8. PROJECT SUMMARY:
The applicant is proposing to replace the current day dock with a larger docking
facility and replace the current boat ramp access pier with a new concrete access
pier. There is currently a pier with a fixed platform, two boat ramps with boat ramp
access pier, fuel pumps, and a bulkhead on site. The applicant could not provide any
past NCDWR or NCDEMLR permits.

9. Project Description
The existing 0.103-acre (4,487sgft) tract is located at 121 Perry Town Road, New
Bern, Craven County. The site is bordered by Brices Creek to the east. The property
shoreline is partially stabilized with a bulkhead, has an elevation of 3' above NWL
and has 188' of shoreline. The property shoreline has a bulkhead, two boat ramps,
and the rest has no coastal wetlands but the rest is an escarped shoreline.
The waters of Brices Creek adjacent to the project area are classified as "C, Sw, NSW"
by the Division of Water Resources. There are no nearby Primary Nursery Areas.
According to the maps provided by the Shellfish Sanitation Section of the NC
Division of Marine Fisheries, the water of the Neuse River adjacent to the property is
predominately closed to shellfish harvesting. No SAV were observed within the
project area.
10. Proposed Project
The applicant is proposing to remove the existing pier and platform and replace it with
a larger docking facility. The new docking facility will be a 9'x10' access platform,
connecting to a 5'x70' platform with 3 5'x24' finger piers, and two tie pilings to create
the docking facility into a 4 slip facility. At end the of the docking facility there is 10'
of water at NWL. The applicant also proposed to remove the current boat ramp access
pier and replace it with a 3'8"x30' concrete access pier. The applicant is proposing to
use marine treated southern yellow pine timber pile and will install them with an
excavator with vibratory hammer. The pilings will have a minimum of 10' embedment
into the river bottom..
11. Anticipated Impacts:
The development would shade 910 square feet of habitat within Brices Creek. There
will be temporary bottom disturbance during dock installation. There would be no
impacts to wetlands, shellfish or SAV resources.

The Purpose for applying for this major development permit is to seek permission for the replacement,
improvement and expansion of the existing dock located at 121 Perrytown Rd. in New Bern NC along
Brices Creek. This dock is for commercial usage for the Merchants Grocery, Grill and General Store,
located across the road at 1801 Brices Creek Rd., and intended for the temporary docking of small
open runabout boats. This project is approx. 1.25 miles up Brices Creek from the Trent River just
beyond the Brices Creek Rd. bridge. The mouth of Brices Creek is approx. 2.25 miles up the Trent
River from the opening at Alfred Cunningham Bridge and the Neuse River.
The current existing wood dock structure has a 5' wide x 20' long walkway connecting to a 5- x 24' L-
shaped finger pier at the end. It is currently being used for temporary docking for fuel and store
merchandise. There is an additional 4' x 30' wooden finger pier in between the two existing boat
ramps located directly to the south of the main dock.
The new dock replacement is proposed to be constructed in the same location as the existing
structure and will continue the same usage. This proposed project includes removal and disposal of
the entire existing wooden dock structure and finger pier. Installation of a new concrete style dock
structure consisting of a 9' x 10' entry access platform along the existing bulkhead. There will be a 5' x
70' long tee style walkway running north to south on the waterward end of this platform and will have
3- 5' x 24' finger piers extending waterward from the Tee. We propose to install a single mooring
piling in between each finger pier creating four dedicated wet slips. We also propose to replace the
existing finger pier between the two existing boat ramps with a new concrete style 30' finger pier that
will be 3'8" wide and will have a new concrete entry ramp abutment on land at the beginning. All
portions of each structure shall be a minimum of 15' away from any adjacent riparian line.
The pilings for this dock will be marine treated southern yellow pine timber pile. We will install them
with the use of an excavator with vibratory hammer that will be stationed upon a steel barge. Pilings
will have a minimum of 10' embedment into the river bottom_ Equipment and material will both be
stored upon this barge as well. Other dock framing materials and concrete decking will set with the
use of gas -powered saws, drills and hand tools. All materials will be attached with 5/8" hot dip
galvanized timber bolts.

All those certain tracts or parcels of land lying and being situate in Number Seven
Township, Craven County, North Carolina, and being more particularly described
as follows:
1. TRACT ONE (PID 7-100-036): Being all of Lot B, 1.598 acres +/-, as same is
shown and delineated on a map of Recombination Survey for Dwight A.
Merchant, said map being recorded in Map Book I, Page 196G in the office of the
Register of Deeds of Craven County, reference to said map being hereby made for
a more perfect description of said property.
2. TRACT TWO PID 7-103-163 : Beginning at an iron pipe in the eastern right of
way Iine of NCSR No. 1143 which iron pipe is located South 13 degrees 00
minutes East 243 feet and North 77 degrees 00 minutes East 30 feet from a spike
at the intersection of the centerline of NCSR No. 1004 with the centerline of
NCSR No. 1143, and running thence with the southern line of the No. 7 Township
Fire Department lot, North 77 degrees 00 minutes East 50.95 feet to an iron pipe
on the west back of Brice's Creek; thence, up and with the shoreline of Bri.ce's
Creek to the complement of the following courses and distances: South 3 degrees

South 11 degrees 13 minutes East 68.03 feet to an iron pipe; thence, South 77
degrees 00 minutes West 11.88 feet to an iron pipe in the eastern right of way line
