Thank you for your response on 12/18/23 to the Corps' RFAI of 12/13/23, the information is under review.
Additionally, upon further review of the information provided in the 11/27/23 PCN and the RFAI response referenced
above, the following information is required to complete our evaluation, confirm compliance with one or more General
or Regional Conditions, and/or complete consultation with another federal/state agency to verify the use of NWP-29:
The PCN indicates in Section 5a-d that potentially jurisdictional boundaries of streams and wetlands have been
delineated and verified by the Corps. Although partial delineation information was included in your PCN,
complete delineation information and documentation for USACE concurrence was not included. Per NWP 29
General Condition 32(b)(5), this information is necessary to process your request to verify the use of this NWP,
and as such your PCN is considered on hold until this information is provided. Note also that a site visit may be
required to verify your delineation of potential waters of the US. Further, additional revisions may be required
on the PCN and plans based on the final Corps -verified boundaries of potential waters of the US.

Specifically, I cannot confirm that a PJD or Delineation Concurrence was issued because I cannot locate
that documentation in our files or database. Delineation documentation and Corps concurrence should
always be submitted with your PCN. Please submit the PJD/DC and all correspondence, data sheets,
supplemental documentation via email to me so that I may continue review of the proposed project.
Additionally, based on evidence reviewed by the Corps in association with our review of this project
application there is sufficient reason to assume there are jurisdictional wetlands and additional
jurisdictional streams in the project review area. Per General Condition 32.(4)(i) A description of the
proposed activity; the activity's purpose; direct and indirect adverse environmental effects the activity
would cause, including the anticipated amount of loss of wetlands, other special aquatic sites, and other
waters expected to result from the NWP activity, in acres, linear feet, or other appropriate unit of
measure; a description of any proposed mitigation measures intended to reduce the adverse
environmental effects caused by the proposed activity; and any other NWP(s), regional general
permit(s), or individual permit(s) used or intended to be used to authorize any part of the proposed
project or any related activity, including other separate and distant crossings for linear projects that
require Department of the Army authorization but do not require pre -construction notification. The
description of the proposed activity and any proposed mitigation measures should be sufficiently
detailed to allow the district engineer to determine that the adverse environmental effects of the
activity will be no more than minimal and to determine the need for compensatory mitigation or other
mitigation measures.
Per General Condition 15. Single and Complete Project. The activity must be a single and complete project. The
same NWP cannot be used more than once for the same single and complete project. PCN Section 6a. Is this a
phased project? Answer: No.
a. This answer contradicts supplemental documentation to the contrary — specifically the following:
"Phase II of the project involves the installation of approximately 1,500 linear feet of 36-inch gravity
sanitary sewer as a parallel replacement for the existing gravity sewer. The new sewer is anticipated to
be installed via open cut and will result in permanent and temporary impacts. Design of Phase II has
not begun, however permanent impacts are assumed to be an additional 15-ft of cleared area (parallel
to existing cleared easement). Additionally, permanent impacts may include installation of permanent
access from Flat Stone Court or the Mason Farm Wastewater Treatment Plant. Temporary impacts are
assumed to be a 30-foot cleared area parallel to the alignment to be used during construction. It is
likely that two approximately 50 feet by 50 feet laydown areas will be placed within the project area but
the location of these is not yet known." — Morgan Creek Sewer Interceptor Relocation Bat Surveys, EPR,

This email is in reference to the Pre -construction notification (PCN) for the proposed OWASA Morgan Creek Interceptor
Replacement Project (SAW- 2022-01307), received on 27 November 2023. 1 am the USACE Wilmington District Raleigh
Regulatory Field Office project manager for Orange County. You can update your records/contacts for the District by
referencing our Regulatory Areas of Responsibility located and updated regularly here

The following information is required to complete our evaluation, confirm compliance with one or more General or
Regional Conditions, and/or complete consultation with another federal/state agency to verify the use of the
Nationwide Permit (NWP):
1. Stream impacts proposed are for one sewer crossing at one stream location via open cut with bank stabilization
(0.08-acre Permanent no -permanent -loss). Please provide construction details specific to this impact activity
including plan/profile/cross-section views overlaid on the delineation and base map clearly depicting the
location, size, and dimensions of the activities, including amount (cy) of fill and the OHWM, and depicting the
type (riprap, etc.) and placement methodology for bank stabilization.
2. For all dewatering activities please provide additional details on the proposed methods for dewatering,
sequencing, equipment, length of time proposed to be dewatered, and methods for restoration.
3. Would any of your proposed activities related to impacts to waters of the US require temporary construction
access in the vicinity of any waters of the US? Please provide additional details as applicable.
4. With regard to impacts to waters of the US and the potential to impact listed aquatic species, please provide
photographs of the stream crossing impact area and additional photos representative of the stream conditions
with regard to the freshwater mussels survey report which did not include photos.
5. Endangered Species Act Section 7: Corps determination for effect for the Atlantic pigtoe (Fusconaia masoni)
"May affect, not likely to adversely affect" — informal consultation with USFWS for concurrence was initiated via
email to USFWS on 13 December 2023. 1 will continue to review and process your permit application and notify
you once the consultation process between USFWS and USACE is complete.
6. Although your PCN indicates you are requesting authorization under NWP-12, that permit is no longer applicable
to water utilities. Your project could be authorized under NWP-58, attached, please review and respond with
confirmation on the updated Nationwide Permit.
7. Please note I corrected a notation error for your Site Coordinates section on page 1 of your PCN to: Latitude
(NAD83) 35.892857, Longitude (NAD83)-79.032245
Please provide the requested information within 30 days, or your application will be administratively withdrawn. To
