Please respond to the items below within 30 days. This application will be considered "on hold" until DWR receives a complete response to the items below: • Impact W4 appears to have a discrepancy between the PCN table and the impact map (Exhibit 8). Please confirm that the impact associated with W4 is for 0.001 acres of temporary construction access, is to be restored, and is not permanent conversion. Stream 12 is described as Intermittent. On Exhibit 5, it is unclear if this stream channel is temporarily impacted by the crossing being installed at Impact S6 (highlighted in yellow below). C • Conditions of the 401 require that, "Any construction corridor that is parallel to a stream or open water shall not be closer than 10 feet to the top of bank or ordinary high-water mark (15A NCAC 02H .0506(b); 15A NCAC 02H .0507(c))". There are several proposed locations (Ex: Exhibit 14) of the 40 ft construction corridor that appear to be at or within 10 feet of the top of bank. Please explain how this condition will be met with the proposed easements or reduce/redesign these areas so that it will meet this condition. 1 While statements were provided in the application for why HDD/jack and bore installation methods were not feasible options for this project, the Division has significant concerns regarding open cut installation methods in large stream systems. It is staff's experience that open cut installation methods within large streams are extremely difficult to construct and maintain in a manner that ensures compliance with water quality standards. Please provide very specific construction details for Stream 1, including proposed dewatering methodology, expectation of encountering rock and methodology for removal of rock, expected construction timeline, and additional measures proposed to ensure water quality protection during construction.
