The expiration of the permit should read 03-18-17 and not 2012 at the bottom of pg. 1. Looks like they have agreed to
pay Hofmann Mitigation Bank for 1.0 credit- not sure if the payment has actually been made.

Size and location of property (water body, road name/number, town, etc,): The 272.28 acre subdivision property is
located at on Lennoxville Road along Taylors and Turners Creek, Beaufort East Village Subdivision, in Beaufort
Carteret County, North Carolina.
Description of projects area and activity: Discharge of fill material into fill 0.467 ac. of jurisdictional wetlands
associated with the construction of the 597 lot Beaufort East Village Subdivision, with associated roadways,
sedimentation and stormwater features, retaining walls, and lots 586, 587, 580, 581, and 582 as described the
CAMA permit application dated 07-19-I1, work plan sheets 1-7 dated 05-23-2011, Wetland Impact Maps 1-10
dated 5-19-2011, and a letter (copy attached) from the NC State Natural Resources Foundation received by this
office on October 5, 2011 that acknowledges receipt of payment from Mr. Karl Blackley Blue Treasure Llc for 1.0
acres non -riparian wetland mitigation credit associated with the construction of the subject project.

Your work is authorized by the above referenced permit provided it is accomplished in strict accordance with the attached
conditions and your submitted plans. Any violation of the attached conditions or deviation from your submitted plans may subject
the permittee to a stop work order, a restoration order and/or appropriate legal action.
This verification will remain valid until the expiration date identified below unless the nationwide authorization is modified,
suspended or revoked. If, prior to the expiration date identified below, the nationwide permit authorization is reissued and/or
modified, this verification will remain valid until the expiration date identified below, provided it complies with all requirements of
the modified nationwide permit. If the nationwide permit authorization expires or is suspended, revoked, or is modified, such that the
activity would no longer comply with the terms and conditions of the nationwide permit, activities which have commenced (i.e., are
under construction) or are under contract to commence in reliance upon the nationwide permit, will remain authorized provided the
activity is completed within twelve months of the date of the nationwide permit's expiration, modification or revocation, unless
discretionary authority has been exercised on a case-by-case basis to modify, suspend or revoke the authorization.
Activities subject to Section 404 (as indicated above) may also require an individual Section 401 Water Quality Certification. You
should contact the NC Division of Water Quality (telephone (919) 733-1786) to determine Section 401 requirements.
For activities occurring within the twenty coastal counties subject to regulation under the Coastal Area Management Act (CAMA),
prior to beginning work you must contact the N.C. Division of Coastal Management.
This Department of the Army verification does not relieve the permittee of the responsibility to obtain any other required Federal,
State or local approvals/permits.

Determination of Jurisdiction:
A. F] Based on preliminary information, there appear to be waters of the US including wetlands within the above described project
area. This preliminary determination is not an appealable action under the Regulatory Program Administrative Appeal Process
(Reference 33 CFR Part 331).
B. ❑ There are Navigable Waters of the United States within the above described project area subject to the permit requirements of
Section 10 of the Rivers and Harbors Act and Section 404 of the Clean Water Act. Unless there is a change in the law or our
published regulations, this determination may be relied upon for a period not to exceed five years from the date of this
notification.
C. ® There are waters of the US and/or wetlands within the above described project area subject to the permit requirements of
Section 404 of the Clean Water Act (CWA)(33 USC § 1344). Unless there is a change in the law or our published regulations,
this determination may be relied upon for a period not to exceed five years from the date of this notification.
D. ® The jurisdictional areas within the above described project area have been identified under a previous action. Please reference

AUTHORIZED MARCH 19, 2007
Residential Developments. Discharges of dredged or fill material into non -tidal waters
of the United States for the construction or expansion of a single residence, a multiple unit
residential development, or a residential subdivision. This NWP authorizes the construction of
building foundations and building pads and attendant features that are necessary for the use of
the residence or residential development. Attendant features may include but are not limited to
roads, parking lots, garages, yards, utility lines, storm water management facilities, septic fields,
and recreation facilities such as playgrounds, playing fields, and golf courses (provided the golf
course is an integral part of the residential development).
The discharge must not cause the loss of greater than 1/2 -acre of non -tidal waters of the
United States, including the loss of no more than 300 linear feet of stream bed, unless for
intermittent and ephemeral stream beds this 300 linear foot limit is waived in writing by the
district engineer. This NWP does not authorize discharges into non -tidal wetlands adjacent to
tidal waters.
Subdivisions: For residential subdivisions, the aggregate total loss of waters of United
States authorized by this NWP cannot exceed 1/2 acre. This includes any loss of waters of the
United States associated with development of individual subdivision lots.
Notification: The pennittee must submit a pre -construction notification to the district
engineer prior to commencing the activity. (See general condition 27.) (Sections 10 and 404)
