easement and Phase C of seven thousand four hundred (7,400) bare roots across roughly twenty-three (+/-23) acres of the easement. Planting zones and densities were based on Yr. 1 monitoring data. The species were picked from the original planting list with minor modifications based on the species' success. Two RS Project Managers were onsite to guarantee that the overall quality of the planting would exceed success criteria requirements. Bare roots were planted and flagged within the fixed vegetation monitoring plots, which will be recorded in the Yr. 2, 2023, Monitoring Report. Table E details the species and the number of planted stems. During the monitoring period, no bond shall be less than $100,000 initially, to cover monitoring expenses. Performance bonds for monitoring shall be renewed at least annually to cover the next years monitoring period, with confirmation of renewal provided to DWR with each annual monitoring report when applicable. DWR reserves the right to alter the credit release schedule if monitoring reports are submitted without proof of bond renewals when applicable.
