On October 1, 2015, the Division of Water Resources (Division) received your application dated
September 29, 2015, requesting an Individual Water Quality Certification from the Division for the
subject project. Representatives of the Asheville Regional Office (ARO) visited the Seven Falls Bonded
Phases project on August 11, 2015 and November 6, 2015. The Division has determined that your
application isincomplete and cannot beprocessed. The application ison-hold until all mfthe following
information is received:
1. Aquatic life passage, including that for nnacvobenthicinvertebrates, bimportant toensuring that
the project doesnotnesultindeOnadationVfsurfamewatemupsneamcdroadurossinQs,w/hichis
arequirement toissue acertification [1SANC4CO2H.O5O6/b\(3)l. The application states that
Impact Areas #3, 5, 9, 10, 11, 12 and 13 do not meet the requirements for aquatic life passage,
however noremedial action isproposed for Impacts #3,5,12and 13. The remedial actions
proposed for impacts 9, 10 and 11 did not provide a specific plan nor any cross-sections.
Provide o specific plan for Impact Areas #3, G, 9, 10L 11' 12 and 13, showing how these crossings
will bereconstructed 10ensure aquatic life passage.
2. Impact #13consists of 375 linear feet of stream impact for a road crossing that was originally
approved for 1O0linear feet ofstream impact. Provide eplan for removing the portion ofthe
culvert that is not necessary for the road crossing and restoring the stream channel or explain
why the additional length of culvert is necessary for this road crossing. [15A NCAC 02H .0506 (b)
For Impacts #10 and 11, provide site-specific plans for stabilization of the outlets and
streambanks downstream of these impact areas. [15A NCAC 02H .0506 (b) (2) & (3)]
4. During the site visits, it was determined that installed erosion control measures and deposited
sediment have artificially elevated the stream channel and altered the hydrology of the system
downstream ofImpact Areas 3and 4. Additionally, significant channel incision and instability

6. The application does not address sediment loss orin-stTeannsediment accumulation observed
during the site visits. Provide anassessment, including amap, for all streams inthe bonded area
with sediment accumulation inexcess of4inches indepth. Provide sediment removal plan for
stream sections identified by the assessment. [15A NCAC 02H .0506 (b) (2) & (3)]

information for the proper consideration of the application. Please respond in writing within 30
calendar daYsofreceipt ofthis letter bvsending three copies ofall ofthe above requested information
tothe 4O1&Buffer Permitting Branch, 1617Mail Service Center, Raleigh, NC27699-1617. ifall ofthe
requested information isnot received inwriting within 3Ocalendar days ofreceipt ofthis letter, the
Division will heunable toapprove the application and itwill bereturned. The return nfthis project will
necessitate reapplication to the Division for approval, including complete application package and the
appropriate fee.
Please be aware that you have no authorization under the Section 401 of the Clean Water Act for this
activity and any work done within waters of the state may be a violation of North Carolina General
Statutes and Administrative Code.
