The Division has determined that your application is incomplete and cannot be processed. The application is on hold until all of the following information is received: 1. Please provide a cross section detail for the culvert installation showing the provisions for aquatic life passage (Condition 13 of General Certification 3890 [attached]). Per Condition 6 of General Certification 3890, all work must be done "in the dry." Therefore, dewatering methods will be necessary to temporarily dewater the stream channel during culvert installation. Please provide a construction sequence that details the method of dewatering to be utilized at the site and the sequence of construction events to be followed to ensure compliance with this condition. If necessary, please ensure that temporary impacts associated with dewatering for the culvert installation are indicated in a revised impact table. 3. Attachment A Section A.(ii) of General Certification 3890 requires a 30 -foot wide vegetated setback be maintained adjacent to streams, rivers and tidal waters in areas that are not subject to a state Riparian Area Protection Rule or other more stringent vegetated setbacks. It does not appear from the site plans that this condition will be met. Please confirm that this condition will be met. Pursuant to Title 15A NCAC 02H .0502(e), the applicant shall furnish all of the above requested information for the proper consideration of the application. If all of the requested information is not received in writing within 30 calendar days of receipt of the email, the Division will be unable to approve the application and it will be returned. The return of this project will necessitate reapplication to the Division for approval, including complete application package and the appropriate fee.
