PROJECT SUMMARY: According to the project narrative, the applicant is requesting authorization to re -develop the existing docking facility by removing the existing pier, dock and boatlift, and constructing a new facility in its place 9. NARRATIVE DESCRIPTION: The project site is located at 715 Hughes Road adjacent to a man-made basin/canal, in Hampstead, Pender County. Existing man-made features on the property include a single- family dwelling, uncovered deck and private docking facility (2-slips). The high ground contains several mature Oaks and the understory is blanketed in ornamental landscaping. A quick search of DCM's permit database confirms the existing docking facility was permitted in November 2018 under CAMA general permit No. 70563. The applicant is now proposing to re -develop the existing docking facility by removing the existing pier, dock and boatlift, and constructing a new facility in its place. The new proposal would result in the creation of a new four -slip docking facility. In addition, the applicant is requesting authorization to perform maintenance dredging within the canal and perform new dredging around the proposed four - slip docking facility. The width of the waterbody in the location of the proposed docking facility ranges from approximately 120'-125' from the edge of marsh on one side to the opposing edge of marsh, allowing a maximum distance between 30'-31.5' beyond the nearshore edge of marsh. The marsh area along the applicant's shore is approximately 5'-12' in width and is comprised mostly of Smooth Marsh Cordgrass (Spartina Alterniflora). Mill Creek and the finger canals associated with the creek system, have a documented history of dredging, as authorized under CAMA Major/Dredge and Fill Permit 175-07, which was issued to Mill Creek Waterway Restoration, Inc., in 2007. According to the permit, the channel abutting the subject property was dredged to a depth of 4' (@NLW), and a width of approximately 25', along the centerline. As proposed, new dredging associated with the application package would be located outside of the existing dredge footprint; therefore, it would be considered new dredging. CAMA Major permit 175-07 is still active and is scheduled to expire on December 31, 2025.0 The waters of the AIWW adjacent to the project site are classified as SA-HQW by the North Carolina Division of Water Resources; however, this particular lot is not located within the 575' AEC. They area is NOT designated as a Primary Nursery Area (PNA) by the North Carolina Division of Marine Fisheries, and they are CLOSED to the harvest of shellfish. 10. PROJECT DESCRIPTION: According to the project narrative, the applicant is requesting authorization to re -develop the existing docking facility by removing the existing pier, dock and boatlift, and constructing a new facility in its place. The new proposal would result in the creation of a new four -slip docking facility. In addition, the applicant is requesting authorization to perform maintenance dredging within the canal and perform new dredging around the proposed four -slip docking facility. As proposed, the total slip count at the subject property would be expanded from a Field Investigation Report: Andrew Smith DCM Major Permit Page 12 two -slip facility to a four -slip facility. Currently, the applicant maintains a single 6' x 17' access pier, 12' x 16' floating dock and a 12' x 12' boatlift along the center of his shoreline. In this location, the applicant proposes to demo all existing water dependent structures and install a new 6' x 22' access pier, two new floating docks (6' x 21.5' and 6' x 18', "L-head" shaped), a 14' x 14' covered platform, 4' x 40' fixed finger pier, 4' x 22' fixed finger pier, 4' x 5.5' finger pier and two 14' x 16' boatlifts. These features would be located along the eastern shoreline and would extend toward the edge of the channel. As proposed, the 6' x 18' and 6' x 21.5' "L-head" shaped floating docks would be located along the terminal end of the pier and would extend toward the north, just beyond the edge of the proposed 14' x 14' covered platform, which would abut the 4' x 40' finger pier. The proposed finger pier would span toward the north, just beyond the near shore edge of Coastal Wetlands, and would provide access to the 4' x 5.5' finger pier, 4' x 22' finger pier and the two 14' x 16' boatlifts. The application indicates the entire docking facility would be located just landward of the width of waterbody limitation. These details can be seen on Page 1 of 3 of the application package. In addition to the proposed docking facility, the applicant proposes to perform maintenance dredging + new dredging around the new facility. The site plan drawings indicate approximately -1.0' of water (relative to NLW) along the near shore edge of the docking facility, and approximately -3.5' NLW along the outer edge of the proposed floating docks. The applicant intends to perform maintenance dredging (16' x 30' or approximately 475 sq. ft.) around the proposed floating docks (to a depth of approximately-4.0'), and initiate new dredging around the entire facility, from the northern riparian line to the south riparian line. As designed, the entire dredge