(See attached pictures). It is a 42" pipe that should have been buried 20% but it was laid at grade, which was an oversight. However, even if the pipe had been buried at the 20% requirement, it would have perched. The pipe is currently 1' above the water, and the plunge pool is about 1' deep. The area has scoured 2' since installation and the 20% burial would have been around 9". If the pipe had been installed correctly, we would have at least 15" of scour. We can correct the perch using an energy dissipator or we can drop the pipe with a junction box and pipe extension. If anything is recommended, we would like to combine rip rap with native material, hoping to be able to proceed without a permit modification? I'm suggesting native material because we are hoping to keep the impact from being deemed a `loss of water'. We will do whateveryou recommend. Although, after reading through the Regional General Permit 50 Special Conditions, specifically (5) it states: Culverts/pipes placed across wetland fills purely for the purposes of equalizing surface water do not have to be buried but must be of adequate size and/or number to ensure unrestricted transmission of water. The pipe is solely for equalizing surface water because the flow is wetland4pipe4stream. Aquatic passage in the pipe system should not be a concern either. And, as you can see from the attached pictures, there are a lot of sheer rock drop-offs, most of which are beyond our construction limits. We would like to consider this pipe purely for the purpose of equalizing surface water and hope you would agree.
