Dear Mr. Blechinger:
In accordance with the application for discharge permit received on February 3, 1998, the
Division is forwarding herewith the subject NPDES permit. This permit is issued pursuant to the
requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between
North Carolina and the U.S. Environmental Protection Agency dated December 6, 1983.
The following changes listed in the DRAFT permit have been retained in this FINAL permit:
• Delete quarterly monitoring requirement for phenols and barium, for consistency with
groundwater remediation General Permit requirements.
• Delete pH limit and monitoring requirement, for consistency with groundwater remediation
General Permit requirements.
• Delete limit for oil and grease and change monitoring frequency from 2/Month to Monthly, for
consistency with groundwater remediation General Permit requirements.
• Delete Special Condition E (Permit Reopener) since this language is already included in the
permit boilerplate.
• Add monthly monitoring and daily maximum effluent limit of 30 mg/l for total suspended solids,
for consistency with groundwater remediation General Permit requirements.
• Change the permit expiration date from 6/30/99 to 6/30/2004.
In addition, the following changes were added to the FINAL permit based on comments received
and additional evaluation:
• Delete effluent limits and/or monitoring requirements for BTEX compounds (benzene,
toluene, ethylbenzene, xylene). According to the Division of Waste Management, Hazardous
Waste Section, BTEX compounds have not been a problem at this site. There were no known
historical gasoline releases, and the former underground storage tank farm always contained
#2 fuel oil. Since 1993, groundwater monitoring data for the RCRA permit shows very

limited detections (two or less) of ethylbenzene, toluene, and xylene, and no detections of
benzene. The reported groundwater concentrations were below levels of concern for surface
water quality. BTEX compounds have not been detected in the treated effluent from the
NPDES-permitted groundwater treatment system.
• Delete effluent limits and/or monitoring requirements for carbon disulfide, 1,1,2,2-
tetrachloroethane, and 2-butanone, which have not been detected in the groundwater
monitoring wells since the RCRA permit was issued, or in treated effluent from the NPDES-
permitted groundwater treatment system.
• The NPDES Outfall 001 location was corrected in the final map.
If any parts, measurement frequencies, or sampling requirements contained in this permit are
unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30)
days following receipt of this letter. This request must be in the form of a written petition, conforming to
Chapter 150B of the North Carolina General Statutes, and filed with the office of Administrative
Hearings, Post Office Drawer 27447, Raleigh, North Carolina 27611-7447. Unless such a demand is
made, this permit shall be final and binding.
Please take notice that this permit is not transferable except after notice to the Division of Water
Quality. Part II, E.4. addresses the requirements to be followed in case of change in ownership or control
of this discharge. The Division of Water Quality may require modification or revocation and reissuance
of the permit.
This permit does not affect the legal requirements to obtain other permits which may be required
by the Division of Water Quality, the Division of Land Resources, the Coastal Area Management Act, or
any other federal or local governmental permit.

SUPPLEMENT TO EFFLUENT LIMITATIONS
AND MONITORING REQUIREMENTS
SPECIAL CONDITIONS
A (2). CHRONIC TOXICITY PASSIFAIL PERMIT LIMIT (QRTRLY)
The effluent discharge shall at no time exhibit chronic toxicity using test procedures outlined in the "North Carolina
Ceriodaphnia Chronic Effluent Bioassay Procedure," Revised November 1995, or subsequent versions.
The effluent concentration at which there may be no observable inhibition of reproduction or significant mortality is
90% (defined as treatment two in the procedure document). The permit holder shall perform Quarterly monitoring
using this procedure to establish compliance with the permit condition. The tests will be performed during the
months of March, June, September, and December. Effluent sampling for this testing shall be performed at
the NPDES permitted final effluent discharge below all treatment processes.
All toxicity testing results required as part of this permit condition will be entered on the Effluent Discharge
Monitoring Form (MR-1) for the month in which it was performed, using the parameter code TGP3B. Additionally,
DWQ Form AT-1 (original) is to be sent to the following address:

Test data shall be complete and accurate and include all supporting chemical/physical measurements performed in
association with the toxicity tests, as well as all dose/response data. Total residual chlorine of the effluent toxicity
sample must be measured and reported if chlorine is employed for disinfection of the waste stream.
Should there be no discharge of flow from the facility during a month in which toxicity monitoring is required, the
permittee will complete the information located at the top of the aquatic toxicity (AT) test form indicating the facility
name, permit number, pipe number, county, and the month/year of the report with the notation of "No Flow" in the
comment area of the form. The report shall be submitted to the Environmental Sciences Branch at the address cited
above.
Should any single quarterly monitoring indicate a failure to meet specified limits, then monthly monitoring will begin
immediately until such time that a single test is passed. Upon passing, this monthly test requirement will revert to
quarterly in the months specified above.
Should the permittee fail to monitor during a month in which toxicity monitoring is required, then monthly
monitoring will begin immediately until such time that a single test is passed. Upon passing, this monthly test
requirement will revert to quarterly in the months specified above.
Should any test data from this monitoring requirement or tests performed by the North Carolina Division of Water
Quality indicate potential impacts to the receiving stream, this permit may be re -opened and modified to include
alternate monitoring requirements or limits.
NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control organism
survival, minimum control organism reproduction, and appropriate environmental controls, shall constitute an invalid
test and will require immediate follow-up testing to be completed no later than the last day of the month following
the month of the initial monitoring.

NOTIFICATION OF INTENT TO ISSUE A STATE NPDES PERMIT
On the basis of thorough staff review and application of Article 21 of Chapter 143, General Statutes of
North Carolina, Public Law 92-500 and other lawful standards and regulations, the North Carolina
Environmental Management Commission proposes to issue a permit to discharge to the persons listed
below effective 7/7/99 and subject to special conditions.
Persons wishing to comment upon or object to the proposed determinations are invited to submit same in
writing to the above address no later than 6/21/99 . All comments received prior to that date will be
considered in the formulation of final determinations regarding the proposed permit. A public meeting may
be held where the Director of the Division of Environmental Management finds a significant degree of
public interest in a proposed permit.

Public notice of intent to issue a State NPDES permit to the following:
1. NPDES No. NC0061204. Thomas Alphin, P.O.Box 354812, Palm Coast, Florida, has applied for a
permit renewal for a facility located at Scarlett Acres Mobile Home Subdivision, 5528 Sherene Lane,
Walkertown, in Forsyth County. The facility discharges 0.020 MGD of treated domestic wastewater from
one outfall into an unnamed tributary to Mill Creek, a Class C stream in the Yadkin -Pee Dee River Basin
which has a 7Q10 flow of 0 cfs and a 30Q2 flow of 0.08 cfs. BOD, ammonia, and dissolved oxygen are
water quality limited. For some parameters, the available load capacity of the immediate receiving water
will be consumed. This may affect future water quality based effluent limitations for additional
dischargers within this portion of the watershed.
2. NPDES No. NC0037834. City of Winston-Salem has applied for a permit renewal for a facility
located at Archie Elledge WWTP, on NCSR 2972 (Griffin Road), southwest of Winston-Salem, Forsyth
County. The facility is permitted to discharge up to 30.0 MGD of treated domestic and industrial
wastewater from one outfall into Salem Creek, a Class C stream in the Yadkin -Pee Dee River Basin which
has a 7Q10 flow of 15.0 cfs. BOD5, ammonia, and dissolved oxygen are water quality limited. For some
parameters, the available load capacity of the -immediate receiving water will be consumed. This may
affect future water quality based effluent limitations for additional dischargers within this portion of the
watershed.
3. NPDES No. NC0080853. Lucent Technologies, Inc., 475 South Street, Morristown, N.J,. 07962,
has applied for a renewal permit for a facility located at the Salem Business Park, 3370 Lexington Road,
Winston Salem, in Forsyth County. The facility discharges up to 0.302 MGD of treated industrial
wastewater from a groundwater remediation facility from one outfall into an unnamed tributary to Salem
Creek, a Class C stream in the Yadkin -Pee Dee River Basin which has a 7Q10 flow of 0.05 cfs. Seven
parameters are water quality limited. For some parameters, the available load capacity of the immediate
receiving water will be consumed. This may affect future water quality based effluent limitations for
additional dischargers within this portion of the watershed.
4. NPDES No. NCO085871. Flakt Products, Inc., Post Office Box 5309, 501 Merritt 7, Norwalk,
CT 06851 has applied for a renewal, for a discharge permit for a facility located at Flakt Products Plant,
200 Lowery Street, Winston-Salem, Forsyth County. The facility is permitted to discharge 0.0864
MGD of treated groundwater from one outfall into Brushy Fork, a Class C stream in the Yadkin Pee -Dee
River Basin which has a 7Q10 flow of 2.9 cfs. No parameters are water quality limited, but this discharge
may affect future allocations.

