To Whom It May Concern:
On behalf of the City of Raleigh, we are applying for a Nationwide Permit 13 from the US Army Corps of
Engineers (USACE) and Water Quality Certification 4245 and Buffer Authorization from the NC Division
of Water Resources (DWR) for proposed impacts to jurisdictional waters and riparian buffers associated
with the project known as Crabtree Creek Trail Improvements at Lassiter Mill Road. The proposed
project intends to construct an improved trail connection between Lassiter Mill Road and the existing
Crabtree Creek Greenway Trail, which requires streambank stabilization along Crabtree Creek located in
Raleigh, Wake County, North Carolina.
The USACE issued a Preliminary Jurisdictional Determination for the subject project on November 7,
2019, under SAW-2019-02165. The NC DWR issued an On -site Determination for Applicability to the
Neuse Buffer Rules under project number 24-068. This new project has not been assigned a DWR Project
number.
A list of the attachments to the online Pre -Construction Notification Application and those attachments

determination associated with Waters of the U.S. subject to Federal jurisdiction under Section 404 of the Clean
Water Act/Section 10 of the Rivers and Harbors Act of 1899 and/or Waters of State and/or Riparian Buffer Rules.
This notification supersedes any previous correspondence concerning the agent for this project.

GENERAL NOTES:
1. CONTRACTOR SHALL OBTAIN ALL NECESSARY LICENSES AND PERMITS REQUIRED TO
COMPLETE THE WORK INCLUDED IN THE CONTRACT DOCUMENTS AT THE CONTRACTOR'S
EXPENSE.

7. THERE MAY BE WETLANDS WITHIN THIS SITE. IT IS THE OWNER'S RESPONSIBILITY FOR

WATERS TO THE MAXIMUM EXTENT PRACTICABLE. FUELING, LUBRICATION, AND GENERAL
EQUIPMENT MAINTENANCE SHALL BE PERFORMED IN A MANNER TO PREVENT, TO THE

5. CONTRACTOR SHALL NOTIFY "NC811" (811) OR (1-800-632-4949) AT LEAST 3 FULL BUSINESS
DAYS PRIOR TO BEGINNING CONSTRUCTION OR EXCAVATION TO HAVE EXISTING UTILITIES

7. ESTABLISH CONSTRUCTION ENTRANCE AND STAGING AREA (SEE DETAIL ON SHEET EC-3A).
8. INSTALL SILT FENCE, TREE PROTECTION, AND OTHER MEASURES AS SHOWN ON PLANS,
CLEARING ONLY AS NECESSARY TO INSTALL THESE DEVICES.
9. LIMITS OF DISTURBANCE SHALL BE MARKED BY SAFETY FENCING EITHER WITH SILT FENCE
OR ORANGE TREE PROTECTION FENCE (SEE DETAIL ON SHEET EC-4).
10. USE THE AREA DESIGNATED ON THE PLANS FOR ALL STAGING ACTIVITIES RELATED TO THE
PROJECT.
11. PARK ALL CONSTRUCTION EQUIPMENT, INCLUDING TRUCKS AND HEAVY EQUIPMENT
WITHIN THE LIMITS OF DISTURBANCE.
12. INSTALL REMAINING EROSION CONTROL MEASURES AS SHOWN ON SHEETS EC-3A THROUGH

13. BEGIN GRADING ACTIVITIES. IN GENERAL, THE CONTRACTOR SHALL WORK FROM UPSTREAM
TO DOWNSTREAM AND CONSTRUCTION IN A LIVE CHANNEL SHALL UTILIZE SHEET PILING TO
DIVERT WATER AS SHOWN ON THE PLANS. MAINTAIN AND ADJUST E & SC MEASURES AS
GRADING PROGRESSES.
14. AT THE END OF EACH WORKING DAY, THE CONTRACTOR WILL BE RESPONSIBLE FOR THE
APPLICATION OF SEED AND STRAW, AS APPLICABLE, TO NEWLY ESTABLISHED STREAMBANKS
AND DISTURBED AREAS. EROSION CONTROL MATTING WILL BE INSTALLED ON TOP OF THE
SEED AND STRAW IN ACCORDANCE WITH THE EROSION CONTROL CONSTRUCTION
SEQUENCE.
15. CONTRACTOR SHALL IMPROVE AND CONSTRUCT THE GREENWAY TRAIL AND PERMANENT
CROSSINGS BY INSTALLING CULVERTS, STABILIZING SIDE SLOPES, AND MODIFYING THE
GREENWAY TRAIL ACCORDING TO THE PLANS AND SPECIFICATIONS. PERMANENT STREAM
CROSSINGS WILL BE INSTALLED WHILE THE WORKING SECTION CONTAINING THE CROSSING
HAS BEEN DEWATERED. ADJUST ACCESS ROADS AND ASSOCIATED SILT FENCE AS NECESSARY
WHEN PERMANENT STREAM CROSSINGS ARE INSTALLED.

