In accordance with the application for a discharge permit received May 20, 1997, the Division is
forwarding herewith the subject NPDES permit. This permit is issued pursuant to the requirements of
North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina
and the US Environmental Protection Agency dated December 6, 1983.
This permit does not authorize flow levels above previously permitted flow. Since improvements to
treatment have been completed your wastewater flow is 3000 GPD or less with improved effluent quality.
The permitted flow is 7800 GPD. For additional flow, the permittee must demonstrate and/or justify the
need for flow expansion. Due to the uncertainty of how the facility will perform with increased flow, the
permittee must continue to pursue non -discharge options as required by Part III D of this permit. If no
non -discharge options are available, the permittee must provide a specific proposal for facilities and the
required flow, along with an engineering economic analysis of the alternatives to discharging. For your
reference we are attaching a copy of "Guidance For Evaluation Of Wastewater Disposal Alternatives".
The Division has an ongoing permitting program to ensure proper design and installation of sewer
collection systems. Therefore, the permittee must receive an Authorization to Contruct from the Division
of Water Quality for proposed sewer lines serving more than one building prior to contruction.
If any parts, measurement frequencies or sampling requirements contained in this permit are
unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30)
days following receipt of this letter. This request must be in the form of a written petition, conforming to
Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative
Hearings, Post Office Drawer 27447, Raleigh, North Carolina 27611-7447. Unless such demand is
made, this decision shall be final and binding.
Please take notice this permit is not transferable. Part II, EA. addresses the requirements to be
followed in case of change in ownership or control of this discharge.
This permit does not affect the legal requirements to obtain other permits which may be required by
the Division of Water Quality or permits required by the Division of Land Resources, Coastal Area
Management Act or any other Federal or Local governmental permit that may be required.

streams draining a steep watershed. The receiving stream is a
small stream approximately 2 feet wide. The Nantahala River

arm of Fontana Lake is 800 ft. downstream. Downstream uses
include aquatic and wildlife propagation, fishing, swimming,
boating, and whitewater activities when the lake level is down.

Previous non-compliance was believed to be a result of insufficient
