Although partial delineation information was included in your PCN, complete delineation information and documentation for USACE concurrence was not included. Per NWP 29 General Condition 32(b)(5), this information is necessary to process your requestto verify the use of this NWP, and as such your PCN is considered on hold until this information is provided. Note also that a site visit may be required to verify your delineation of potential waters of the US. Further, additional revisions may be required on the PCN and plans based on the final Corps -verified boundaries of potential waters of the US. Specifically, I cannot confirm that a PJD or Delineation Concurrence was issued because I cannot locate that documentation in our files or database. Delineation documentation and Corps concurrence should always be submitted with your PCN. Please submit the PJD/DC and all correspondence, data sheets, supplemental documentation via email to me so that I may continue review of the proposed project. The Preliminary JD request was submitted to RaleighNCREGC@usace.army.mil on June 16, 2022 and was assigned to April Norton, USACE. A copy of the Preliminary JD request (SAW-2022-01307 [1j TRGNSYSTEMS OWASA Morgan Creek Interceptor, Chapel Hill), and correspondence with April Norton is attached to this response. b. Additionally, based on evidence reviewed by the Corps in association with our review of this project application there is sufficient reason to assume there are jurisdictional wetlands and additional jurisdictional streams in the project review area. Per General Condition 32.(4)(i) A description of the proposed activity; the activity's purpose; direct and indirect adverse environmental effects the activity would cause, including the anticipated amount of loss of wetlands, other special aquatic sites, and other waters expected to result from the NWP activity, in acres, linear feet, or other appropriate unit of measure; a description of any proposed mitigation measures intended to reduce the adverse environmental effects caused by the proposed activity; and any other NWP(s), regional general permit(s), or individual permit(s) used or intended to be used to authorize any part of the proposed project or any related activity, including other separate and distant crossings for linear projects that require Department of the Army authorization but do not require pre -construction notification. The description of the proposed activity and any proposed mitigation measures should be sufficiently detailed to allow the district engineer to determine that the adverse environmental effects of the activity will be no more than minimal and to determine the need for compensatory mitigation or other mitigation measures. OWASA is committed to incorporating all reasonable and practicable design features to avoid and minimize jurisdictional impacts and to provide full compensatory mitigation of all remaining, unavoidable jurisdictional impacts. Avoidance measures were taken throughout the planning and design stages, and minimization measures were incorporated as part of the project design. The proposed project will result in minimal adverse environmental effects, and impact areas have been limited to one stream crossing at Morgan Creek. The installation will be completed via open cut and includes bank stabilization. For the bank stabilization, natural material and rip rap will be reinstalled per the stabilization detail sheet previously provided. Permanent stream impacts from the installation will result in 56 linear feet (3,393.16 sq. ft.) of permanent impact. No temporary stream impacts are proposed. 2. Per General Condition 15. Single and Complete Project. The activity must be a single and complete project. The same NWP cannot be used more than once for the same single and complete project. PCN Section 6a. Is this a phased project? Answer: No. a. This answer contradicts supplemental documentation to the contrary - specifically the following: "Phase II of the project involves the installation of approximately 1,500 linear feet of 36-inch gravity sanitary sewer as a parallel replacement for the existing gravity sewer. The new sewer is anticipated to be [2l TRGNSYSTEMS installed via open cut and will result in permanent and temporary impacts. Design of Phase II has not begun, however permanent impacts are assumed to be an additional 15-ft of cleared area (parallel to existing cleared easement). Additionally, permanent impacts may include installation of permanent access from Flat Stone Court or the Mason Farm Wastewater Treatment Plant. Temporary impacts are assumed to be a 30-foot cleared area parallel to the alignment to be used during construction. It is likely that two approximately 50 feet by 50 feet laydown areas will be placed within the project area but the location of these is not yet known." - Morgan Creek Sewer Interceptor Relocation Bat Surveys, EPR, 22 August 2023. The proposed Morgan Creek Interceptor Replacement project is a single and complete project and includes a 1,000-foot section of sewer line that has undergone numerous emergency repairs and is in critical need of replacement. The purpose of the replacement is to improve the ability of the existing line to meet the current and projected future flow conditions. The project will not increase the existing utility footprint, and no additional development is anticipated to result from the project. The project has been identified as critical, and the planning and design are 100% complete, including construction drawings. The "Phase II" project is a separate project that is being reviewed for OWASA's comprehensive Critical Improvements Plan (CIP). This plan includes future projects to be completed in the utility's service area. The project has not been designed and is still undergoing the initial planning and environmental investigations to avoid and minimize any potential environmental impacts that could be associated with these future improvements to the utility. Version: May 2017 Page 3 Jurisdictional Determination Request F. JURISDICTIONAL DETERMINATION (JD) TYPE (Select One) ❑ I am requesting that the Corps provide a preliminM JD for the property identified herein. A Preliminary Jurisdictional Determination (PJD) provides an indication that there may be "waters of the United States" or "navigable waters of the United States"on a property. PJDs are sufficient as the basis for permit decisions. For the purposes of permitting, all waters and wetlands on the property will be treated as if they are jurisdictional "waters of the United States". PJDs cannot be appealed (33 C.F.R. 331.2); however, a PJD is "preliminary" in the sense that an approved JD can be requested at any time. PJDs do not expire. ❑ I am requesting that the Corps provide an approved JD for the property identified herein. An Approved Jurisdictional Determination (AJD) is a determination that jurisdictional "waters of the United States" or "navigable waters of the United States" are either present or absent on a site. An approved JD identifies the limits of waters on a site determined to be jurisdictional under the Clean Water Act and/or Rivers and Harbors Act. Approved JDs are sufficient as the basis for permit decisions. AJDs are appealable (33 C.F.R. 331.2). The results of the AJD will be posted on the Corps website. A landowner, permit applicant, or other "affected party" (33 C.F.R. 331.2) who receives an AJD may rely upon the AJD for five years (subject to certain limited exceptions explained in Regulatory Guidance Letter 05- 02). ❑ I am unclear as to which JD I would like to request and require additional information to inform my decision. G. ALL REQUESTS ❑ Map of Property or Project Area. This Map must clearly depict the boundaries of the review area. ❑ Size of Property or Review Area +1- 13 acres. ❑ The property boundary (or review area boundary) is clearly physically marked on the site. Further, an AJD, a proffered individual permit (and all terms and conditions contained therein), or individual permit denial can be administratively appealed pursuant to 33 C.F.R. Part 331.