2. RIPRAP APRONS SHALL BE CONSTRUCTED TO IMPEDE ANY EROSION OF THE CHANNEL AND
STREAM BANKS BY THE WATER DIVERTED FROM THE WORK AREA.
3. BANK STABILIZATION STRUCTURES WILL BE INSTALLED ACCORDING TO THE DETAILS
PRESENTED ON SHEET 2C-2.
4. ANY EXCAVATED MATERIAL CONTAINING MANMADE MATERIAL IS NOT SUITABLE MATERIAL
FOR CHANNEL FILL AND MUST BE DISPOSED OF OFFSITE UNLESS OTHERWISE DIRECTED BY

5. THE PROPOSED CHANNEL BANKS SHALL BE STABILIZED WITH EROSION CONTROL MATTING

TRANSPLANTING. PLANTS THAT ARE TO BE TRANSPLANTED WILL BE MARKED WITH HIGHLY
VISIBLE TAPE.
2. ANY UNUSABLE TREES & BRUSH REMOVED DURING CLEARING & GRUBBING OF SITE SHALL

EROSION & SEDIMENT CONTROL NOTES:
1. GRADING AND EROSION CONTROL METHODS SHALL ADHERE TO THE NORTH CAROLINA
DEPARTMENT OF ENVIRONMENTAL QUALITY (NC DEQ) DIVISION OF ENERGY, MINERAL, AND
LAND RESOURCES (NC DEMLR) STANDARDS AND SPECIFICATIONS. WHERE METHODS DIFFER
FROM CITY OF RALEIGH THE MORE STRINGENT METHOD SHALL BE APPLIED.
2. EROSION AND SEDIMENT CONTROL (E & SC) PERMIT AND A CERTIFICATE OF COVERAGE
(COC) MUST BE OBTAINED BEFORE ANY LAND DISTURBANCE ACTIVITIES.
3. WHEN PROJECT IS COMPLETE, THE PERMITEE SHALL VISIT DEQ.NC.GOV/NCG01 TO SUBMIT
AN ELECTRONIC NOTICE OF TERMINATION (E-NOT). A $100 ANNUAL GENERAL FEE WILL BE
CHARGED UNTIL THE E-NOT HAS BEEN FILLED OUT.
4. E & SC DEVICES MUST BE INSTALLED AND INSPECTED PRIOR TO ANY GRADING ON SITE. THE
CONTRACTOR SHALL CALL FOR AN INSPECTION BY NC DEMLR ONCE INITIAL MEASURES ARE

7 DAYS, 10 DAYS FOR MODERATE SLOPES (3H:1V OR LESS) AND WITHIN 14 CALENDAR DAYS
EVERYWHERE ELSE ACCORDING TO THE TEMPORARY SEEDING SCHEDULE ON SHEET 2C-8.
12. FOR ANY LAND DISTURBING ACTIVITY WHERE GRADING ACTIVITIES HAVE BEEN COMPLETED,
TEMPORARY OR PERMANENT GROUND COVER (SHEET 2C-8) SUFFICIENT TO RESTRAIN
EROSION SHALL BE PROVIDED AS SOON AS PRACTICAL, BUT IN NO CASE LATER THAN SEVEN
(7) DAYS AFTER COMPLETING THE WORK. STABILIZATION IS THE BEST FORM OF EROSION
CONTROL. TEMPORARY SEEDING IS NECESSARY TO ACHIEVE EROSION CONTROL ON LARGE

