1ͲThefirstcreditreleasemilestoneisbasedonthepotentialcreditsstatedintheapprovedmitigationplan.
2ͲThefirstcreditreleaseshalloccuruponestablishmentofthemitigationbank,whichincludesthefollowingcriteria:
1) ExecutionoftheMBIorUMBIbytheSponsorandtheUSACE;
2) ApprovalofthefinalMitigationPlan;
3) Mitigationbanksitemustbesecured;
4) DeliveryofthefinancialassurancesdescribedintheMitigationPlan;
5) RecordationofthelongͲtermprotectionmechanismandtitleopinionacceptabletotheUSACE;
6) 404permitverificationforconstructionofthesite,ifrequired.
3ͲThesecondcreditreleaseisbasedonthecredittotalsfromtheasͲbuiltsurvey,andmaydifferslightlyfromthecredittotalsstatedinthemitigationplan.
4ͲA10%reserveofcreditstobeheldbackuntilthebankfulleventperformancestandardhasbeenmet.
