Hi Joey,
Here’s what was submitted a couple months ago. The site alterations to support the drainage changes will need to be
performed initially and the home construction would follow. I suppose additional silt and or barrier fence could be
installed around the lower part of the open ditch line to prevent someone walking through it?

Mr. Mileti,
On January 30, 2024, the Division of Water Resources (Division) received your application requesting a
401 Water Quality Certification from the Division for the subject project. The Division has determined
2
that your application is incomplete and cannot be processed. The application is on-hold until all of the
following information is received:
1. The project application did not include a copy of plans for the project. A set of plans depicting
the location and extent of surface waters and proposed impacts to these waters is required so
the Division can evaluate potential water quality impacts. Please include a copy of project plans.
[15A NCAC 02H .0502(a)(9)]
2. The Division does not allow flowing water to come in contact with the disturbed area. Please
indicate how this will be prevented, such as conducting work when the intermittent stream is
dry or using a pump around system. [15A NCAC 02H .0506(b)(2)]
Pursuant to Title 15A NCAC 02H .0502(c), the applicant shall furnish all of the above requested
information for the proper consideration of the application. Please provide your response by April 12,
2024. If all of the requested information is not received, the Division will be unable to approve the
application and it will be denied as incomplete. The denial of this project will necessitate reapplication
to the Division for approval, including a complete application package and appropriate fee.
Please let me know if you have any questions.
Regards,
Joey
