Debbie,
I have been reassigned the above noted project and require additional information to complete my review. Please
respond to the items listed below within 30 days of this email. The application will be considered "on hold" until receipt
of a complete response.
1. Has the dam breach activity begun yet? If not:
a. Provide a dam breach construction sequence that clearly details how the breach will occur. The
sequence should include an evaluation of the expected flows from the breach area as the area is
excavated, and the velocity expected to be released into the downstream wetland.
b. The Division has concerns that the proposed dam breach has the potential to release sediment into
downstream waters. Have any investigations been completed to determine the elevation of the pond
bottom? Have any investigations been conducted to determine the type of pond bed material,
specifically to determine how likely it would be to mobilize downstream after pond draining.
2. It appears that the proposed riprap dissipator pad to be constructed at the outlet of the culvert will be placed on
a steep slope. Please clarify if the proposed slope is expected to be permanently stable.
3. Please clarify how buffer impacts were determined at the proposed road crossing. Impact Map Area E shows
that portions of the buffer around the lower area of the pond were not included as impacts, however upon
completion of the pond breach it is likely that the buffer will not exist below the proposed road.
4. If the offsite impact area Al and A2 are within an existing maintained sewer corridor then the buffer impacts
within this area would be considered an "existing use" and exempt from the buffer rules.
5. Pursuant to 15A NCAC 02H.0506(b) "a 401 Water Quality Certification may only be issued upon determining that
the proposed activity will comply with state water quality standards which includes designated uses, numeric
criteria, narrative criteria and the state's antidegradation policy, as defined in rules of 15A NCAC 02B .0200... In
assessing whether the proposed activity will comply with water quality standards, the Division shall evaluate if
the proposed activity: (2) would cause or contribute to a violation of water quality standards; (3) would result in
secondary or cumulative impacts that cause or contribute to, or will cause or contribute to, a violation of water
quality standards. Based on the current proposed plan the Division believes there is potential for indirect
impacts to stream A, Stream B and linear wetland L-W01 as all surface flow to these areas appears to be routed
to SCMs which may discharge at a lower point of the noted feature or into a different feature. To further
evaluate this concern, please provide a proposed discharge location for SCM #2 located between Stream A and
Stream B. It is recommended that you also carefully evaluate indirect impacts to these features and provide
further information for the Division's evaluation.
