This letter is in response to NCDEQ's NPDES Compliance Evaluation Inspection (CEI) Report addressed to
MCK's Charlotte North Carolina Terminal (Facility) dated August 09, 2023, that corresponds to CEI
inspection conducted on August 02, 2023, Permit Number NC0046213. In this letter, NCDEQ indicated
the inspection revealed the following deficiencies:
1) This report is being issued as a Notice of Violation (NOV) for the late submittal of the
November 202Z January 2023, and March 2023 E DMR's which are violations of the subject
NPDES Permit and North Carolina General Statute (G.S.) 143-215.1:
Actions Taken to Address Violation:
MCK Terminals LLC has reviewed the NCDEQ's NPDES Compliance Evaluation Inspection (CEI) Report.
Based on this review:
• The facility has implemented a QA/QC procedure to ensure the proper sampling and accuracy of
the data reported on the discharge monitoring report (DMR).
• The facility has scheduled routine monthly meetings prior to the DMR due date to review the
data with the Responsible Official to support certification and submission of the DMR in a timely
manner.
