Based on our discussion and the plan sheets attached, resetting the 24in culvert pipe is recommended. These activities shall also include stabilization of the scour holes located downgradient of the culvert area. Rip-rap should not be dumped in, but rather pressed into the stream banks to allow aquatic passage. Please use this email as approval for these activities. All the conditions listed in the 401 WQC (attached) still apply. Let me know if I can provide additional assistance. The pipe carried an unnamed tributary to Foster Creek which for some reason did not appear on the project plans. We applied for an After-The-Fact Nationwide Permit #18 and Water Quality Certification 4139. Last fall, Lori Beckwith of the US Army Corps of Engineers did a compliance inspection of the project and determined that either the pipe was perched when it was installed or had caused a scour hole at the outlet. She requested that we reset the pipe properly or if that is not possible for some reason, to fill the scour hole with riprap. Since the action had been permitted previously, she is not requiring us to send in another PCN. I would like to know how you want us to handle the situation. Thanks for your help.