• This is a minor renewal for a solvent/die Uo,2ttue cplptaamminated groundwater remediation
system with a design flow of 0.302 MG ! 1:9� ll - Hl-c1arge averages between 0.052 to
0.093 MGD. Due to complexity of treatment system, facility was rated Class II. Facility is operated
by ENSR under contract to Lucent.
• The site is a former AT&T manufacturing site which ceased operation in 1989, and is now owned by
Lucent. Groundwater remediation at this site is a requirement of the facilities RCRA Post -Closure
Permit. NC Division of Waste Management-Haz Waste is overseeing project.
• Facility discharges to UT Salem Creek>Muddy Creek>Yadkin River>High Rock Lake. Salem Creek
is listed in 1998 303(d) as PS (partially supporting) its designated uses, with problem parameters
being fecal, turbidity, and sediment. Nonpoint sources were identified as the major pollutant sources.
Summer 7QI0 is 0.05 cfs, providing limited dilution (IWC = 90%).
Permit Issues
• No major issues with this facility. Results of quarterly toxicity testing do not indicate a toxicity
problem. Since start-up in 1996, 13 of 15 tox tests passed, and the two failures were followed by
passes the following month. DMR data for past 14 months shows only one detection of a toxicant
(tetrachloroethene) at 2.4 ug/l. This permit was effective in 1994 with quarterly monitoring for
toxicants. In comparison, the general GW remediation permits effective in 1996 require monthly
monitoring for all parameters. Given the good compliance record to date, NPDES has kept the
monitoring to a quarterly basis for toxicants.
• Remove phenol monitoring, since it is currently required only for discharges to class WS streams.
• Remove barium from monitoring for the following reasons: 1) this parameter is not required for the
general GW remediation permits; 2) there is no state WQS; and 3) it would only be a concern in class
WS streams where water ingestion is a possible exposure route.
• Add TSS monthly monitoring with limit, which is a requirement in all GW remediation general
permits. In addition, sediment was one reason for impaired stream rating.
• Remove limit for oil and grease, and change monitoring from 2/Month to Monthly. DMR data has

• Remove limit and monitoring requirement for pH, since it is not required in groundwater remediation

F. CHRONIC TOXICITY PASS/FAIL PERMIT LIMIT (QRTRLY)
The effluent discharge shall at no time exhibit chronic toxicity using test procedures outlined in:
1.) The North Carolina Ceriodaphnia chronic effluent bioassay procedure (North Carolina Chronic
Bioassay Procedure - Revised *September 1989) or subsequent versions.
The effluent concentration at which there may be no observable inhibition of reproduction or
significant mortality is 90% (defined as treatment two in the North Carolina procedure document).
The permit holder shall perform quarterly monitoring using this procedure to establish compliance
with the permit condition. The first test will be performed after thirty days from the effective date
of this permit during the months of March, June, September and December. Effluent sampling for
this testing shall be performed at the NPDES permitted final effluent discharge below all treatment
processes.
All toxicity testing results required as part of this permit condition will be entered on the Effluent
Discharge Monitoring Form (MR-1) for the month in which it was performed, using the parameter
code TGP3B. Additionally, DEM Form AT-1 (original) is to be sent to the following address:

Test data shall be complete and accurate and include all supporting chemical/physical measurements
performed in association with the toxicity tests, as well as all dosetresponse data. Total residual
chlorine of the effluent toxicity sample must be measured and reported if chlorine is employed for
disinfection of the waste stream.
Should any single quarterly monitoring indicate a failure to meet specified limits, then monthly
monitoring will begin immediately until such time that a single test is passed. Upon passing, this
monthly test requirement will revert to quarterly in the months specified above.
Should any test data from this monitoring requirement or tests performed by the North Carolina
Division of Environmental Management indicate potential impacts to the receiving stream, this
permit may be re -opened and modified to include alternate monitoring requirements or limits.
NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum
control organism survival and appropriate environmental controls, shall constitute an invalid test
and will require immediate retesting(within 30 days of initial monitoring event). Failure to submit
suitable test results will constitute noncompliance with monitoring requirements.

Pollutant Discharge Elimination System (NPDES) Permit issued by the North Carolina
Department of Environment and Natural Resources (NCDENR) dated May 19, 1999. The
following comments are provided on behalf of Lucent Technologies Inc. (Lucent) to address
issues related to the Draft Permit.
• The NPDES Outfall 001 location indicated on the map of the Draft Permit is incorrect.
Attached is a correct location of Outfall 001 as contained in the current facility NPDES
permit. The outfall is located on Lucent/Salem Business Park property.
• We request elimination from monitoring requirements four constituents identified on the
table contained in Section A(1) of the Draft NPDES Permit including toluene, benzene,
ethylbenzene and xylenes. These four constituents have not been detected in the facility
effluent since treatment was initiated. Furthermore, the constituents are not Hazardous
Constituents of concern as indicated in Part IV, Section B of the RCRA Part B Post Closure
Permit (NCD003213907).
• ENSR is in the midst of evaluating process enhancements related to the oxidation filters and
addition of potassium permanganate to the system. As was discussed recently, ENSR has
eliminated potassium permanganate addition to the system pending the results of the next

quarterly sampling event. Should the test results be positive, we intend to eliminate the
potassium permanganate feed permanently. The attached letter to Mr. Mike Mickey of the
NCDENR, Winston-Salem Regional Office dated June 14, 1999 provides additional support
for our plan. The process description emailed to you on May 10, 1999 for the facility has
been modified as provided below.
"Groundwater containing chlorinated and petroleum hydrocarbon compounds is
extracted through a series of groundwater extraction wells located at the Lucent
Winston-Salem site. The groundwater is pumped via in -well centrifugal pumps to the
treatment facility where the water is treated by the following physical and chemical
methods to remove contaminants prior to discharge under the conditions of the NPDES
permit:
Oil/water separation,
Granular media filtration,
Feed -water storage and equalization
Filtration
Air stripping (Packed tower and shallow tray),
Carbon polishing (activated carbon), and

• ENSR is also planning to address additional process optimization opportunities in the future.
We want to have the flexibility within the new permit to implement process modifications, a `
�er improvements, and system enhancements as appropriate without the need for permit
�ll modifications. For example, the treatment system consists of two parallel treatment trains
f 4. (e.g. "A" and "B" systems). We may conclude, after an engineering review, that adequate
U treatment can be accomplished by only one treatment train.

