Wendell — this memo is in response to your question about the applicability of Part IV of your
NPDES permit. Part IV includes special conditions for all Municipal discharges.
"Municipal" as defined by EPA regulations means publicly -owned treatment works (POTWs)
treating domestic or domestic & industrial wastewater. At the time the NPDES program and its
facility designations were created, no thought was given to other publicly -owned facilities [such as
schools, prisons, WTPs, etc.] that would potentially require NPDES permits.
Thus the Ward WTP, covered by NC0081256, is NOT required to comply with the special
conditions in Part IV of your NPDES permit.