footprint would measure approximately 72' x 26' (or roughly 1,900 sq. ft.), and total volume of dredged material/spoil would be approximately 88 cubic yards. The site plans show that the proposed dredge footprint would begin approximately 5' from the waterward edge of marsh and would extend just beyond the'/4 width of waterbody limitation. The dredge cut would taper approximately 5' from the outer edge of marsh, from a depth of approximately -2.0' at normal low water to the -4.0' (NLW) contour. Spoil material resulting from the proposed dredging operations would be handled via a bucket to barge type operation and would be disposed of on the subject property. The designated disposal area (33' x 80' or approximately 2,640 sq, ft.) is located along the roadside portion of the property, well outside of the 30' Coastal Shoreline buffer. Based on a 10/25/23 site visit (conducted by DCM), there does not appear to be any shellfish resources or SAV within the project area. Additionally, the disposal area appears to be void of any wetlands. Considering the main channel of Mill Creek, including the side channel which provides access to the subject facility, has been previously dredged under CAMA major permit 175-07, the new proposal does not appear to be inconsistent with current DCM Rules. ANTICIPATED IMPACTS: As proposed, the docking facility would incorporate approximately 1,151 sq. ft. of open water area. The proposed dredge activities would disturb approximately 1,900 sq. ft. of previously dredged and new shallow bottom area, and approximately 2,640 sq. ft. of upland (dredge spoil placement). The proposed development appears to be consistent with the'/4 width Rule and does not appear to extend beyond the near shore edge of the channel. Additionally, the proposed development would be located within the applicant's area of riparian access. The applicant has received a waiver of encroachment (allowing development within the 15' riparian corridor setback) from the riparian property owner to the north (Thomas); however, the southern neighbor did not agree to waive the setback. As proposed, the new docking facility would be located a distance of at least 15' from the common riparian line shared with the adjoining property owner to the south. The structure consists of a 16' x 6' dock, with 11' long gangway down to a 20.5' x 10.4' floating platform. A rip rap embankment protects the 75' of shoreline, along the water. Existing Land Uses: The project is located in a residential subdivision, with the Washington Acres HOA boat ramp situated to the west of and adjacent to the project property. Existing Wastewater Treatment/Disposal: Sanitary wastewater is not required for this project. Solid Waste/Fish Offal/Trash Disposal: Solid waste, fish offal and trash disposal is not necessary for this project Use and Daily Operations of the Project When Complete Proposed Development Purpose: The purpose of this development is to provide 2 dry slips and 2 wet slips, with adequate water depths, for the private property owner's enjoyment. Build ings/Facilities/U nits/Structu res: The docking facility is the only structure proposed with this application. Use & Daily Operations: Daily operations will be by the owner, his family and friends, and at their leisure. Construction Methodology & Equipment: First, the old dock, floating platform and lift will be removed to allow for dredging to take place. Dredging will be conducted by either with a small excavator or hydraulically, which will be brought to the site by barge. The barge will be moored at the site, when not in use. Spoil from the dredging will be moved to the front of the property by front end loader or bobcat. Once the dredging is complete, pilings will be installed by either jetting or vibration. Lastly the fixed dock, finger piers and gazebo will be constructed, from typical marine construction materials, and then the platforms will be floated into place and attached to their respective pilings. Development Activities Narrative Specifics: The applicant intends to perform dredging activities within 1900 SF of Mill Creek, to a max depth of -3.0' below normal low water, generating approximately 70.4 CY of spoil material (1900 SF x 1.25' (average dredge depth) = 1900 CF/27 = 88 CY). Dredging will not take place within 5' of the NLW line, to ensure coastal wetlands are not affected. The dredge spoil will be spread out across approximately 2830 SF of the applicant's front yard. The docking facility will consist of 9 separate components (please site plan and project narrative and attachments for details). Application Narrative: The project area is located within a man made canal, off of Mill Creek, and is adjacent to the Washington Acres HOA boat ramp. The water is classified as ORW by the Division of Water Resources (see attached). The Division of Marine Fisheries has the waterbody classified as Permanent Secondary PNA but permanently closed to shell fishing (see attached). SEGi measured water depths within the project area on 8/2/23, at 3:15 pm, and found depths ranged from -1.0 below normal low water (BNLW) and -3.0' BNLW. Portions of the canal, including approximately 475 SF of the proposed project area, has received