unto the EPARTMENT, its successors and assigns, in FEE SIMPLE the right of way located in M 11 R River
Township, Henderson County,North Carolina, which is particularly described as follws,
BEGINNING on the undersigned's most southwestern property corner; thence in a northerly
direction with the undersigned's most western property line to a property corner, said
a corner being the most northwestern corner of the undersigned; thence in a southeasterly •
direction with the undersigned's most northern property line to the point of intersection
with the eastern right of way limits of the project, said point being normal to Survey
Station 14+00, Survey Line Y-1; thence in a southwesterly direction in a straight line
S} to a point located 30 ft. southwest of and normal to Survey Station 14+00, Survey Line
,h` Y-1; thence in a northwesterly direction in a straight line to a point located 75 ft.
east of and normal to Survey Station 63+00, Survey Line L-1 Revised; thence in a southerly
direction in a straight line to a point located 75 ft. east of and normal to Survey
Station 61+17.62, Survey Line L-1 Revised; thence in a southerly direction in a straight
m line to a point located 85 ft. east of and normal to Survey Station 59+75, Survey Line
L-1 Revised; thence in a southeasterly direction in a straight line to a point located
105 ft. east of and normal to Survey Station 59+00, Survey Line L-1 Revised; thence in

division property line between the undersigned and Tom Moore, said point being 103 ft.

TO HAVE AND TO HOLD the aforesaid right of way and all privileges and appurtenances thereunto belonging
to the DEPARTMENT in FEE SIMPLE.
The GRANTORS by the execution of this instrument,acknowledge that the plans for the aforesaid project
as they affect their property have been fully explained to them or their authorized representative.
And the GRANTORS covenant with the DEPARTMENT, that the GRANTORS are seized of the premises in fee simple,
have the right to convey the same in fee simple, that the title thereto is marketable and free and clear of all
encumbrances,and that the GRANTORS will warrant and defend the title against the lawful claims of all persons whom-
soever except for the exceptions hereinafter stated. Title to the property hereinabove described is hereby conveyed
