Ryan,
Can you confirm whether or not the subject project would be for the record only (GC) for a 401 ? Permanent
stream impacts are >40', there are no wetland impacts, no ORW, HQW, PNA, SA, WS-I, II or Wild and Scenic
resources, and no buffers. It is in a trout watershed/stream, but I am not positive if that alone kicks us into
written/Individual 401 territory when we are already getting a written 404. Let me know what you think, thanks!

Bill: This is in response to a Pre -Construction Notification (PCN) DA# SAW-2024-00353 received on
2/15/2024, and considered complete on 2/15/2024. In submitting the PCN, you requested verification that
the proposed project is authorized by a Department of the Army (DA) NWP 14.
The work affecting waters of the United States is part of an overall project known as NCDOT / BR-0067 /
Br100086 / NC151 bridge replacement. The
project involves impacts to a total of 155 linear feet (0.04 acre) of tributary (28 linear feet of bank
stabilization; 127 linear feet of temporary impacts).
The project is located at Bridge No. 86 over Stony Fork, on NC 151, southwest of Candler, Buncombe County,
North Carolina.
Conditions of the Individual Section 401 WQC will generally become conditions of any final
NWP verification letter. Should state action on the required WQC approve
a project different from that shown on the current application, a modification to the PCN will
be required. You should notify our office of any such changes, as substantial changes may
require further evaluation.
As stated above, this is a provisional notification. This letter does NOT provide
Department of the Army (DA) authorization. You are cautioned that commencement of
the proposed activity(ies) requested prior to receiving a written DA authorization would
constitute a violation of Federal laws and subject you to further enforcement action. Receipt

of a certification from the state (NC Division of Water Resources) does not preclude the requirement for
obtaining DA authorization (e.g., an
NWP/RGP verification letter) prior to commencing the work.

of this letter is forwarded to State agencies for their information. If you have