13. THE EROSION CONTROL INSPECTOR MAY REQUIRE ADDITIONAL FIELD MEASURES AS
NECESSARY TO PROVIDE ADEQUATE PROTECTION FROM RECEIVING WATER COURSES.
14. PROTECTION OF EXISTING VEGETATION: AT THE START OF GRADING INVOLVING THE
STRIPPING OF TOPSOIL OR LOWERING OF EXISTING GRADE AROUND A TREE, A CLEAN,
SHARP, VERTICAL CUT SHALL BE MADE AT THE EDGE OF THE TREE SAVE AREA AT THE SAME
TIME AS OTHER EROSION CONTROL MEASURES ARE INSTALLED. THE TREE PROTECTION
FENCING SHALL BE INSTALLED ON THE SIDE OF THE CUT FARTHEST AWAY FROM THE TREE
TRUNK AND SHALL REMAIN IN PLACE UNTIL ALL CONSTRUCTION IN THE VICINITY OF THE
TREES IS COMPLETE. NO STORAGE OF MATERIALS, FILL, OR EQUIPMENT AND NO
TRESPASSING SHALL BE ALLOWED WITHIN THE BOUNDARY OF THE PROTECTED AREA AND
SHALL BE POSTED ON THE PROTECTION FENCE. A PROTECTION FENCE CONSTRUCTED OF
MATERIAL RESISTANT TO DEGRADATION BY SUN, WIND, AND MOISTURE FOR THE DURATION
OF THE CONSTRUCTION, SHALL BE INSTALLED AT THE SAME TIME AS THE EROSION CONTROL
MEASURES AND SHALL BE IN PLACE UNTIL ALL CONSTRUCTION IN THE VICINITY OF THE
TREES IS COMPLETE (SEE DETAIL ON SHEET EC-3A).
15. A CONSTRUCTION SEQUENCE HAS BEEN PROVIDED (SEE THIS SHEET). INSTALLATION OF ALL
PROPOSED E & SC MEASURES IN THE SEQUENCE(S) PROVIDED AND MAINTENANCE OF
THOSE DEVICES IS REQUIRED. THE CONTRACTOR MAY BE ALLOWED, WITH PRIOR APPROVAL
FROM THE OWNER, TO COORDINATE CHANGES TO THE PLAN WITH THE ON -SITE E & SC
INSPECTOR AND THE ENGINEER.
16. CONTRACTOR SHALL INSPECT AND REPAIR ALL EROSION CONTROL DEVICES AT LEAST ONCE
PER WEEK AND AFTER EVERY SIGNIFICANT RAINFALL EVENT. EACH DEVICE IS TO BE
MAINTAINED OR REPLACED IF SEDIMENT ACCUMULATION HAS REACHED ONE HALF THE
CAPACITY OF THE DEVICE.
17. CONTRACTOR WILL FIELD LOCATE SILT FENCE OUTLETS AT LOW POINTS IN SILT FENCE
AND/OR A MINIMUM OF EVERY 100 LINEAR FEET OF SILT FENCE AS REQUIRED TO PROVIDE
RELIEF FROM CONCENTRATED FLOWS. SILT FENCE OUTLETS SHOWN ON THESE PLANS ARE
BASED ON THE BEST TOPOGRAPHIC INFORMATION AVAILABLE AT THE TIME OF DESIGN.
CONTRACTOR TO FIELD VERIFY AND ADJUST LOCATIONS OF SILT FENCE OUTLETS AND/OR
PLACE ADDITIONAL OUTLETS TO INSURE THAT ALL LOW SPOTS ALONG THE SILT FENCE HAVE
AN OUTLET.
18. WASHED STONE AND WIRE BACKING SHALL BE USED WITH SILT FENCE WHENEVER SILT

COURSE WHERE 50' OF BUFFER IS NOT PROVIDED.
19. ALL DIMENSIONS AND GRADES SHOWN ON THE PLANS SHALL BE FIELD VERIFIED BY THE
CONTRACTOR PRIOR TO CONSTRUCTION. CONTRACTOR SHALL NOTIFY THE OWNER IF ANY
DISCREPANCIES EXIST PRIOR TO PROCEEDING WITH CONSTRUCTION FOR NECESSARY PLAN
OR GRADE CHANGES. NO EXTRA COMPENSATION SHALL BE PAID TO THE CONTRACTOR FOR

20. NO DEBRIS SHALL BE TRACKED ONTO PUBLIC RIGHT OF WAY. IF THE SITUATION OCCURS
WHERE MUD, ROCKS AND DEBRIS IS TRACKED ONTO PAVEMENT, THE CONTRACTOR SHALL
CLEAN THE PAVEMENT AND INSTALL ADDITIONAL MEASURES TO PREVENT FUTURE
OCCURRENCES.
21. INSTALL SILT FENCE FOR ALL STAGING AND STOCKPILE AREAS (SEE DETAIL ON SHEET EC-3A).
ANY STOCKPILE AREAS SHALL USE TWO (2) ROWS OF SILT FENCE.
22. IF CONCRETE WASHOUTS ARE UTILIZED, THESE AREAS ARE TO BE WITHIN THE LIMITS OF
DISTURBANCE AND SHOULD BE LOCATED AT LEAST 50 FT. AWAY FROM STORM DRAIN
INLETS AND SURFACE WATER.
EROSION & SEDIMENT CONTROL
MAINTENANCE PLAN:
1. QUALIFIED PERSONNEL, ON A DAILY BASIS WILL EVALUATE ALL TEMPORARY EROSION AND
SEDIMENT CONTROL PRACTICES FOR STABILITY AND OPERATION.
2. INSPECT AND MAINTAIN ALL EROSION CONTROL MEASURES EVERY 7 DAYS AND AFTER EACH
SIGNIFICANT RAINFALL (0.5" OR GREATER) AND DOCUMENT WITH INSPECTION REPORTS
AND WRITTEN LOGS SHALL BE KEPT.
3. A RAIN GAUGE WILL ALSO BE KEPT ON -SITE AND DAILY RAINFALL AMOUNTS WILL BE
RECORDED.
4. ANY REPAIRS NEEDED WILL BE PERFORMED IMMEDIATELY TO MAINTAIN ALL PRACTICES AS
DESIGNED.
5. THE CONTRACTOR SHALL BE RESPONSIBLE FOR THE MAINTENANCE OF TEMPORARY ON SITE
E & SC MEASURES.
6. THE CONTRACTOR SHALL BE RESPONSIBLE FOR IMPLEMENTING AND FOLLOWING THE
APPROVED E & SC PLAN.

