I apologize for the delay. Can you forward pictures of the perched pipe and the downgradient area below the culvert outlet?
Attached are the plans I have from the after the fact approval in 2020.
Based on the details below, resetting the pipe would appear to cause more disturbance of the area and stabilizing the culvert outlet as is would be recommended. If natural material
alone cannot be used as fill for the scour hole, those details should be provided.
If rip-rap is determined to be the last resort for stabilization, it should not be dumped into the scour hole, but pressed into the banks.
Please depict the approximate location of the unmarked JS on the attached plans, from the culvert outlet location into Foster Creek.

Good morning,
In 2020, we extended a 24” driveway pipe to allow for the installation of guardrail as part of the replacement of bridge 73 over Foster Creek on SR 1341 Foster Creek Road. The pipe
carried an unnamed tributary to Foster Creek which for some reason did not appear on the project plans. We applied for an After-The-Fact Nationwide Permit #18 and Water Quality Certification
4139. Last fall, Lori Beckwith of the US Army Corps of Engineers did a compliance inspection of the project and determined that either the pipe was perched when it was installed or
had caused a scour hole at the outlet. She requested that we reset the pipe properly or if that is not possible for some reason, to fill the scour hole with riprap. Since the action
had been permitted previously, she is not requiring us to send in another PCN. I would like to know how you want us to handle the situation.
