Good Morning Andy, Thank you for your quick responses. Thank you for the clarification on the private portion of the Alexander Crossing Apartments and the updated documents for the public portion. Please see my comment below in blue regarding the existing sewer permit number. 1. What is/are the permit number(s)associated with the existing sewer being replaced? The existing sewer starting at new Manhole#2(shown in green on the attached exhibit)is 97.19 LF and will be removed/abandoned. We do not know the existing permit number for that existing sewer. Where would I obtain that information?—The owner/operator of the sewer is responsible for keeping and maintaining all permits and records associated with that portion of the sewer. Durham County W WTP should have a record of this information as well. Without the original project name,it would be very difficult for the Division to locate the permit number. Hello Andy, Please see my comment responses below in blue. While looking over some of the documents you forwarded to Kevin,I noticed some differences between the Private and Public projects. Please provide clarification on the following items. • According to the 2024-03-05-Alexander Crossing—Public NCDEQ Sewer Application-Revised application submitted to Kevin on 03/05/2024, the Private portion of the gravity sewer is 300.79 LF of DIP and 78.25 LF of PVC,totaling 379.04 LF of GS and there is approximately 550.48 LF of existing sewer being replaced. The attached exhibit was prepared to include a table that show the split between public and private totals out and show where they are located on-site. The separate narratives were correct, but I did update the lengths on VII of the public application. The private application and narrative are correct. I renamed the date on the attached PDF to keep my head straight and attached both public and private applications and narratives to this email.—Thank you for the clarification on the accuracy of the private application/narrative and the updated public application. • According to the 2024-03-05-Durham County Sewer Project Narrative—PUBLIC submitted to Kevin on 03/05/2024,contain no private sewer information but the public sewer information differs to the narrative provided in the application and states that there is 97.19 LF of existing sewer being replaced. The attached exhibit was prepared to include a table that show the split between public and private totals out and show where they are located on-site.—Thank you for the updated public application. 1. What is/are the permit number(s)associated with the existing sewer being replaced? The existing sewer starting at new Manhole#2 (shown in green on the attached exhibit)is 97.19 LF and will be removed/abandoned. We do not know the existing permit number for that existing sewer. Where would I obtain that information?—The owner/operator of the sewer is responsible for keeping and maintaining all permits and records associated with that portion of the sewer. Durham County W WTP should have a record of this information as well. Without the original project name,it would be very difficult for the Division to provide the permit number. 2. According to the most recent narrative you sent tome for the private project,on 02/05/2024,the total length of GS is 538.66 LF (460.41 LF of DIP and 78.25 LF of PVC. These lengths are correct, see attached exhibit. Please clarify the differences and update both project narratives and FTAs appropriately. —Thank you for the clarification on the accuracy of the private application/narrative. Please update and resubmit this section to reflect that the applicant is a"Corporation." This has been revised to Corporation.-corrected a. Additionally,is the intention for Durham County to take ownership of the infrastructure after the completion of the project? No,this part of proposed sewer will not be maintained by Durham County.-noted 2. Pursuant to Section 18.1.(e)of SL 2023-137,the 75 GPD/BR rate shall apply for all applicable non-discharge permits issued on or after November 1,2023. According to our records, there appears to be a stream through the western portion of the project area. Does this project have any stream crossings or other stream and/or wetland impacts? The storm pipe outlet from the primary SCM does not cross the stream, but there is an impact to the stream buffer. There are no wetland impacts. If so,what are the impacts and are they temporary or permanent? Permanent. —Noted.Buffer impact not due to this sewer extension project. 4. According to Section IX.5.,401/404 authorization is not needed for this project. Please provide an explanation indicating why a separation requirement is not applicable to the project since there is a stream through the western portion of the project area. The storm pipe through the buffer is an outlet from the primary SCM and we are taking stormwater to the stream edge as required.— Noted.Stream impacts not due to this sewer extension project. 15A NCAC 02T.0107 Staff Review and Permit Preparation states: "(2)(e)If an application is accepted and later found to be incomplete, the applicant shall be advised how the application or accompanying supporting information may be modified to make it complete. The staff shall advise the applicant: (2) if all required information is not submitted within 30 days, the project will be returned as incomplete.Any resubmittal of a returned application shall be accompanied with a new application fee." Elaine, While on a call with Zach on another matter,I inquired about Alexander Crossing. There is a possibility that the buffer impact for the primary SCM outlet for this private Apartment project(see picture below)did not require a 401 permit as that responsibility could have been delegating to the City of Durham or Durham County. That makes sense because Edens(former engineer that is out of business)acquired site plan approval,CD approval,Durham County erosion control approval, etc. Thank you Zach for looking into this more. I will wait for confirmation before resubmitting the application back to you Elaine. I am hung up right now as I am trying to locate the 401 approval for the outlet pipe from the stormwater device as shown in the picture below. I do not have a copy of the permit letter in any of the files I have and the developer is looking as well. We took on this project that was almost fully permitted when the former engineering firm closed for business. The site plan was approved, the CD's were approved by the City, and Durham County issued the grading permit. There is no way they would have received all those approvals without that buffer impact permit letter. I reached out to Stephanie Goss at 919-791- 4256 to see if I could obtain the approval letter, which hopefully exists, but I have not heard back from her yet. I will keep you posted on my progress.