PHASE 2 EROSION CONTROL NOTES:
1. CONTRACTOR SHALL LOCATE AND VERIFY THE LOCATION AND DEPTH OF ALL EXISTING UNDERGROUND UTILITIES PRIOR TO BEGINNING CONSTRUCTION AND
NOTIFY THE ENGINEERING OF ANY CONFLICTS/DISCREPANCIES.
2. NEW EROSION AND SEDIMENT CONTROL DEVICES MUST BE INSTALLED AS SHOWN ON PLANS AND INSPECTED PRIOR TO ANY GRADING OR DEMOLITION ON
SITE. MAINTENANCE AND REPAIR SHALL BE MADE, AS NECESSARY, DURING CONSTRUCTION ACTIVITIES. THE CONTRACTOR SHALL CALL FOR AN INSPECTION
ONCE INITIAL MEASURES ARE IN PLACE.
3. SEDIMENT/EROSION CONTROL DEVICES MUST BE CHECKED AFTER EACH STORM EVENT. EACH DEVICE IS TO BE MAINTAINED OR REPLACED IF SEDIMENT
ACCUMULATION HAS REACHED ONE HALF THE CAPACITY OF THE DEVICE.
4. A COPY OF THE APPROVED EROSION CONTROL PLAN MUST BE ON FILE AT THE JOB SITE AT ALL TIMES.
5. INSTALL A RAIN GAUGE (6" CAPACITY OR GREATER) ONSITE.
6. ALL EROSION AND SEDIMENT CONTROL MEASURES SHALL BE MAINTAINED UNTIL ALL UPSLOPE DRAINAGE AREAS HAVE BEEN STABILIZED AND PERMANENT
VEGETATION HAS BEEN ESTABLISHED.
7. CONSTRUCTION, MAINTENANCE, AND REMOVAL OF ALL EROSION CONTROL DEVICES ARE THE RESPONSIBILITY OF THE GRADING CONTRACTOR UNLESS
OTHERWISE NOTED. ANY DEWATERING ASSOCIATED WITH THIS PROJECT IS TO BE DONE THROUGH A SILT BAG. CONTRACTOR SHALL WORK IN DRY CONDITIONS
TO THE MAXIMUM EXTENT POSSIBLE.
8. ANY GRADING BEYOND THE DENUDED LIMITS SHOWN ON THE PLAN IS A VIOLATION OF THE EROSION CONTROL PERMIT AND IS SUBJECT TO A FINE. ANY NEED
TO DISTURB BEYOND THE APPROVED PLAN SHALL BE BROUGHT TO THE ATTENTION OF THE OWNER, ENGINEER AND EROSION CONTROL INSPECTOR.
9. THE ANGLE FOR GRADED SLOPES AND FILLS SHALL BE NO GREATER THAN THE ANGLE THAT CAN BE RETAINED BY VEGETATIVE COVER OR OTHER ADEQUATE
EROSION -CONTROL DEVICES OR STRUCTURES. IN ANY EVENT, SLOPES LEFT EXPOSED WILL, WITHIN 7 OR 14 CALENDAR DAYS OF COMPLETION OF ANY PHASE OF
GRADING, BE PLANTED OR OTHERWISE PROVIDED WITH TEMPORARY GROUND COVER, DEVISES OR STRUCTURES SUFFICIENT TO RESTRAIN EROSION.
PERMANENT GROUNDCOVER WILL BE PROVIDED FOR ALL DISTURBED AREAS WITHIN 15 WORKING DAYS OR NO MORE THAN 90 CALENDAR DAYS (WHICHEVER IS
SHORTER) FOLLOWING COMPLETION OF CONSTRUCTION. TEMPORARY SEEDING IS NECESSARY TO ACHIEVE EROSION CONTROL ON LARGE DENUDED AREAS AND
ESPECIALLY WHEN SPECIFICALLY REQUIRED AS PART OF THE CONSTRUCTION SEQUENCE ON THE PLAN. ALL GRADED SLOPES STEEPER THAN 3:1 MUST BE SEEDED
