Division personnel have reviewed and approved your application for renewal of the subject permit.
Accordingly, we are forwarding the attached NPDES discharge permit. This permit is issued pursuant to
the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between
North Carolina and the U.S. Environmental Protection Agency dated May 9, 1994 (or as subsequently
amended).
An Authorization to Construct (A to C) permit was issued to this facility on November 29, 2001. As such,
the supplement page in this final permit has been changed to incorporate the modifications granted in the
A to C permit. Please note that if any expansion in flow beyond the permitted limit is expected, the Madison
County Board of Education is required to apply for a permit modification.
If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable
to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following
receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of
the North Carolina General Statutes, and filed with the Office of Administrative Hearings (6714 Mall Service
Center, Raleigh, North Carolina 27699-6714). Unless such demand is made, this decision shall be final and
binding.
Please note that this permit is not transferable except after notice to the Division. The Division may require
modification or revocation and reissuance of the permit. This permit does not affect the legal requirements
to obtain other permits which may be required by the Division of Water Quality or permits required by the
Division of Land Resources, the Coastal Area Management Act or any other Federal or Local governmental
permit that may be required.

This permit shall become effective March 1, 2002.
This permit and authorization to discharge shall expire at midnight on September 30, 2005.

Dear Dr. Wilcox:
On February 14, 2001, Wanda Frazier conducted an operation
and maintenance inspection at Madison Middle School. The
inspection indicated marginal compliance as a result of very poor
maintenance by school maintenance staff and identified several
critical issues associated with management of wastewater at this
site.
Attached is a copy of the inspection report for your
records. The following items are in need of immediate
maintenance and repair:
1} There are still serious problems with uneven
distribution of wastewater over the sand filter beds as cited
previously in other inspections. The front of the beds still
appear to be getting most of the flow within the first third of
the length of the bed. This area has accumulated dark, crusty
solids causing the wastewater to pond and generate odors. Some

of the distribution pipes have fallen off of or are sagging
between the supporting blocks and need to be repositioned.
In order for the sand bed to provide adequate treatment,
such as ammonia reduction, it is imperative that the wastewater
be evenly distributed over the entire surface.
2) vegetation growing on the -sand bed needs to be removed
and the sand needs to be raked and leveled.' These deficiencies
have been cited previously in several other inspections of this
facility.
Since Madison County Schools has a contract for providing
technical assistance from the NC Department of Public Instruc-
tion, Division of Plant Operations, this office contacted Bob
Deweese (919-807-3546) and discussed the matter. Bob does an
excellent job of troubleshooting and offering suggestions for
improving plant maintenance and performance. He has suggested
the installation of a recirculation system for the existing
wastewater treatment system.
During Ms. Frazier's visit, she noticed the construction of
a new school adjacent to.the Middle School. The management of
the wastewater from this facility is a critical issue and doesn't
seem to have been properly addressed. Ms. Frazier contacted
school personnel and was told to contact Mr. Wayne Roberts
regarding wastewater treatment for the new school. Mr. Roberts
indicated that there were no plans for the installation of a new
wastewater treatment system. He stated that he wanted to connect
the wastewater flow from an additional 400-500'students to the
existing wastewater treatment system. It must.be stated clearly
that the existing Middle School system cannot accept this
additional wastewater.
The existing wastewater treatment system was designed in
1991 for a 600 student public middle school with cafeteria and
gymnasium with showers. The design flow of 9,000 gallons per day
was based on 15 gallons per day per student. This existing
wastewater treatment system is permitted only for flow from the
Middle School. Current enrollment figures of 618 students
indicate that this system is at its flow capacity. The current
permit expires October 31, 2001. A request for renewal should be
submitted no later that 180 days before expiration.
The current wastewater system has had a history of problems
including poor maintenance, marginal and non-compliance, as well
as,.notices'of violations and civil assessments.

The procedure for obtaining a permit for additional
wastewater flow and permission to expand the existing wastewater
treatment system requires a new NPDES permit and an authorization
to construct permit. This process is quite lengthy and requires
a detailed review of alternative and conceptual engineered plans
for providing .adequate wastewater management, as well as, a
public notice and approval period.
This office has not been contacted regarding the expansion
of the existing system nor the request for an expanded discharge
permit. It is essential that the Middle School Board resolve -the
issues related to the management of the wastewater that will be
generated by the new school before proceeding further with
construction of this new facility.

The following facilities have permits that expire on 10-31-01 and on 12/31 /01 and have
been assigned to you for renewal.
I have attached some of the latest inspection letters which contains comments regarding
renewal. However, I misinformed those facilities, whose permits expire 10-31-01, of the
deadline. For some reason, I was misinformed or I miscalculated and thought that the
deadline was March 31 st, instead of May 4th. SORRY! ! ! I guess that you will start
getting these requests sooner than anticipated.
As you probably know, disinfection will be required for the Town of Hot Springs during
this next permit cycle. We would like to stagger in the fecal limits after they have had
time to budget, get an A to C, install, operate and test the effectiveness of the new system.

system. We met with the architect and explained that the existing
