1.0 Introduction (Block 18)
The Villages at Cross Creek Subdivision is a 194.45-acre property located off of NC Highway
125 in Roanoke Rapids, North Carolina (Attachment A, Figure 1). The property has been
developed with both single-family and multi-family residences. Sewer and power easements
have been constructed on the site.
In the northwest corner of the subdivision lies an emergent riparian wetland. The drainage
feature which bisects the wetland is an unnamed tributary (UT) to Chockoyotte Creek.
Previously this drainage feature was dammed at the crossing of N.C. 125, and a pond existed on
the site. This dam was reportedly breached during Hurricane Isabel in 2003 and the water
drained from the pond. An emergent wetland developed in the area of the former pond and the
UT to Chockoyotte Creek cut a new drainage feature through the wetland.
Roanoke Land Development LLC plans to rebuild the dam and restore the pond within
approximately 4.99 acres of the emergent wetland.
2.0 Purpose and Need (Block 19)
The purpose and need for this project is to rebuild a dam that was damaged during Hurricane
Isabel in 2003 in order to recreate the pond and restore the historic aquatic function of the site.
Because it is depicted on the USGS Topographic Map Roanoke Rapids, NC Quadrangle,
(Appendix A, Figure 2) the pond has been located on the site since at least 1974.
3.0 Site Description
The site is located in the Roanoke River Basin (Hydrologic Unit Code 03010107).Two
jurisdictional wetland areas have been delineated on the site. Located on the western boundary of
the property there is a 19.486-acre wetland, the northern half of which is an emergent wetland
that was once a pond, and the southern half which is a forested wetland area. Another wetland
area on the eastern side of the property is 2.014 acres and forested. A drainage feature which
runs through the western wetland is a UT to Chockoyotte Creek (Division of Water Quality
Stream Index # 23-29; Class C). The jurisdictional determination plat, verifying the locations of
these wetlands, was signed by Ms. Jean Manuele of the US Army Corps of Engineers (USAGE)
on March 17, 2006.
4.0 Impacts
4.1 Wetland Impacts (Block 20)
There will be permanent impacts to 383.5 square feet (0.01 acres) of wetland due to fill
from placement of the new dam. There will be permanent impacts to 217,174.3 square
feet (4.99 acres) of wetland due to flooding from the reformation of the pond. Some
excavation may also take place within the 4.99 acres in order to form the banks of the
pond, and to keep the pond contained within those 4.99 acres. Any soil excavated from

the pond area will be placed outside of the wetlands. There have been no impacts to
wetlands from subdivision construction and there are no plans to impact wetlands by the
subdivision in the future.
Impervious surface on the site at "build out" will be 13.6% (Attachment C), therefore
stormwater controls are not required by North Carolina Division of Water Quality
(NCDWQ). Sewage will be treated by the City of Roanoke Rapids, and homes will be
connected to the sewer line that has already been constructed on the site. This project will
not have cumulative impacts which would result in additional development that could
impact nearby downstream water quality.
4.2 Cultural Resources
Historic Resources - Archeology and Architecture
A letter was sent to the North Carolina State Historic Preservation Office (SHPO) on
June 22, 2007 (Appendix B) by ECS regarding any archeological or architectural
resources on the site. A response was received via letter dated July 20, 2007 from Ms.
Renee Gledhill-Earley requesting an archeological survey in the area of subdivision
construction. ECS then emailed Ms. Gledhill-Earley on August 16, 2007 to inform the
SHPO that the construction of this subdivision was already complete and that this permit
application was simply to replace the dam that had been destroyed during Hurricane
Isabel. ECS then received a letter from Ms. Gledhill-Earley, dated August 20, 2007
withdrawing their recommendation for an archeological survey. SHPO did not have any
issues concerning architectural resources.
Wild and Scenic Rivers
This project will not impact any designated Wild and Scenic Rivers.
4.3 Federally Protected Species
A review of the North Carolina Natural Heritage Database for the USGS 7.5 Minute
Roanoke Rapids, NC Quad revealed no Federally-endangered, threatened, proposed
endangered or proposed threatened species. In addition, ECS sent letters to the U.S. Fish
and Wildlife Service (USFWS) and the North Carolina Natural Heritage Program (NHP)
on June 22, 2007 (Appendix B). The response from the USFWS, dated July 9, 2007 was
that the site does not "appear to have any federally-listed threatened or endangered
species, or protected habitat, or species proposed for listing". The response from the
NHP, dated June 27, 2007 was that they have "no record of rare species, significant
natural communities or significant natural heritage areas at the site nor within a mile of
the project."