& COMPOST LAID WITHIN 7 DAYS OF COMPLETION OF GRADING. ALL REMAINING DISTURBED AREAS ARE TO BE SEEDED AND COMPOST LAID WITHIN 14 DAYS.
PERMANENT SWALES ARE TO BE STABILIZED WITHIN 7 DAYS. SEE THE GROUND STABILIZATION CHART FOR ADDITIONAL REQUIREMENTS.
10. ADDITIONAL MEASURES TO CONTROL EROSION AND SEDIMENT MAY BE REQUIRED BY REPRESENTATIVE OF THE NCDEQ DEMLR DEPARTMENT. ADDITIONAL SILT
FENCE OUTLETS AT LOW AREAS MAY BE INSTALLED BY CONTRACTOR AS REQUIRED. E&SC MEASURES ARE TO BE INSTALLED AT ANY AREAS USED FOR
CONTRACTOR EQUIPMENT STAGING, MATERIALS LAYDOWN, SPOIL OR WASTE AREA.
11. PROTECTION OF EXISTING VEGETATION (IF APPLICABLE): AT THE START OF GRADING INVOLVING THE STRIPPING OF TOPSOIL OR LOWERING OF EXISTING GRADE
AROUND A TREE, A CLEAN, SHARP, VERTICAL CUT SHALL BE MADE AT THE EDGE OF THE TREE SAVE AREA AT THE SAME TIME AS OTHER EROSION CONTROL
MEASURES ARE INSTALLED. THE TREE PROTECTION FENCING SHALL BE INSTALLED ON THE SIDE OF THE CUT FARTHEST AWAY FROM THE TREE TRUNK AND SHALL
REMAIN IN PLACE UNTIL ALL CONSTRUCTION IN THE VICINITY OF THE TREES IS COMPLETE. NO STORAGE OF MATERIALS, FILL, OR EQUIPMENT AND NO
TRESPASSING SHALL BE ALLOWED WITHIN THE BOUNDARY OF THE PROTECTED AREA AND SHALL BE POSTED ON THE PROTECTION FENCE. A PROTECTION FENCE
CONSTRUCTED OF MATERIAL RESISTANT TO DEGRADATION BY SUN, WIND, AND MOISTURE FOR THE DURATION OF THE CONSTRUCTION, SHALL BE INSTALLED
AT THE SAME TIME AS THE EROSION CONTROL MEASURES AND SHALL BE IN PLACE UNTIL ALL CONSTRUCTION IN THE VICINITY OF THE TREES IS COMPLETE.
12. INSTALLATION AND MAINTENANCE OF ALL PROPOSED SEDIMENTATION & EROSION CONTROL MEASURES IS REQUIRED. THE CONTRACTOR MAY BE ALLOWED,
WITH PRIOR APPROVAL FROM THE OWNER, TO COORDINATE CHANGES TO THE PLAN WITH THE ON -SITE NCDEQ DEMLR INSPECTOR AND THE ENGINEER OR THE
OWNER'S REPRESENTATIVE.
13. CONTRACTOR WILL FIELD LOCATE SILT FENCE OUTLETS AT LOW POINTS IN SILT FENCE AS REQUIRED TO PROVIDE RELIEF FROM CONCENTRATED FLOWS.
14. ALL DIMENSIONS AND GRADES SHOWN ON THE PLANS SHALL BE FIELD VERIFIED BY THE CONTRACTOR PRIOR TO CONSTRUCTION. CONTRACTOR SHALL NOTIFY
THE OWNER IF ANY DISCREPANCIES EXIST PRIOR TO PROCEEDING WITH CONSTRUCTION FOR NECESSARY PLAN OR GRADE CHANGES. NO EXTRA COMPENSATION
SHALL BE PAID TO THE CONTRACTOR FOR ANY WORK DONE DUE TO DIMENSIONS OR GRADES SHOWN INCORRECTLY ON THESE PLANS IF SUCH NOTIFICATION

