Ward WTP Guilford County Division personnel have reviewed and approved your application for renewal of the subject permit. Accordingly, we are forwarding the attached NPDES discharge permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated May 9, 1994 (or as subsequently amended). This final permit includes the following changes from the draft permit sent to you on June 7, 2006: ➢ To support nutrient modeling for the Deep River watershed, nutrient monitoring has been added. Monitoring for Total Nitrogen and Total Phosphorus will be conducted quarterly. ➢ A re -opener clause regarding future nutrient controls has also been added. A summary of the Division's nutrient monitoring strategy is enclosed for your reference. The Division cannot agree to the sampling proposal made in your comments dated July 26, 2006. Your technical argument, while sound, does not alleviate the need for effluent data from your facility. Effluent sampling is being added to all permits in the Deep River watershed so that actual nutrient contributions can be tracked from each discharge. The data collected will be used for future modeling of the watershed in order to plan nutrient reduction strategies. Should the effluent data collected show no nutrient loading to the receiving stream, the monitoring may be removed at the next permit renewal. If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings (6714 Mail Service Center, Raleigh, North Carolina 27699-6714). As of this permit issuance, any previously issued permit bearing this number is no longer effective. Continue to operate a conventional water treatment plant with a discharge of filter -backwash wastewater: This facility is located in High Point at the Frank L. Ward WTP on East Kivett Drive in Guilford County. 2. Discharge from the South Lagoon via outfall 001 at the location specified on the attached map into an unnamed tributary to Richland Creek, classified C waters in the Cape Fear River Basin. 3. Discharge from the North Lagoon on an as -needed basis via outfall. 002 [ca. 400 feet upstream of outfall 001 ] into an unnamed tributary to Richland Creek, classified 'C waters in the Cape Fear River Basin. EFFLUENT LIMITATIONS AND MONITORING REQUIREMENTS During the period beginning on September 1, 2006 and lasting until expiration, the Permittee is authorized to discharge from outfall 001 or outfall 002. Simulation discharge from both outfalls is prohibited. The Ward Water Filtration Plant currently pumps as finished water an average of 11.5 MGD. At the present time, we are running Total Phosphorus and (NO3+NO4) on our finished water twice a month. The results we are obtaining on Total Phosphorus are <0.4 mg/L and by using deductive reasoning, our lagoon effluent should be that or less. The (NO3+NO4) results are similar, they are also in the low ranges <0.3 mg/L. We would like to propose an alternative sampling schedule. We would like to sample Quarterly for one year for Total Phosphorus and Total Nitrogen. This will give data for each season of the year. If the results are <0.4 mg/1 Total Phosphorus and <0.4 mg/L Total Nitrogen we would like to stop sampling. If for any reason we would change our process, we would start the cycle over for one year with the same stipulations on results. Please let us know if this will meet with your approval. Question?
