Please find the below responses to RFI and attachments, let me know if you need anything additional to continue to
process. Thanks.
USACE 1) Project coordinates in the application are inconsistent with the project description. Please clarify, and/or
provide updated coordinates for the proposed project.
Applicant Response: See attached.
USACE 2) Would any of the construction access corridors be maintained as maintenance corridors or roadside
shoulders? If so, have those permanent impacts been accounted for?
Applicant Response: Impacts associated with long term roadside shoulder maintenance was included with the
previously provided permanent and temporary impacts of the project.
USACE 3) Temporary wetland impacts for 'erosion control devices' are listed in the provided drawings. What are the
erosion control devices, and would these areas be revegetated and restored to pre -construction contours, where
applicable?
Applicant Response: Silt fence and outlets. Areas of temporary wetland impacts would be restored to similar pre -
construction grades and stabilized with native herbaceous seed mix and as needed, natural fiber containing matting.
USACE 4) Please provide the width of the stream at the impact location.
Applicant Response: The stream's average width is 2.52 feet wide at the proposed impact location.
USACE 5) Have you been in contact with NCDWR regarding an Individual Water Quality Certification for this project?
Applicant Response: Yes, a 401 WQC was requested concurrently with the NWP Verification request.
NCDWR 1) Has the delineation of the project area or a portion thereof ever been submitted to the USACE for
verification?
Applicant Response: Yes, a delineation of the project area was submitted to the USACE with the NWP Verification
Request.
NCDWR 2) Section E.1a (or Section F.1 of PCN Form Version 4.3), you indicated that the project does not include nor is
adjacent to protected riparian buffers. However, the project is located within the Jordan Lake Buffer Area and requires
diffuse flow and/or other forms of stormwater treatment for the proposed buffer impacts. Please clarify this discrepancy
and provide information verifying that you are seeking or have already received written approval from the local
authority for buffer impacts and will be able to comply with any applicable diffuse flow/SWM requirements.
Applicant Response: See attached. The applicant will obtain riparian buffer authorization and approval of a stormwater
management plan from the local delegated authority prior to the proposed impacts occurring.
NCDWR 3) In the "Impact Justification and Mitigation" section of the PCN, you stated that "the site has been designed to
provide off -site drainage area from adjacent properties to the north and west of the site to continue hydration of
streams and wetlands on the site." A review of the USGS Stream Stats indicates that majority of the drainage area to
these features is within the project limits. Please provide a visual representation or other documentation to support the
previous statement and substantive justification that hydrologic input will be maintained to the wetlands and streams
on the site. Please also update applicable plan sheets to clearly show such measures/details. If maintenance of wetland
hydrology is unable to be justified as appropriate, please update the PCN and plan sheets to include the indirect impacts
resulting from the loss of hydrology and therefore aquatic function.
Applicant Response: See attached. The applicant has designed the proposed project to maintain 72% of the pre -
construction drainage area to wetlands and streams located on the site following construction. Based on the amount of
pre -construction drainage area that will be maintained to unimpacted streams and wetlands located on the site, it is our
opinion that there will not be an adverse affect to aquatic function or quality of remaining unimpacted streams and
wetlands located on the site.

DWR has the same concerns as the Corps. If you would like DWR to continue the review of your application, please copy
me on your response to the requested information. In addition to the Corps' request, please provide a complete
response to the items below. Please note that your application will be considered "on hold" with DWR until a complete
response is received.
Has the delineation of the project area or a portion thereof ever been submitted to the USACE for verification?
Section E.1a (or Section F.1 of PCN Form Version 4.3), you indicated that the project does not include nor is
adjacent to protected riparian buffers. However, the project is located within the Jordan Lake Buffer Area and

The following information is required to complete our evaluation, confirm compliance with one or more General
or Regional Conditions, and/or complete consultation with another federal/state agency to verify the use of the
Nationwide Permit (NWP):
1. Project coordinates in the application are inconsistent with the project description. Please clarify, and/or
provide updated coordinates for the proposed project.
2. Would any of the construction access corridors be maintained as maintenance corridors or roadside
shoulders? If so, have those permanent impacts been accounted for?
3. Temporary wetland impacts for `erosion control devices' are listed in the provided drawings. What are

D. Impact Justification and Mitigation
1. Avoidance and Minimization
1a. Specifically describe measures taken to avoid or minimize the proposed impacts in designing project.
The larger warehouse building has been designed for a specific user based upon their requirements. The site has been
designed to separate tractor trailer traffic from general vehicular traffic. A circular flow around trailer docks and the
warehouses are necessary for operational efficiencies of the occupant, for safety purposes of emergency personnel services
and for the user to segregate tractor trailer from vehicular traffic. Necessary size of the larger building, trailer docks, trailer
storage, distance between docks and trailer storage (i.e. cross dock configuration), vehicular parking areas and general
vehicular and tractor trailer flow pattern has been designed based upon the user's anticipated requirements and general
safety.
The site has been designed to provide off -site drainage area from adjacent properties to the north and west of the site to
continue hydration of streams and wetlands on the site.
The remaining 1.68 acres of wetlands and 1,458 linear feet of stream channel have been avoided.
1 b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques.
The clearing limits will be staked and sediment erosion control devices will be used. Temporary coffer dams will be installed
upgradient of the proposed road crossing. During construction, water will be pumped around the construction footprint.
Appropriate stream bank protection will be provided in the channel during road construction and all excess excavated material
will be immediately removed from the stream bank/road crossing area. Upon completion of the culvert installation, the
temporary sand bag coffer dam will be removed and flow will be diverted through the culvert. Following the culvert installation,
disturbed banks will be restored to similar pre -construction conditions, matted and seeded/live staked.

The IPaC report for the site identifies small whorled pogonia as a federally protected species that could be proximate to
the project area. The project area contains a former drained pond and stream in an overgrown patsture. Suitable habitat,
specificially, mature wooded land with open mid and understories, is not located within the project area. Therefore, we
hvade made a determination of no effect for small worled pogonia.