AS DETERMINED BY THE ON -SITE INSPECTOR.
17. IT IS THE RESPONSIBILITY OF THE CONTRACTOR TO KEEP ALL SEDIMENT ON SITE AND ENSURE NO SEDIMENT LEAVES THE LIMITS OF DISTURBANCE OF THE
PROJECT. THIS MAY REQUIRE INSTALLATION OF ADDITIONAL EROSION CONTROL MEASURES ABOVE AND BEYOND WHAT IS SHOWN ON THE PLANS. IF
ENVIRONMENTAL OR SITE CONDITIONS WARRANT ADDITIONAL EROSION CONTROL MEASURES, CONTRACTOR SHALL OBTAIN PRIOR APPROVAL FROM DEP

CONSTRUCTION GUIDELINES:
1. ALL EROSION AND SEDIMENT CONTROL DEVICES SHOULD BE INSTALLED IN ACCORDANCE WITH THE
APPROVED EROSION CONTROL PLAN.
2. CHANNEL FLOW SHOULD BE DIVERTED AWAY FROM THE WORK AREA IN ACCORDANCE WITH THE
APPROVED EROSION CONTROL PLAN AND SITE SHOULD BE DEWATERED.
3. LOOSE MATERIAL AT THE TOE OF THE EMBANKMENT SHOULD BE EXCAVATED UNTIL ASTABLE
FOUNDATION IS REACHED.
4. EXCAVATE THE STREAM BANK UNTIL A STABLE SLOPE ANGLE IS ACHIEVED. THE SUBGRADE SHOULD
BE SMOOTH, FIRM, AND FREE FROM PROTRUDING OBJECTS OR VOIDS THAT WOULD EFFECT THE
PROPER POSITIONING OF THE FIRST LAYER OF STONES AND FILTER FABRIC. REMOVE ROOTS, TWIGS,
AND OTHER DEBRIS IN BOULDER TOE EXCAVATION LIMITS.
5. PLACE NON WOVEN GEOTEXTILE FILTER FABRIC LOOSELY AND EVENLY ON PREPARED FILL SLOPE
AND SECURE WITH STAPLES 2 FEET ON -CENTER MAXIMUM. RETAIN A SUITABLE LENGTH OF NON
WOVEN GEOTEXTILE FABRIC TO CONTINUE 12" PAST THE FOOTER ROCK. ADJACENT STRIPS SHOULD
OVERLAP 12 INCHES AND BE STAPLED ON 12 INCH CENTERS. UPSTREAM OR UPSLOPE FILTER FABRIC
SHOULD ALWAYS BE PLACED OVER THE DOWNSTREAM OR DOWNSLOPE FILTER FABRIC. IF THE
FILTER FABRIC IS TORN OR DAMAGED DURING CONSTRUCTION, IT SHOULD BE REPAIRED OR
REPLACED. STAPLES SHALL BE 0.125 INCHES DIAMETER NEW STEEL WIRE FORMED INTO A "U"
SHAPE NOT LESS THAN 6 INCHES IN LENGTH WITH A THROAT OF 1 INCH WIDTH.
6. FOOTER ROCKS SHALL BE PLACED INDIVIDUALLY AND KEYED INTO THE CHANNEL, BED, STREAM
BANK AS SHOWN IN THE DETAIL. THE TOP ROCKS OF THESE STRUCTURES SHALL BE PLACED
LINEARLY, WITH TIGHT AND CONTIGUOUS SURFACE CONTACT WITH ADJACENT ROCK. ENSURE THE
ROCKS ARE STACKED SO THE PLACED STONE RESTS ON TWO STONES IN THE TIER BELOW IT. HEADER
BOULDERS SHOULD BE SET SLIGHTLY BACK FROM FOOTER BOULDERS SUCH THAT PART OF THE
HEADER BOULDER IS RESTING ON THE POROUS BACKFILL.
7. PLACEMENT OF COARSE BACKFILL SHOULD OCCUR CONCURRENTLY WITH THE PLACEMENT OF EACH
CONSECUTIVE ROCK LAYER. THE BACKFILL SLOPE ANGLE SHOULD BE 2H:1V OR FLATTER BUT
SHOULD ALWAYS PROVIDE AT MINIMUM POSITIVE DRAINAGE.
8. IF GEOTEXTILE IS PUNCTURED DURING BOULDER PLACEMENT, THE BOULDERS SHALL BE FULLY
REMOVED FOR AT LEAST THREE FEET OUTSIDE THE LIMITS OF THE FABRIC PUNCTURE AND A NEW
GEOTEXTILE PATCH WITH MINIMUM OVERLAP SHALL BE SECURELY FASTENED OVER THE PUNCTURE
WITH SECURING PINS.
NOTES:
1. AN EROSION CONTROL BLANKET SHALL BE USED TO STABILIZE THE NEWLY CONSTRUCTED
CHANNEL FROM THE TOP OF BANK TO TOE OF SLOPE AND SHALL BE 100%
BIODEGRADABLE.
2. THE CHANNEL SIDE SLOPES SHALL BE FINE GRADED, SEEDED, FERTILIZED, AND LIMED
PRIOR TO INSTALLING THE EROSION CONTROL BLANKET. REMOVE ROOTS, TWIGS, AND
OTHER DEBRIS WHICH WOULD CAUSE BULGES IN THE MATTING AS WELL AS PREVENT THE
MATTING FROM BEING LAID FLUSH TO THE FINISHED SURFACE.
3. KEY -IN EDGES OF MATTING A MINIMUM OF 6 INCHES INTO FINISHED GRADE. LAY
MATTING SHINGLED DOWNSTREAM TO UPSTREAM, OVERLAPPING AT EDGES A MINIMUM
OF 1 FOOT.
4. INSTALL STAKES TO ENSURE GOOD GROUND CONTACT OF THE MATTING TO WITHSTAND
MEDIUM TO HIGH FLOWS. STAKES SHALL BE 100% BIODEGRADABLE AND INSTALLED PER
THE MANUFACTURER'S SPECIFICATIONS INCLUDING, BUT NOT LIMITED TO, THE
MANUFACTURER'S RECOMMENDED DENSITY AND PATTERN.
5. KEY -IN EDGES OF MATTING A MINIMUM OF 6 INCHES, PARTICULARLY NEAR RESTORATION
STRUCTURES, BOULDERS, LOGS, ETC. CHECK MATTING FOR LOOSE ENDS, FLAPS, OR OTHER
WEAKNESSES OR DAMAGE WHICH MAY CAUSE IT TO BECOME LOOSE UNDER FLOW
CONDITIONS.
6. FIELD ADJUSTMENTS TO MATTING LOCATION MAY BE MADE AT THE DISCRETION OF THE
ENGINEER.
7. THE EROSION CONTROL BLANKET SHALL CONSIST OF A MACHINE -PRODUCED BLANKET