• Lastly, Special Conditions for Chronic Toxicity limits as indicated in Section A(2) of the Draft
Permit, refer to the test procedures from "November 1995, or subsequent versions". It is
our understanding that, effective July 1, 1999, new "Whole Effluent Toxicity" procedures will
be implemented as described in the NCDENR letter dated May 17, 1999. Will the new
permit allow testing in accordance with the new procedures?

Pursuant to our conversation on June 14, 1999, this letter serves to inform you of a process
operational modification implemented at the Lucent Technologies facility located at 3300
Lexington Road, Winston-Salem North Carolina.
Recent chronic toxicity failures prompted an in-depth evaluation of the groundwater treatment
system. ENSR has identified the most likely contributor to chronic toxicity failure is the addition
of potassium permanganate upstream of the oxidizing filters. Based on the original design, the
oxidizing filters were designed to remove iron and manganese from the influent groundwater to
prevent fouling of the media in the air strippers. Since the start up of the treatment system in
1995, iron and manganese levels in the influent groundwater have declined. Iron and
manganese are, naturally -occurring minerals in the groundwater and not contaminants of
concern.
For evaluation, samples representative of influent groundwater were collected from the
feedwater tanks during May 1999 for analysis of total metals, dissolved metals, suspended
solids, and dissolved solids. The results of these analyses indicate the influent to the oxidizing
filters does not contain significant levels of iron and manganese such that potassium
permanganate oxidation is not required. Based on the analysis results, the majority of iron and
manganese present in the groundwater originates from extraction well EW-15.

The analytical results were supplied to LANTEC (manufacturer of the air stripper media), along
with the pertinent operational data. LANTEC estimated that with extraction well EW-15
contributing flow, the media would likely foul within one year. However, without extraction well
EW-15's contribution, fouling would likely not occur for two years. Fouling is a concern when
iron and manganese concentrations are above 2.0 mg/I each. LANTEC advised that fouling
would be noticeable as the differential pressure, between the influent and effluent air streams
would increase.
Ms. Daphne Olszewski, Case Manager, North Carolina Division of Waste Management has
agreed to allow shut down of extraction well EW-15 for the foreseeable future. With EW-15 off,
iron and manganese concentrations are negligible and well below the oxidizing filters original
design effluent goal. Therefore, ENSR has eliminated potassium permanganate addition to the
oxidizing filters and discontinued operation of extraction well EW-15. The oxidizing filters will
continue to be operated as filters to remove suspended solids however, without the addition of
potassium permanganate.
We understand that discontinuation of potassium permanganate does not require a permit
modification and does not require pre -approval by the North Carolina Division of Water Quality.
ENSR plans to conduct a repeat sampling for chronic toxicity analysis at the next quarterly
sampling event scheduled for the week of June 21 — 25,.1999. The repeat sampling will be
done with the system operating without potassium permanganate addition and without the
operation of extraction well EW-15.

BETX compounds have not historically been a problem at the site. There
were no known gasoline releases, and the former underground storage tank
farm always contained #2 fuel oil. However, since the RCRA permit was
issued in September, 1993, the monitoring results for the BETX
compounds are:
Benzene - not detected
Ethylbenzene - detected once at 21 ug/l
Toluene - detected once at 5 ug/l (detection limit)
Xylene - two hits, one at 7 and one at 160 ug/l
The BETX compounds have only been detected in the extraction wells
nearest the former UST area.
The only other solvent of significant concentration not represented in the
draft NPDES permit is cis-1,2-dichloroethene which was detected as high
as 15,000 ug/l in 1998 (untreated groundwater). Trichlorfluormethane has
been detected in the southern portion of the plume but has decreased over
time to the current (1998) level of 50 ug/l or less. Carboy n disulfide,
1 1,2,2-tetrachloroethane, and 2-butanone have not been found in the
monitoring wells since the RCRA permit was issued.

