Dear Mr. Davis:
On March 7, 2024, a site inspection was conducted for the Cleveland County Landfill facility located at 250
Fielding Road, Cherryville, Cleveland County, North Carolina. A copy of the Compliance Inspection Report is
enclosed for your review. The site visit and file review revealed that the subject facility is covered by NPDES
Stormwater General Permit NCG 120000 under Certificate of Coverage NCG 120072. Permit coverage authorizes
the discharge of stormwater from the facility to receiving waters designated as Buffalo Creek, Long Creek, and
Smith Creek, Class WS-III and C;Sw waters in the Broad River Basin.
The facility's paperwork related to the referenced permit appeared compliant; however, the site-wide compliance
status was not evaluated at this time because of the seeps and sampling issues identified. Please refer to the
enclosed Compliance Inspection Report for additional comments and observations made during the inspection.
Additionally, on October 18, 2023, the Department of Environmental Quality received a Tier Relief Request for
Fecal Coliform for the facility. As a result of the referenced inspection, the tier relief request is denied. Multiple
potential sources and reasons for the fecal levels reported at the facility need to be addressed prior to a tier relief
request being considered.
Please be advised that violations of the NPDES Stormwater General Permit are subject to a civil penalty
assessment of up to $25,000 per day for each violation. If you or your staff have any questions, comments, or

Inspection Summary:
Jerry Eplin and Isaiah Reed with DEMLR conducted a compliance evaluation inspection for the referenced facility. The
facility requested Tier Monitoring Relief in relation to elevated fecal results reported at multiple facility outfalls
During the inspection, it was found that the Stormwater Pollution Prevention Plan(SWPPP)was present and had been
updated within the last year. Likewise,training had been perforemd within the last year. Non-discharge/illicit discharge
monitoring records exist, however,the referenced monitoring is not sufficient to evalute non-stormwater discharges. Facility
personnel and/or their consultant indicated that monitoring involves activities similar to Qualitiative Monitoring and that dry
weather observions of the outfalls is not possible because the basins discharge nearly continuously. However, basins are
supposed to completely dewater in 3-5 days. Repairs to basin outlet structures are needed so that they completely
dewater within the required time frame. Additional, a damaged riser and damaged barrel pipe were observed in SP-1, Outfall
8. Repairs are needed.
During the inspection, several potential leachate seeps were identified. Furthermore, a water feature was found cutting into
an area of apparently burried Municipal Solid Waste,exposing the waste. Tier Monitoring Relief is not appropriate. The
facility should work with the Division of Solid Waste to address the leachate and MSW issues outlined above.

Comment: Note that while the facility is conducting analytical monitoring,there are some outfalls that are
not being monitored because the outfall, as configured, does not allow a true grab stormwater
sample. However, it appears that with maintenance, additional outfalls could be monitored and
that maintenance is recommended.

Comment: The facility has documented illicit discharge monitoring records, however, as performed the
monitoring is insufficient to evaluate non-stormwater discharges. Basins do not appear to be
draining within 3 -5 days of a rain event. Basin discharge structures should be maintained so
that the basin dewaters within required timeframes. Basins with damaged risers and/or barrel
pipes should be repaired.