5.0 Impact .lustification
The following alternatives analysis is provided to show that the project impacts are justifiable in
the location proposed.
Alternative 1 - No Build
Alternative 1 would leave the emergent wetland in its current state (Appendix E). This would not
meet the project purpose and need of replacing the dam and restoring the pond. In addition, this
would not provide for the historical aquatic function of the site. A pond has been on the property
since at least 1974 when the USGS Topographical Quad was published.
Alternative 2 -Off-Site Pond
Alternative 2 would dam a stream or drainage feature and create a pond in another location in
Roanoke River Drainage Basin. This would not meet the project purpose and need of restoring
the historical aquatic function on the Villages at Cross Creek property. In addition building a
dam in another location would likely alter the aquatic function of another feature that has not
historically been a pond. It could also impact terrestrial wildlife by removing upland habitat, and
Alternative 3 - On-Site Pond (Preferred Alternative)
Alternative 3 would replace the dam on the subject property that was breached during Hurricane
Isabel in 2003, thereby restoring the pond that has been located on the property since at least
1974. This will also restore the historical aquatic function that has been present on the site in the
past. This is the only alternative that meets the project purpose and need.
6.0 Mitigation
Roanoke Land Development, LLC is purchasing all compensatory mitigation via the North
Carolina Ecosystem Enhancement Program's In-lieu Fee Process. The acceptance letter can be
found in Attachment B.

The purpose of this letter is to notify you that the North Cazolina Ecosystem Enhancement Program (NCEEP) is willing to
accept payment for impacts associated with the above referenced project. Please note that this decision does not assure that
the payment will be approved by the permit issuing agencies as mitigation for project impacts. It is the responsibility of the
applicant to contact these agencies to determine if payment to the NCEEP will be approved.
This acceptance is valid for six months from the date of this letter and is not transferable. If we have not received a copy of
the issued 404 Permit/401 Certification/CAMA permit within this time frame, this acceptance will expire. It is the
applicant's responsibility to send copies of the permits to NCEEP. Once NCEEP receives a copy of the permit(s) an invoice
will be issued based on the required mitigation in that permit and payment must be made prior to conducting the authorized
work. The amount of the In Lieu Fee to be paid to NCEEP by an applicant is calculated based upon the Fee Schedule and
policies listed at www.nceep.net.
Based on the information supplied by you the impacts that may require compensatory mitigation are summarized in the
following table.

Upon receipt of payment, EEP will take responsibility for providing the compensatory mitigation. If the regulatory agencies
require mitigation credits greater than indicated above, and the applicant wants NCEEP to be responsible for the additional
mitigation, the applicant will need to submit a mitigation request to NCEEP for approval prior to permit issuance. The
mitigation will be performed in accordance with the Memorandum of Understanding between the N. C. Department of
Environment and Natural Resources and the U. S. Arrny Corps of Engineers dated November 4, t998.

Thank you for your letter of June 22, 2007, concerning the above project.
~X/e have determined that the project as proposed will not affect any historic structures.
Based on the topographic and hydrological situation of the project area, there is a high probability that prehistoric
archaeological sites exist in the overall development area. Depending on the historic use of the land, historic-period
sites may exist as well. We note several structures on the topographic map (our copy dated 1974) that may have
associated-or themselves now be-archaeological sites. While the wetlands crossings typically covered under a
permit application probably will not affect significant archaeological resources, subsequent construction of the
proposed subdivision may.
We, therefore, recommend that an archaeological survey be conducted across the overall project area to identify and
evaluate potentially significant sites prior to inltiaaon of the subdivision facilities (e.g., roads, utiliues). If significant
sites are identitled, appropriate measure can then be taken to minimize adverse impacts. We will be pleased to assist
you in the development and review of any scopes of work, proposals, or other documents relating to this matter.
Two copies of the resulting archaeolo},ncal survey repott, as wdl as one copy of the appropriate site Forms, should
be forwarded a> us for review and comment as soon as they are available and well in advance of any construction
activities.
A list of archaeological consultants who have conducted or expressed an interest in contract work in North Carolina
is available at wwly.arch.der.srlte.ne.us/cr>rlsults. The archaeologists listed, or any other experienced archaeologist,
may be cc,nricted to conduct the recommended survev.

The Natural Heritage Program has no record of rare species, significant natural communities, or
significant natural heritage areas at the site nor within a mile of the project area. Although our maps do
not show records of such natural heritage elements in the project area, it does not necessarily mean that
they are not present. It may simply mean that the area has not been surveyed. The use of Natural
Heritage Program data should not be substituted for actual field surveys, particularly if the project area
contains suitable habitat for rare species, significant natural communities, or priority natural areas.
You may wish to check the Natural Heritage Program database website at www.ncnhp.org for a listing
of rare plants and animals and significant natural communities in the county and on the quad map.
NC OneMap now provides digital Natural Heritage data online for free. This service provides site
specific information on GIS layers with Natural Heritage Program rare species occurrences and
Significant Natural Heritage Areas. The NC OneMap website provides Element Occurrence (EO) ID
numbers (instead of species name), and the data user is then encouraged to contact the Nahrral Heritage
Program for detailed information. This service allows the user to quickly and efficiently get site specific
NHP data without visiting the NHP workroom or waiting for the information Request to be answered by