CONSTRUCTION GUIDELINES:
1. INSTALL SUBGRADE GRADING AND BOULDER TOE TO FINISHED ELEVATIONS, REMOVING ROOTS,
TWIGS, AND OTHER DEBRIS WHICH WOULD PREVENT THE MATTING FROM BEING LAID FLUSH TO
THE FINISHED SURFACE.
2. PLACE EROSION CONTROL BLANKET ON TOP OF THE SUBGRADE/BOULDER TOE PERPENDICULAR TO
THE DIRECTION OF STREAM FLOW. RETAIN A SUITABLE LENGTH OF EROSION CONTROL BLANKET TO
CONTINUE MATTING UPTHE SLOPE. INSTALL THE EROSION CONTROL BLANKET SUCH THAT THE
UPSTREAM SIDE WILL BE ON TOP AND WILL OVERLAP THE DOWNSTREAM SIDE BY AT LEAST ONE
FOOT AS NECESSARY TO COVER THE LONGITUDINAL LENGTH REQUIRED.
3. PLACE SALVAGED AND/OR FURNISHED TOPSOIL UPON EROSION CONTROL BLANKET TO
APPROPRIATE GRADE ELEVATION AND BANK SLOPE. PLACE SELECT FILL TO A VERTICAL DEPTH OF 12
INCHES AND MINIMUM OF 4 FEET IN LENGTH. TAMP SOIL FIRMLY.
4. APPLY PERMANENT SEED TO TOPSOIL IN ACCORDANCE WITH PLANTING SCHEDULES, SEED MIXES,
AND PLANTING AS DESIGNED AND AS SPECIFIED. SEED MIXTURE TO BE APPLIED TO FRONT PORTION
OF LIFT THAT WILL BE LEFT EXPOSED.
5. ENCAPSULATE THE TOPSOIL WITH UNBURIED LENGTH OF EROSION CONTROL BLANKET TO COVER
THE LIFT. FASTEN EROSION CONTROL BLANKET WITH WOODEN STAKES. HANDLE THE FABRIC AND
SOIL MATERIALS IN A MANNER THAT DOES NOT DAMAGE THE MATTING OR DEPOSIT SOIL
MATERIAL IN THE STREAM CHANNEL. REPAIRS AND FABRIC REPLACEMENT ARE THE RESPONSIBILITY
OF THE CONTRACTOR.
6. AFTER SOIL LIFT IS COMPLETED, THE LIVE CUTTINGS SHALL BE CRISS-CROSSED ON TOP OF THE LIFT
AT 8 TO 12 BRANCHES PER LINEAR FOOT ALONG THE STREAM BANK. THE BASAL END OF THE
BRANCHES SHOULD EXTEND AT LEAST 1 FOOT PAST THE BACK OF THE SOIL LIFT, AGAINST THE BACK
OF THE EXCAVATION. NO MORE THAN 6 INCHES OF THE BUDDING END OF THE LIVE BRANCH
SHOULD EXTEND PAST THE FRONT OR FINISHED FACE OF THE SOIL LIFT. ORIENT THE BRANCHES SO
THE EXPOSED PORTIONS HAVE THEIR BUDS FACING UPWARDS AND REMOVE THE TERMINAL BUD
TO PROMOTE ROOT AND STEM DEVELOPMENT.
7. COVER THE LIVE BRANCHES WITH TOPSOIL TO CREATE AN EVEN SURFACE FOR THE CONSTRUCTION
OF THE NEXT LIFT.

