Sullins, Director Chuck Wakild, Deputy Director Division of Water Quality November 8, 2007 DWQ Project # 2007-1437 Craven County Mark Curry 1409 Pasture Point Road Merritt, NC 28556 Subject Property: Lot #7, Pasture Point New Bern, NC Trent River, Neuse River Basin REQUEST FOR ADDITIONAL INFORMATION Dear Mr. Curry, On August 20, 2007, the Division of Water Quality (DWQ) received your Minor Variance application dated July 28, 2007 to impact 700 feet of Zone 2 of the Neuse River Ripazian Buffer to construct a proposed single-family residence, The DWQ has determined that your application was incomplete and/or provided inaccurate information as discussed below. The DWQ will place this project on hold as incomplete until we receive this additional information. Please provide the following information so that we may continue to review your project. Additional Information Requested: 1. Avoidance and minimization There appears to be sufficient azea on the property outside of the riparian buffer for construction of asingle-family residence without impacting the Neuse River Riparian Buffer. Please provide additional information justifying why this building cannot be constructed in a location that is not in the riparian buffer, or why the building cannot be reconfigured in a manner that avoids encroachment into the riparian buffer. Please respond in writing within three weeks of the date of this letter by sending this information to the DWQ Central Office (2321 Crabtree Boulevard Suite 250, Raleigh NC 27604) and the DWQ Washington Regional Office (943 Washington Square Mall, Washington NC 27889). If we do not hear from you within three weeks, we will assume that you no longer want to pursue this project and we will consider the project as withdrawn. This letter only addresses the application review and does not authorize any impacts to wetlands, waters or protected buffers. Please be aware that any impacts requested within your application aze not authorized (at this time) by the DWQ.
