On February 27,2024, Ian Callaway,Lily Kay,and Jeffery Chandler from the Mooresville Regional Office
of the Division of Energy, Mineral and Land Resources (DEMLR), conducted a site inspection for the
American Ready Mix facility located at 7225 Old Statesville Road, Mecklenburg County,North Carolina.
A copy of the Compliance Inspection Report is enclosed for your review. Sergio and Daniel Guillen were
also present during the inspection and their time and assistance is greatly appreciated. The site visit and
file review revealed that the subject facility is not covered by an NPDES Stormwater Permit.
As a result of the site inspection, the following violation(s) are noted:
1)NPDES Stormwater Discharge Permit
The site has industrial activity exposed to stormwater and does not have an NPDES Stormwater Discharge
Permit

enforcement to the Director of the Division of Energy, Mineral & Land Resources regarding these issues.
Your above-mentioned response to this correspondence will be considered in this process. This office
requires that the violations, as detailed above,be properly resolved. These violations and any future
violations are subject to a civil penalty assessment of up to$25,000 per day for each violation. Should

Inspection Summary:
This site was Inspected on February 27,2024 at 10:30 am with Julianna Hawley and Richard Farmer with Mecklenbur€
County. The site was a Ready mix Concrete batch plant in operation at time of inspection. The site did not have an
approved NPDES Industrial Stormwater permit. Concrete waste was observed running off the Batch Plant's property
and has reached a stream running behind the property. Two pH readings were measured at the creek by Richard
Farmer of Mecklenburg County showing a pH of 11.9 and 12. The batch plant had a concrete settling basin,but it was
not being used. Stormwater and truck wash water were being diverted into a ditch which discharged into the creek.
There was no lined or designated concrete washout, and all concrete waste was disposed of at the back of the batch
plant's property. Offsite concrete waste was present along the back of the property and extending 50-100 ft
downstream.
