The following summarizes findings from the regulatory field visit with the U.S. Army Corps of
Engineers (USACE) and N.C. Division of Environmental Quality (NCDEQ) held at the project site
on January 25, 2024, to review the wetland, stream and riparian buffer determination.
1. Morgan Creek Crossing
a. USACE:
i. Requested that M&C/TranSystems provide documentation indicating the
proposed project will not impeded normal high water flows
Response: See Sheet C2 which includes a profile of the existing and
proposed conditions including the Ordinary High Water Mark (OHWM).
Per our site visit on January 25, 2024, the USACE indicated water
elevations on this day were approximately the OHWM. The existing
sanitary sewer pipe was above the water during this site visit and
therefore above the OHWM. The proposed aerial sanitary sewer pipe's
lowest elevation is higher than the existing aerial sewer pipe and
therefore will also be above the OHWM.
ii. Requested updates to temporary and permanent impacts
Response: see discussion below and attached.
b. General Impact Drawing Changes:
i. USACE: The drawings should show the concrete pier as a temporary
impact and note that the pier is being removed completely and the
streambed will be restored with natural material

M&C Response: Per note on IM2 of the Impact Maps, the stream crossing
is a temporary impact and it includes removal of the existing sanitary
sewer pipe and existing concrete pier.
ii. USACE: The drawings should show the clearance from bottom of
proposed pipe to bottom of stream bed
Response: See sheet C2 of the Plan/Profile drawings, approximately Sta.
12+50 and Note 9 for this change.
iii. DEQ: The drawings should include diagrams and explanation on
dewatering and sequence of events
Response: The proposed aerial sewer is 36-inch stainless steel with
welded joints and will be supported by concrete piers that are located
below grade outside of the stream channel. The proposed features are
installed above the Ordinary High Water Mark (OHWM), and outside of
the stream. Temporary coffer dams will be utilized to install the concrete
piers. The proposed sewer pipe will be staged away from the stream
while the joints are welded. Upon successful completion of welding the
joints of the new sewer pipe, the new pipe will be lifted and placed onto
the concrete piers. The pipe will be secured to the concrete piers per the
drawings. Once flow is removed from the existing sewer (required as part
of installation of MH 12), the existing aerial crossing and three (3)
associated existing concrete piers will be removed from the stream
channel and the stream bed will be restored with natural material. The
stream banks will be restored utilizing the detail shown on the plans
which requires rip rap to be keyed into the bank.
The use of temporary coffer dams will allow uninterrupted flow of
Morgan Creek for installing concrete piers. Any impacted areas will be
restored to original grade and stabilized.
iv. DEQ: The Drawings should show the existing permanent maintained
utility easement and proposed utility easement
Response: The 401-404 impact maps have been updated to show the
proposed and existing maintained corridors.
v. DEQ: The buffer impacts call -outs and tables should include "Allowable"
or "Allowable w/ Mitigation"
Response: All riparian buffer impacts are allowable. A note has been
added to impact maps.

2. Tributary to Morgan Creek near Station 3+50
a. USACE:
i. USACE identified the stone inside the stream as existing. Excavation in
this area is not anticipated, but if required, needs to be restored to match
existing conditions which means the stone needs to be replaced and
"keyed" in place
Response: Sheet C1 has been updated to indicate this stream is
jurisdictional per the USACE. Sheet EC1 has been updated to require
Contractor to restore stream to match existing conditions with native
material. See updated impact maps indicating temporary stream impacts.
b. DWR
i. Prior DEQ determination did not identify this as a jurisdictional stream
and therefore the Jordan Buffer rules are not implemented. Assuming
the prior determination has not expired, the prior determination will
remain effective and no buffers will be added to the stream.
Response: Updated JD mapping is provided. No change required to
impact maps.

pond connected to a stream feature, or the feature is determined not to be present. Stream features that are checked
"Subject" have been located on the property and possess characteristics that qualify them to be subject to the buffer
rules. There may be other streams located on the property that are not depicted on the maps referenced above and

are therefore not subject to the buffer rules. However, if the stream features are present on the tract they are subject
to all other applicable North Carolina stream standards and permitting requirements as outlined in 15A NCAC 0213,
and may be considered jurisdictional according to the US Army Corps of Engineers.
This on -site determination shall expire five (5) years from the date of this letter. Landowners or affected
parties that dispute a determination made by the DWR may request a determination by the Director. An
appeal request must be made within sixty (60) days of date of this letter. A request for a determination by the
Director shall be referred to the Director in writing. If sending via US Postal Service: c/o Paul Wojoski; DWR
— 401 & Buffer Permitting Unit; 1617 Mail Service Center; Raleigh, NC 27699-1617. If sending via delivery
service (UPS, FedEx, etc.): Paul Wojoski; DWR — 401 & Buffer Permitting Unit; 512 N. Salisbury Street;
Raleigh, NC 27604.
This determination is final and binding unless, as detailed above, an appeal is requested within sixty (60)
days.
This project may require a Section 404/401 Permit for the proposed activity. Any inquiries should be
