Dear John and Chad.
Southern Environmental Group, Inc. (SEGi) has been retained by JC Rentals, LLC (herein referred to as the "Applicant") to
pursue USACE and DWR approvals, in the form of an Individual Permit (IP) and Major Water Quality Certification (WQC)
respectively. The authorizations are necessary to facilitate the impact of 0.68 acre of jurisdictional wetlands, at 7815 Ocean
Highway E., which is located approximately 2.5 miles south of Leland, in Brunswick County, North Carolina. The purpose of
the fill is to allow the Applicant the ability to open a retail car dealership, with associated parking for employees and
customers as well as a dealership office, within a 16.54 acre parcel of land owned by the Applicant
Leland and Brunswick County are rapidly growing areas of eastern North Carolina. However, there are very few car
dealerships, especially used car dealerships, in this region. A search of used car dealerships revealed there is only one located
within the Leland area. The next closest would be in Southport or Shallotte. The Applicant believes there is a need for a used
car dealership in this region, as it will offer residents in and around the Leland area, as well as those in southeastern
Brunswick County, an alternative to driving into Wilmington, which is overly congested as it is, or 45 minutes south to
Shallotte, which is forty five minutes south, or even further into South Carolina for their used vehicle purchases.
The wetland feature to be impacted is a relic bottomland hardwood forest that was severed by the construction of the CRX
railroad bed. This railroad has since been abandoned for use, but the bed still remains. The feature receives stormwater
runoff, from US Highway 17, and groundwater seepage. It discharges, via culvert, into Morgan's Branch, a headwater to
Town Creek. Historically the feature has been continually mowed and, thus, does not provide much in the way of habitat. As
the feature is hydrologically fed by groundwater recharge and stormwater runoff, a slow trickle of water continuously flows
through the culvert. During heavy rain events, stormwater runoff, from US Highway 17, flows directly through the wetland,
without time for biological or chemical processes to remove pollutants.
The Applicant and SEGi have explored multiple off -site and on -site alternatives that would meet the Applicant's desired
purpose and need. They are discussed within the attached IP application and its accompanying appendices. Minimization
efforts, in the form of retaining walls, have been incorporated into the site plan. The use of the wall alleviates the need to

impact approximately 600 square feet (0.013 acre) of pristine bottomland fringe, of Morgan's Branch. In addition to
minimize secondary impacts to downstream water quality, the Applicant proposes to grass the area where used vehicles will
be parked. This should help to treat the stormwater runoff, before it discharges into Morgan's Branch, improving downstream
water quality. As mitigation for the proposed impact, the Applicant intends to make payment to the Lower Cape Fear
Umbrella Mitigation Bank, at a 2:1 mitigation to impact ratio. This would equate to the Applicant purchasing 1.4 acre of
riparian wetland restoration credit. A copy of the acceptance letter has been included as an attachment to IP Application form.
It is SEGi's hope the information found within and attached to this request are adequate to process the authorizations without

The nature of the activity includes removing hydric soil from the wetland feature to be
impacted and replaced with clean earthen fill. Utilities (i.e. light poles) will be intalled and then
the area will be graded to the desired contour. It is estimated that approximately 6745 CY of
clean earthen fill will be needed to bring the car lot up to grade. Retaining walls will be utilized
to minimize impacts to wetlands. Please see Attachment F for details of the work.

The purpose of the project is to establish a retail car dealership that has US Highway 17
frontage, is in a fast growing area of Brunswick County (i.e. close to Leland), on a site that is
logistically capeable of displaying at least 200 used cars, while also providing acreage for an
office and parking for employees and customers and is economically feasible to the Applicant.

This wetland has been historically managed (Le mowed), has been severed from it's parent
feature by the rail road bed and is adjecent to a 4 lane highway (i.e. US Hwy 17). Due to the
fact the site will be grassy, it is anticipated that little runoff will result from the development,
thus flooding is not of concern. This is a single and complete project. Wetland impacts have
not taken place within the property limits or any other phase of the project, -in the past, and
no further wetland impacts are anticipated.

A. Off -site Alternative Analysis
A comprehensive off -site alternatives analysis has been conducted, as part of the Individual Permit process. SEGi
applied the Section 404(b)(1) guidelines by utilizing historical aerial photography and available current land use
records, to best determine if any off -site alternatives existed.
Considering the purpose of the project specifically, the desired location being in close proximity to the town of
Leland and visible from the Highway 17 corridor, multiple sites were reviewed. These sites were chosen for their
visibility from US Highway 17 and zoning, as well as their potential ability to accommodate a retail car dealership,
with accompanying infrastructure, parking and office building. The following table contains the properties that were
evaluated as alternative sites for the development:

Of the above listed sites, only seven (highlighted in yellow) appeared to meet at least some of the Applicant's
required criteria (i.e. commercial or business zoning, good visibility from US Hwy. 17, adequate area and logistically
capable of being developed). Those sites are discussed below.
1. Alternative Site 1 — Parcel ID: 0460004601
This site met the size and location criterion but, when taking into consideration the installation of an
access road and required setbacks, this site does not provide adequate frontage to US Hwy. 17.
Therefore, Alternative Site 1 was rejected.
2. Alternative Site 2— Parcel ID: 04600046
This site appears to meet most of the Applicant's criteria, but a review of LIDAR and the Brunswick
County GIS Wetland Inventory Map reveals the need for wetland impacts, greater than what is currently
being proposed, in order to achieve the Applicant's stated goal. Therefore, this site was rejected.
3. Alternative Site 3 — Parcel ID: 0570008608
While this site meets the location and visibility requirements, it does not provide adequate frontage to US
Hwy. 17, and therefore, was rejected.
4. Alternative Sites 4, 5,and 6 — Parcel IDs: 04700034, 0470004104
These sites are very visible from US Hwy. 17, but they are located within an area of Leland that is
experiencing the highest growth rate, resulting in higher land prices. This makes purchasing these lots
economically infeasible, and therefore, these sites were rejected.
5. Alternative Site 7
As with Alternative Sites 4 -6, this property is located within the high growth rate area of Leland, it is also
visually blocked by mature trees that are located within the NC Department of Transportation right -of -way
vegetative buffer. Therefore, this site was rejected.
B. On -Site Altematives Analysis
During the design of the project, several on -site alternatives were considered.
1. Alternative 1 — Current Proposed Design: This alternative was designed to utilize as much of the Hwy.
17 frontage as possible, while only impacting the degraded wetland feature, within the property
boundaries. Alternative 1 was accepted as it was the least environmentally damaging practicable
alternative.
2. Alternative 2 — Utilization of other uplands within the tract to avoid impacts: This alternative was
reviewed, but there is no available upland, within the parcel, that meets the Applicant's criteria,
specifically uplands that front US Hwy. 17. Therefore Alternative 1 was rejected due to an increased
amount of wetland impacts.
3. Alternative 3 — Minimizing the impact area: This alternative was considered, but was rejected due to the
fact that the entire area is needed to achieve the Applicant's stated goal.
The Applicant investigated other potential means for developing the subject area, and has been unable to find a
practicable alternative that would achieve his goal and meet his stated purpose.
