R006.1, (formerly B- 5623). Dear Mr. Steffens and Ms. Sprinkle: The North Carolina Department of Transportation (NCDOT) is proposing to replace Bridge No. 85 over Great Coharie Overflow on SR 1214 (Boykin Bridge Road) in Sampson County. The existing three span - 52 ft. bridge will be replaced with a two span - 80 ft. bridge. A revised preliminary jurisdictional determination (PJD) was acquired for the study area for this project on February 4, 2022 and the project was assigned Action Id No. SAW-2016-01018. DWR issued a Stream Determination Letter on February 7, 2022. Impacts associated with the project include 0.020 acres of fill, 0.041 acres of mechanized clearing and 0.003 acres of temporary surface water impacts for a cofferdam for removal of end bent 2. Total permanent wetland impacts (loss) for this project are 0.061 acres. There is one utility relocation associated with this project that will not impact jurisdictional resources. The attached permit drawings provide more details on the proposed impacts associated with this bridge replacement. Protected Species: Habitat for Wood stork (Mycteria americana) is present within the project study area per the Natural Resource Technical Report (NRTR) Update dated June 28, 2022. The study area was last surveyed on May 1, 2023, and no birds or nest were observed. Per review of the USFWS IPaC database on March 19, 2024, the Wood stork is no longer listed within the project study therefore a biological conclusion is not needed, and no further action is required. The study area was last surveyed on March 22, 2022 and they are absent within the study area and a 'No Effect' determination is suggested for this species. Northern Long -Eared Bat As you are aware, the US Fish and Wildlife Service has revised the previous programmatic biological opinion (PBO) in conjunction with the Federal Highway Administration (FHWA), the US Army Corps of Engineers (USACE), and NCDOT for the northern long-eared bat (NLEB) (Myotis septentrionalis) in eastern North Carolina. The PBO covers the entire NCDOT program in Divisions 1-8, including all NCDOT projects and activities. Although this programmatic covers Divisions 1-8, NLEBs are currently only known in 22 counties, but may potentially occur in 8 additional counties within Divisions 1-8. NCDOT, FHWA, and USACE have agreed to two conservation measures which will avoid/minimize mortality of NLEBs. These conservation measures only apply to the 30 current known/potential counties shown on Figure 2 of the PBO at this time. The programmatic determination for NLEB for the NCDOT program is May Affect, Likely to Adversely Affect. The PBO will ensure compliance with Section 7 of the Endangered Species Act for ten years (effective through December 31, 2030) for all NCDOT projects with a federal nexus in Divisions 1-8, which includes Sampson County, where Bridge No. 85 is located. Tricolored Bat The US Fish and Wildlife Service has issued a programmatic conference opinion (PCO) in conjunction with the Federal Highway Administration (FHWA), the US Army Corps of Engineers (USACE), and NCDOT for the tricolored bat (TCB) (Perimyotis subflavus) in eastern North Carolina. The PCO covers the entire NCDOT program in Divisions 1-8, including all NCDOT projects and activities. NCDOT, FHWA, and USACE have agreed to three conservation measures (listed in the PCO) which will avoid/minimize take to TCBs. These conservation measures apply to all counties in Divisions 1-8. The programmatic determination for TCB for the NCDOT program is May Affect, Likely to Adversely Affect. Once the TCB is officially listed, the PCO will become the programmatic biological opinion (PBO) by formal request from FHWA and USACE. The PBO will ensure compliance with Section 7 of the Endangered Species Act for approximately five years (effective through December 31, 2028) for all NCDOT projects with a federal nexus in Divisions 1-8, which includes Sampson County, where Bridge No. 85 is located. Regulatory Approvals: Section 404 Permit: NCDOT is proposing to construct this project under the conditions of Nationwide 3. Based on the current design and impacts, notification requirements are not applicable for this project and written approval from the USACE is not required. NCDOT will abide by all conditions listed in NW 3 and will include a copy of the certifications in the permit package and/or contract. Section 401 Permit: The associated 401 General Certification 4239 will also apply to this project. Notification thresholds or circumstances for these certifications are not applicable to this project therefore written concurrence from the Division of Water Resources (DWR) is not required. NCDOT will abide by all conditions listed in GC 4239 and will include a copy of the certifications in the permit package and/or contract. The existing bridge is 52' long. The replacement structure will be a two -span 80' long bridge, providing a 30' 10" clear deck width. The roadway grade of the new structure is less than 1' higher than the existing grade along the bridge. There will be no direct discharge into the stream (no deck drains on bridge). The existing bridge has one bent in the stream, and the proposed structure will also have one bent in the stream. All existing stormwater drainage patterns were maintained on the prpoject to the fullest extent. Drainge boxes/concrete flumes will be used to pick up the bridge drainage will discharge at all four quadrants of the bridge, with three of them crossing into wetland boundaries. There are no ditches present to be impacted by the project, and no ditches will be added. There are no existing pipes on the project. Class II rip rap will be used as bank stbilization on the upstream side of the bridge.
