Good morning,
The DWR has reviewed the application materials for this project (DWR Project #20240183) and
supports the USACE request for additional information sent to the applicant to clarify and quantify
the impacts associated with the development. The ePCN was received on 1/26/24. DWR received
the application fee as required by 15A NCAC 02H .0502 (State application completeness
requirements) on 1/31/24 which started the 60-day State review clock and began the 180-day
federal reasonable period of time pursuant to 40 CFR Part 121.6, which ends on 7/29/24. Based on
the pending request for additional information that is necessary to complete the 401 review, DWR
will be placing the project on -hold until the request for additional information has been satisfied.

Dana,
As opposed to waiting for DCM to confirm the project is outside their AEC I went ahead and
reviewed the package for completeness. The following items are needed to make the package
complete and ready for further processing:
• Agent authorization statement provided was not signed the applicant, please have signed.
• The adjacent waterbody was listed as SA which would have in turn required an individual cert
however after confirmation with the State the proper designation would have been SC for the
Cape Fear and C Sw for Barnards Creek. Please correct this on the PCN to avoid any confusion
regarding the need for an Individual water quality certification.
• The Corps will need the floodplain approval before any verifications can be rendered.
• The PCN states a 40' long pipe whereas the drawings show a 38' pipe, please clarify.
• Why is an approximate 40' crossing necessary for two opposing lanes of traffic? Most NCDOT
secondary roads only have 2 (12') lanes, could further minimization be realized?
• The grading limits appear to cross the wetland line in two additional areas, please refer to the
grading drawing with highlighted areas. If grading is extending into the 404 areas
authorization will be required.
• There is a statement on the permit drawings "proposed pier access" but the drawing is cut
short of the entire pier structure. If there will be pier improvements associated with the
apartments this would need to be disclosed and authorized as part of a single and complete
project.