I received the draft permit today and had a couple of questions or requests
for clarification. In my notes from our telphone conversation on May 6,
1999, I noted that Oil and Grease monitoring was being reduced from 2/mo to
quarterly whereas the draft permit says once per month. I may have
misunderstood. Also, the figure identifies the outfall incorrectly. The
correct outfall location should be at a point on the Salem Business Park
property immediately east of the RR Tracks.

Per our conversation on May 6, 1999 and in response to your request for an
introductory description of the NPDES permitted treatment system at the
former Lucent Winston-Salem, NC facility, the following is provided.
Groundwater containing chlorinated and petroleum hydrocarbon compounds is
extracted through a series of groundwater extraction wells located at the
Lucent Winston-Salem site. The groundwater is pumped via in -well
centrifugal pumps to the treatment facility where the water is treated by
the following physical and chemical methods to remove contaminants prior to
discharge under the conditions of the NPDES permit:
Oil/water separation,
Granular media filtration,
feedwater storage and equalization
Chemical oxidation and filtration (potassium permanganate),
Air stripping (Packed tower and shallow tray),
Carbon polishing (activated carbon), and
Solids removal (filter press).
The groundwater treatment systems consist of two parallel oxidation and air
stripping treatment trains receiving segregated flow as follows:
"A" System - TPH Extraction Wells and Perimeter VOC Extraction Wells; and
"B" System - Interior VOC Extraction Wells.
Groundwater extraction and treatment operations at the site are controlled
through an operations computer located in the treatment building. A series
of touch screens provide the on -site operator with the capability of setting
equipment into on, off or automatic modes. Automatic mode indicates that
the equipment will run within the setpoints specified.

The Division is beginning the second five-year cycle of river basin planning and permit renewals. An
examination of the basin planning schedule has revealed that the timing of permit renewals does not
allow an evenly distributed workload as first envisioned. This results in problems with the efficiency
and effectiveness of the NPDES program. In an effort improve customer service, and after thorough
review of the water quality issues in your area, the Division is changing the permit renewal schedule for
all NPDES permits in your sub -basin.
This permit modification changes the expiration date of the subject permit to June 30, 1999. Please
find enclosed the revised permit cover page. Insert the new cover page into your permit and discard the
old page. All other terms and conditions contained in the original permit remain unchanged and in full
effect. This permit modification is issued pursuant to the requirements of North Carolina General
Statutes 143-215.1 and the Memorandum of Agreement between North Carolina and the U. S.
Environmental Protection Agency.
If you have already submitted a permit renewal application for the subject facility, the Division will
retain the application until your permit is due for renewal. No additional forms or fees will be required.
If any parts, measurement frequencies or sampling requirements contained in this permit modification
are unacceptable to you, you have the right to an adjudicatory hearing upon written request within
thirty (30) days following receipt of this letter. This request must be a written petition conforming to
Chapter 150B of the North Carolina General Statutes, filed with the Office of Administrative Hearings,
Post Office Drawer 27447, Raleigh, North Carolina 27611-7447. Unless such demand is made, this
decision shall be final and binding.

After a thorough review of the Yadkin -Pee Dee River basin management plan and water quality issues relevant to
the subject facility, the Division of Water Quality has decided to extend the duration of the subject permit. The
expiration date of your permit will be changed in order to allow the Division to review all NPDES discharge
permits in the Yadkin River Basin during calendar year 1999.
All terms and conditions in the existing permit will apply until a new expiration date is assigned by the Division.
Extension of existing Effluent Limitations and Monitoring Requirements does not exempt the subject facility from
the new Enforcement Policy recently enacted by the Division.
Attached to this letter is a copy of the Public Notice that is being published to announce the planned extension of
your permit. After Public Notice has been made by the Division, the expiration date of your permit will be
changed via a permit modification. No draft permit will be sent out with the Public Notice, as none of the
conditions in the existing permit will be modified.
The Division appreciates your patience and understanding to date regarding the rescheduling of the subject
permit. If you have already submitted your renewal application package, no additional fees or documentation will
be required as a result of this change to your permit's expiration date.