BE OBTAINED WITHIN 200 MILES OF THE PROJECT SITE. PLANT STOCK AND SEED MIXES MAY BE USED FROM NURSERIES

2. THE CONTRACTOR (I.E. PLANTING SUPERVISOR) INSTALLING THE VEGETATION SHALL HAVE ONE OF THE FOLLOWING
QUALIFICATIONS / CERTIFICATIONS: CERTIFIED LANDSCAPE TECHNICIAN, CERTIFIED PLANT PROFESSIONAL, REGISTERED
FORESTER, REGISTERED LANDSCAPE CONTRACTOR, OR CERTIFIED NURSERYMEN.
3. THE CONTRACTOR (I.E. PLANTING SUPERVISOR) WILL BE RESPONSIBLE FOR MANAGING ALLACTIVITIES INVOLVING
PERMANENT PLANTING, INCLUDING BUT NOT LIMITEDTO THE FOLLOWING: SITE PREPARATION FOR PLANTING, SEEDLING

BE BENEFICIAL TO PLANT SURVIVABILITY. ANY ADDITIONAL MEASURES WILL BE CONSIDERED PART OF THE 80% SURVIVAL

property at the request of Jennifer Burdette of Natural Resource Consultants to determine the
applicability of the above -noted state regulations.
The Division of Water Resources has determined that streams listed in the table below and identified on
the attached maps are shown on either the most recently published NRCS Soil Survey of Wake County
and/or the USGS National Map at a scale that incorporates the National Hydrography Dataset High
Resolution data at 1:24,000 scale. Streams that are listed as "Subject" on the below table have been
located on the ground at the site and possess characteristics that qualify them to be at least intermittent
streams in accordance with the NC Stream Identification Manual v.4.11 and therefore subject to the
Neuse Buffer Rules. Please be aware that features identified as "not subject" may be considered
jurisdictional according to the US Army Corps of Engineers and subject to the Clean Water Act.

This letter is in response to your letter of January 22, 2024 which provided the U.S. Fish and
Wildlife Service (Service) with the biological conclusion of the North Carolina Department of
Transportation that the proposed improvements to the Crabtree Creek Greenway in Wake County
(STIP No. BL-0027) may affect, but are not likely to adversely affect the federally listed Neuse
River Waterdog (Necturus lewisi), Dwarf Wedgemussel (Alasmidonta heterodon), Atlantic
Pigtoe (Fusconaia masoni), and Carolina Madtom (Noturus furiosus). The following response is
provided in accordance with Section 7 of the Endangered Species Act (ESA) of 1973, as
amended (16 U.S.C. 1531-1543).
Much of the project occurs just upstream of the Lassiter Mill Dam on Crabtree Creek, and this
impounded upstream section of the stream does not provide suitable habitat for any of the listed
aquatic species. Mussel and fish surveys were conducted within the project area downstream of
Lassiter Mill Dam on August 10, 2022. No Dwarf Wedgemussels, Atlantic Pigtoes, or Carolina
Madtoms were observed. Neuse River Waterdog surveys were conducted downstream of the
dam in December 2022. One Neuse River Waterdog was observed.
Although one Neuse River Waterdog was observed downstream of the dam, the portions of the
project downstream of the dam will likely have insignificant and/or discountable effects to the
species. Based on available information, the Service concurs with your conclusion that the
proposed action may affect, but is not likely to adversely affect the Neuse River Waterdog,
Dwarf Wedgemussel, Atlantic Pigtoe, and Carolina Madtom. We believe that the requirements
of Section 7(a)(2) of the ESA have been satisfied. We remind you that obligations under Section
7 consultation must be reconsidered if. (1) new information reveals impacts of this identified
action that may affect listed species or critical habitat in a manner not previously considered in
this review; (2) this action is subsequently modified in a manner that was not considered in this
review; or (3) a new species is listed or critical habitat determined that may be affected by this

the submittal and offer the following comments.
We have conducted a review of the project and are aware of no historic resources which would be affected by
the project. Therefore, we have no comment on the project as proposed.
The above comments are made pursuant to Section 106 of the National Historic Preservation Act and the
Advisory Council on Historic Preservation's Regulations for Compliance with Section 106 codified at 36 CFR
Part 800.
