The Division of Water Quality (the Division or DWQ) hereby issues the attached NPDES permit for
the subject facility. We issue this permit pursuant to the requirements of North Carolina General
Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S.
Environmental Protection Agency dated October 15, 2007, or as subsequently amended.
Changes to Your Permit. We understand you have made no significant changes to your WWTP
facilities since last renewal. We have therefore made only minimal changes to your previous permit by
updating your facility description and map, and adding parameters codes to the monitoring table for
your convenience [see Supplement to Cover Sheet and permit Section A. (1.)]. Lastly, we have
removed the parameter Dissolved Oxygen [code 00300], inappropriately included in your permit draft.
If any parts, measurement frequencies, or sampling requirements contained in this permit are
unacceptable, you have the right to an adjudicatory hearing, upon written request submitted within
thirty (30) days after receiving this letter. Your request must take the form of a written petition
conforming to Chapter 150B of the North Carolina General Statutes, and you must file it with the
office of Administrative Hearings, 6714 Mail Service Center, Raleigh, North Carolina 27699-6714.
Unless such a demand is made, this permit shall be final and binding.

VZ Top Homeowners Association (HOA) WWTP
850 Hudson Road, Highlands
Macon County
to receiving waters designated as Brooks Creek in the Savannah River Basin in accordance with
effluent limitations, monitoring requirements, and other conditions set forth in Parts I, II, III and IV
hereof.
This permit shall become effective November 1, 2012.
This permit and authorization to discharge shall expire at midnight on August 31, 2017.

revoked. As of this permit issuance, any previously issued permit bearing this number is no longer
effective. Therefore, the exclusive authority to operate and discharge from this facility arises under the
permit conditions, requirements, terms, and provisions included herein.

2. discharge from said treatment works via Outfall 001, at the location specified on the attached map,
into Brooks Creek [Stream Segment 3-10-2-3], a waterbody currently classified B-Trout within
Subbasin 03-13-01 of the Savannah River Basin.

Correspondence with the Permittee - During the Draft Review process, Joe Corporon emailed Michael
Rosenberg (Permittee) to say the draft is in progress; Joe asked for a sight map showing the property perimeter.
Data Review -- reviewed BIMS data from November 2007 through April 2012. Data for BOD5, TSS, and
Ammonia (NH3 as N) show no values above permit limits - no limit violations. The Region issued some
violations (NOVs) for flow monitoring frequency, but these appear to be seasonally related to the intermittent
occupancy of a resort clientele (no penalties assessed). Flow is 100% domestic and estimated based on
occupancy (83 people). Actual flow averages — 0.002 MGD (less in the past two years); maximum reported
22Sep2009 at 0.0243 MGD is anomalous (high by a factor of 10) and is likely a reporting error.
Renewal — no changes from the previous permit except to update facility description and map; added parameter
codes to the effluent page.