previous authorization, from the DCM, for dredging (see attached Mill Creek Dredging Map - SEGi was not furnished with a copy of the permit or the project number for the Mill Creek Dredging Project). The project site's waterfront has been stabilized with a living shoreline, and coastal wetlands (i.e., Spartina alternaflora) has emerged (see attached). Sand makes up the composition of the proposed dredge area and there are no submerged aquatic vegetation or shellfish within the project area. The first part of the proposed project will entail dredging an area measuring approximately 75' x 25.3' (1900 SF) of sandy substrate to a depth of approximately -3.0' below normal low water. The need to dredge is a result of Washington Acres HOA members power loading their boats, which causes sand to be displaced. When this occurs during an outgoing tide, the sand settles under the applicant's existing dock (see attached). Prior to commencing with dredging, silt fence will be installed around the dredge disposal area and then the existing two -slip docking facility, which is made up of one (1) 12' on center boat lift and one (1) 20.5' x 10.4' floating dock, will be dismantled. Hydraulic and/or mechanical dredging will utilized to complete the work. Silt screens will be used during mechanical dredging, to ensure sediment and fines are contained within the proposed dredge area. Approximately 88 cubic yards of material is proposed to be dredged. The spoil will be spread out across the front of the applicant's property (see attached site plan for details). The second part entails the proposed construction of a new docking facility that will provide for four (4) boat slips, two wet and two (2) with conventional lifts. The docking facility will be for the applicant's personal use and will consist of one (1) 22' x 6' fixed dock (Component 1- DP-1193), which will provide access to one (1) 40' x 4' fixed finger pier (Component 2 - DP-1209) that will provide access to one (1) 16' x 16' covered platform (Component 7 - DP-1212), one (1) 22' x 4' fixed finger pier (Component 3 - DP-1210) and one (1) 14' x 4' fixed finger pier (Component 6 - DP-1211). Components 3 and 6 will provide access to two (2) boat lifts, each measuring 14' x 16' (Components 4 & 5 - DP-1215 and Slips 3 & 4). Component 1 will also provide access, via gangway, to one (1) 21.5' x 6' floating platform (Component 8 - DP-1214), off which one (1) 18' x 6' floating platform (Component 9 - DP-1213) will be positioned. Components 8 & 9 have been designated as Slips 1 & 2 Components 8 & 9 will serve as the other two slip areas. Pilings will be installed using vibration or jetting. It is anticipated the work will be conducted and completed prior to April 2024. If it cannot, the contractor will adhere to the US Fish and Wildlife's GUIDELINES FOR AVOIDING IMPACTS TO THE WEST INDIAN MANATEE Precautionary Measures for Construction Activities in North Carolina Waters (see attached). The need to dredge is a result of Washington Acres HOA members power loading their boats, which causes sand to be displaced. When this occurs during an outgoing tide, the sand settles under the applicant's existing dock (see attached). Prior to commencing with dredging, silt fence will be installed around the dredge disposal area and then the existing two -slip docking facility, which is made up of one (1) 12' on center boat lift and one (1) 20.5' x 10.4' floating dock, will be dismantled. Hydraulic and/or mechanical dredging will utilized to complete the work. Silt screens will be used during mechanical dredging, to ensure sediment and fines are contained within the proposed dredge area. Approximately 88 cubic yards of material is proposed to be dredged. The spoil will be spread out across the front of the applicant's property (see attached site plan for details). The second part entails the proposed construction of a new docking facility that will provide for four (4) boat slips, two wet and two (2) with conventional lifts. The docking facility will be for the applicant's personal use and will consist of one (1) 22' x 6' fixed dock (Component 1- DP-1193), which will provide access to one (1) 40' x 4' fixed finger pier (Component 2 - DP-1209) that will provide access to one (1) 16' x 16' covered platform (Component 7 - DP-1212), one (1) 22' x 4' fixed finger pier (Component 3 - DP-1210) and one (1) 14' x 4' fixed finger pier (Component 6 - DP-1211). Components 3 and 6 will provide access to two (2) boat lifts, each measuring 14' x 16' (Components 4 & 5 - DP-1215 and Slips 3 & 4). Component 1 will also provide access, via gangway, to one (1) 21.5' x 6' floating platform (Component 8 - DP-1214), off which one (1) 18' x 6' floating platform (Component 9 - DP-1213) will be positioned. Components 8 & 9 have been designated as Slips 1 & 2 Components 8 & 9 will serve as the other two slip areas. Pilings will be installed using vibration or jetting. It is anticipated the work will be conducted and completed prior to April 2024. If it cannot, the contractor will adhere to the US Fish and Wildlife's GUIDELINES FOR AVOIDING IMPACTS TO THE WEST INDIAN MANATEE Precautionary Measures for Construction Activities in North Carolina Waters (see attached).
